About modification of some orders of the Government (expansion of the right to social payments)

Based on part (3) article 5 of the Law No. 289/2004 on temporary disability benefits and other benefits of social insurance (The official monitor of the Republic of Moldova, 2004, Art. No. 168-170, 773), with subsequent changes, and article 6 of the Law No. 315/2016 on social payments on children (The official monitor of the Republic of Moldova, 2017, Art. No. 19-23, 56), with subsequent changes, DECIDES: the Government

1. In the Regulations on procedure for appointment and allowance payment to families with children approved by the Order of the Government No. 1478/2002 (Official monitor of the Republic of Moldova, 2002, Art. No. 154-157, 1612), with subsequent changes, to make the following changes:

1.1. add with Item 2-3 of the following content:

"2-3. In case of independent entrepreneurs calculation of the insurance years of service necessary for purpose of the benefits provided in subitems c), e), f) and g) Item 4, join the periods for which fees of compulsory national social insurance, since January 1, 2026 were paid.";

1.2. in Item 7:

1.2.1. 3) to add the subitem with the letter d 1) of the following content:

"d 1) in case of independent entrepreneurs - from the date of, the end of maternity leave following behind day, according to the options provided in Item 42, if they confirm the insurance years of service provided in Item 2. If the female independent entrepreneur does not receive maternity allowance, the benefit is established since the birth of the child, except as specified, provided in letter r);";

1.2.2. add subitem 4-2) with the letter d 1) of the following content:

"d 1) in case of independent entrepreneurs if they correspond to the condition about availability of insurance years of service provided in Item 2, - within 90 calendar days from the date of establishment of adoption or the edition of the order about accommodation of the child in service of guardianship/guardianship";
