About social payments on children

The parliament adopts this organic law.

Chapter I. General provisions

Article 1. Subject and purpose of the law

This law establishes social payments on children for the purpose of providing the minimum financial support from the state in case of the child's birth, for child care, for maintenance of twins, and also social payments in support of the adopted children, children, temporarily without parental support, and children without parental support, including for training continuation.

Article 2. Coverage of this law

Within this law children – citizens of the Republic of Moldova taking the residence in the Republic of Moldova, children who are acknowledged as stateless persons in the Republic of Moldova, and the foreign children living in the Republic of Moldova can use social payments.

Article 3. Basic concepts

For the purpose of this law the following concepts mean:

monetary value of the minimum basket of necessary goods in case of the child's birth – the monetary value of the minimum set of the things necessary for ensuring care of the newborn established according to the methodology approved by the Ministry of Labour and Social Protection;

the child, temporarily without parental support, – the child to whom the order of territorial authority of guardianship according to provisions of the Law on special protection of children, being in risk situation, and the children separated from parents No. 140 of June 14, 2013 establishes the status of the child, temporarily without parental support;

the child, without parental support, – the child to whom the order of territorial authority of guardianship according to provisions of the Law on special protection of children, being in risk situation, and the children separated from parents No. 140 of June 14, 2013 establishes the status of the child, without parental support;

the adopted child – the child adopted according to the procedure of national or international adoption.

Chapter II. Types and the amount of social payments on children

Article 4. Types of social payments on children

(1) On the child in case of the birth the lump-sum allowance in case of the child's birth is provided.

(2) On the child aged up to two years the monthly allowance on child care is provided to uninsured person.

(3) On twins or is more than children born from one pregnancy, the monthly allowance on content before achievement of age by them is provided three years on each child.

(4) On the child, temporarily without parental support, and the child, without parental support, placed in service of guardianship/guardianship, the monthly allowance on content of the child who is under guardianship/guardianship is provided.

(5) On the adopted child the monthly allowance on content of the adopted child is provided.

(6) On children, temporarily without parental support, and children without parental support, and also on young people who before achievement of 18 years had the status of the child without parental support, continuing training in organizations of professional and higher education, the benefit for training continuation is provided.

(7) On children with the status of the child, temporarily without parental support, and the child, without parental support, 18 years which are in service of placement of family type, in social service the Communal house for the children who are in risk situation, in social service the Center of accommodation of the children separated from parents and students in educational institutions since the fifth class and before achievement of age by them, the daily benefit for the child is provided.

Article 5. The amount of social payments on children

(1) the Lump-sum allowance in case of the birth of the child is established in the amount of, equal to monetary value of the minimum basket of necessary goods in case of the birth of the child calculated in the year preceding the child's birth. The size of lump-sum allowance in case of the child's birth annually affirms the Government.

(2) the Monthly allowance on child care before achievement of age by it two years to uninsured person, monthly allowance on content of the child who is under guardianship/guardianship, monthly allowance on content of the adopted child, and also benefit for continuation of training are paid in the size approved by the Government.

(3) the Monthly allowance on content of twins or is more than children born from one pregnancy, before achievement of age by them provide three years according to the statement of insured and uninsured persons in the amount of 50 percent of the size of monthly allowance on child care before achievement of the age by it two years provided for uninsured persons according to part provisions (2), on birth date of the child.

Chapter III. Procedure for establishment and payment and source of financing of social payments on children

Article 6. Procedure for establishment and payment

The procedure for establishment and payment of social payments on the children provided by this law is established by the Government.

Article 7. Financing source

The social payments on children provided by this law are paid from the government budget.

Chapter IV. Final and transitional provisions

Article 8

(1) This law becomes effective since January 1, 2017.

(2) the Size of lump-sum allowance in case of the birth of the child is established according to provisions of this law for the children born since January 1, 2017.

(3) the Monthly allowance on child care before achievement of age by it and monthly allowance on content of twins or is more two years than children born from one pregnancy, before achievement of age by them three years it is established for the children born since January 1, 2017.

(4) the Amount of the social payments regulated by this law affirms the law on the government budget and the law on the budget of the national social insurance for the corresponding years.

(5) to the Government in six-months time from the date of entry into force of this law to bring the regulations into accord with this law, to develop and approve the regulations necessary for implementation of this law.
