About determination of payment procedure of pensions to some categories of persons in 2026 in the period of warlike situation

According to article 30 of the Law of Ukraine "About the Government budget of Ukraine for 2026" the Cabinet of Ministers of Ukraine decides:

1. Determine that in the period of warlike situation in 2026 of pension (retirement benefits) appointed (listed) according to the Customs code of Ukraine, the laws of Ukraine "About public service" "About prosecutor's office", "About the status of the People's Deputy of Ukraine", "About the National Bank of Ukraine", "About the Cabinet of Ministers of Ukraine", "About diplomatic service", "About service in local government bodies", "About judicial examination", "About the status and social protection of the citizens who were injured owing to the Chernobyl catastrophic crash", "About the state support of mass media and social protection of journalists", "About scientific and scientific and technical activities", "About provision of pensions of persons discharged from military service and some other persons", resolutions of the Verkhovna Rada of Ukraine of October 13, 1995 No. 379/95-BP "About approval of the Regulations on the assistant-consultant to the People's Deputy of Ukraine" (taking into account allowances, increases, to additional pension, the target monetary assistance, pension for special merits in front of Ukraine, indexation and other pension supplements established by the legislation) which size exceeds 10 sizes of the subsistence minimum established for persons which lost working capacity are paid using coefficients to the corresponding amounts of exceeding:

to part of pension (retirement benefit) which is exceeding 10 sizes of the subsistence minimum established for persons which lost working capacity, and not exceeding 11 sizes of the subsistence minimum established for persons which lost working capacity - 0,5;

to part of pension (retirement benefit) which is exceeding 11 sizes of the subsistence minimum established for persons which lost working capacity, and not exceeding 13 sizes of the subsistence minimum established for persons which lost working capacity - 0,4;

to part of pension (retirement benefit) which is exceeding 13 sizes of the subsistence minimum established for persons which lost working capacity, and not exceeding 17 sizes of the subsistence minimum established for persons which lost working capacity - 0,3;

to part of pension (retirement benefit) which is exceeding 17 sizes of the subsistence minimum established for persons which lost working capacity, and not exceeding 21 sizes of the subsistence minimum established for persons which lost working capacity - 0,2;

to part of pension (retirement benefit) exceeding 21 sizes of the subsistence minimum established for persons which lost working capacity - 0,1.

To the persons who are receiving pensions (retirement benefits) in the amount of, certain in paragraph one of this Item, and having pension entitlement according to the Law of Ukraine "About obligatory national pension insurance" and in which the size of the pension estimated according to Article part one 27, of paragraph two of part one of Article 28 and article 29 of the Law of Ukraine "About obligatory national pension insurance" exceeds 10 sizes of the subsistence minimum established for persons which lost working capacity coefficients are applied to the corresponding amounts of exceeding of the pension granted (listed) according to the acts of the legislation specified in paragraph one of this Item over the pension amount estimated according to Article part one 27, of paragraph two of part one of Article 28 and article 29 of the Law of Ukraine "About obligatory national pension insurance".

2. Determine that in the period of warlike situation in 2026 the coefficients determined by Item 1 of this resolution are not applied to pensions (retirement benefits) of persons which were directly involved in anti-terrorist operation, ensuring its carrying out, being directly in areas of anti-terrorist operation during its carrying out, direct participation in implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions, ensuring their implementation, being directly in areas and during implementation of the specified actions, were directly involved in the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with military aggression of the Russian Federation against Ukraine, being directly in areas and during implementation of the specified actions, and also to pensions in case of loss of the supporter, the dead (the dead, missing persons) of such persons appointed to family members that is confirmed by the data from the Unified state register of veterans of war received by the Pension fund of Ukraine according to the procedure of information exchange with the Ministry of cases of veterans.

3. Recognize invalid:

the resolution of the Cabinet of Ministers of Ukraine of January 3, 2025 No. 1 "About determination of payment procedure of pensions to some categories of persons in 2025 in the period of warlike situation" (The Official Bulletin of Ukraine, 2025, No. 9, the Art. 769);

the resolution of the Cabinet of Ministers of Ukraine of February 4, 2025 No. 116 "About modification of Item 2 of the resolution of the Cabinet of Ministers of Ukraine of January 3, 2025 No. 1" (The Official Bulletin of Ukraine, 2025, No. 19, the Art. 1276).

4. This resolution becomes effective since January 1, 2026.
