About benefits to families with children

For the purpose of social protection of families with children and according to the Law No. 315 of December 23, 2016 on social payments on children (The official monitor of the Republic of Moldova, 2017, Art. No. 19-23, 56) DECIDES: the Government of the Republic of Moldova

1. Approve Regulations on procedure for appointment and allowance payment to families with children it (is applied).

2. Expenses on accomplishment of provisions of this resolution are covered respectively:

by budget funds of the national social insurance - monthly allowance on education of the child for insured persons, lump-sum allowance for entrusting of the adopted child, the lump-sum allowance on the child adopted or accepted under guardianship/guardianship, and monthly allowance on education of the child is more senior than 3 years adopted or accepted under guardianship/guardianship;

at the expense of means of the government budget - lump-sum allowance in case of the child's birth; monthly allowance on child care before achievement of age by it 2 years and monthly allowance on content of two or more children born from one pregnancy before achievement of age of three years by them.

Regulations on procedure for appointment and allowance payment to families with children

I. General provisions

1. To families with children the families with children taking the residence or the location in the Republic of Moldova have the right to benefits.

2. Insured person according to this provision person who conforms to requirements, the stipulated in Article 6 Laws on temporary disability benefits and other benefits of social insurance No. 289-XV of July 22, 2004 is considered.

 2-1. In case of the insured persons provided in Item 1-1) of article 4 of the Law No. 489/1999 on the state system of social insurance in case of calculation of the insurance years of service necessary for purpose of the benefits provided in subitems c), e), f) and g) Item 4, the entire periods of execution of service as the serviceman or the employee (employee) with special status in bodies of national defense, state security and public order till January 1, 2017 join.

2-2. In case of persons of the liberal professions performing activities in the sphere of justice calculation of the insurance years of service necessary for purpose of the benefits provided in subitems c), e), f) and g) Item 4, join the periods for which the fixed amount of fee of compulsory national social insurance determined since January 1, 2021 is paid.

3. In case of calculation of the insurance years of service granting the right to purpose of the benefits provided in subitems c), e), f) and g) Item 4, also not insurance periods equated to insurance join: the periods of accomplishment of the urgent or reduced military service, the period of child care aged up to 3 years one of parents or, in case of the death of both parents, the guardian, the period of receipt of payment for unemployment, the period in which insured person received benefit on employment, the period in which person received temporary disability benefit.

3-1. The legal representative of the child who on birth date of the child is considered uninsured person:

- it is not employed;

- works, however has no necessary working life for purpose of the benefits provided in subitems c), e), f) and g) item 4;

- performs the activities in quality: the individual entrepreneur, the owner of the entrepreneurial patent, except for specified persons who perform labor activity including at other companies in which have the insured income and have the right based on the law, to monthly allowance on education of the child.

II. Types and sizes of benefits to families with children

4. Families with children have the right to the following types of benefits:

a) lump-sum allowance in case of the child's birth;

b) monthly allowance on child care before achievement of age by it 2 years;

c) monthly allowance on education of the child, according to options - for insured persons;

d) monthly allowance on content of twins or more children born from one pregnancy before achievement of age of 3 years by them;

e) lump-sum allowance for entrusting of the adopted child;

f) lump-sum allowance on the child adopted or accepted under guardianship/guardianship;

g) the monthly allowance on education of the child is more senior than 3 years adopted or accepted under guardianship/guardianship.

4-1. Since October 1, 2022 the monthly allowance on child care before achievement of age of 2 years by it is paid including to persons (legal representatives of the child) who have the right to monthly allowance on education of the child.

4-2. The monthly allowance on education of the child is granted to one of insured parents according to the following options:

a) from the date of, the end of maternity leave following behind day before achievement of 3 years by the child of age;

b) from the date of, the end of maternity leave following behind day, for a period of 24 months. For the period after the expiration of 24 months and before achievement of 3 years by the child of age the monthly allowance on education of the child is not provided;
