About start and realization of pilot project on rendering the state services "Issue of Permission to Foreigners and Stateless Persons to Permanent Residence in the Republic of Kazakhstan" and "Assignment or Prolongation of the Status of Kandas"

1. Start pilot project on rendering the state services "Issue of Permission to Foreigners and Stateless Persons to Permanent Residence in the Republic of Kazakhstan" and "Assignment or Prolongation of the Status of Kandas" for the immigrants arriving to the Republic of Kazakhstan for the purpose of permanent residence by means of conducting testing, questioning on the migration.enbek.kz platform of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan and interview in the place of stay.

2. Approve:

1) Rules of conducting testing, questioning and interview of the immigrants arriving for permanent residence to the Republic of Kazakhstan according to appendix 1 to this order;

2) Rules of assignment of the status of kandas according to appendix 2 to this order;

3) Rules of issue to foreigners and stateless persons of permission to permanent residence in the Republic of Kazakhstan according to appendix 3 to this order.

3. To provide to "Center of Development of Manpower" joint-stock company for the purpose of realization of pilot project necessary accesses for the authorized staff of Departments of police of areas, the cities of republican value and the capital.

4. To provide to the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan together with the Ministry of Internal Affairs of the Republic of Kazakhstan:

1) realization of access according to the Rules approved by Item 2 of this order;

2) training of authorized staff of local executive bodies of areas, cities of republican value and capital, non-commercial joint-stock company "Government for Citizens state corporation, Departments of police;

3) bringing this order to data of local executive bodies of areas, the cities of republican value and the capital, Departments of police for management in work.

5. To the ministry of artificial intelligence and digital development of the Republic of Kazakhstan, the Ministry of Foreign Affairs of the Republic of Kazakhstan and Committee of homeland security of the Republic of Kazakhstan to take the necessary measures following from this order and to bring this order to the attention and for management in work to non-commercial joint-stock company "The Government for Citizens state corporation, to foreign institutions of the Republic of Kazakhstan and territorial subdivisions of Committee of homeland security of the Republic of Kazakhstan.

6. "The Government for Citizens state corporation to provide to non-commercial joint-stock company functioning of sectors of self-service in which consultation on questions of use of services of the web portal of "the electronic government" and use of the digital signature, and also provision of opportunity to immigrants of independent receipt of the state services rendered by means of the web portal of "the electronic government" is performed.

7. To provide to committee on migration of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) within five calendar days after signing of this joint order the direction it in the Kazakh and Russian languages in the republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this joint order on official Internet resource of the Ministry of Labour and Social Protection of the population of the Republic of Kazakhstan after its official publication;

3) within ten working days after execution of subitems 1) and 2) Item 7 of this order submission of information on execution to departments of legal service of the Ministry of Labour and Social Protection of the population and internal affairs of the Republic of Kazakhstan.

8. To impose control of execution of this joint order on the supervising vice-Minister of Labour and Social Protection of the population and the deputy minister of internal affairs of the Republic of Kazakhstan.

9. This order becomes effective after day of its official publication and is effective till December 31, 2026.

Rules of conducting testing, questioning and interview of the immigrants arriving for permanent residence to the Republic of Kazakhstan

Chapter 1. General provisions

1. These rules establish single procedure for conducting testing, questioning and interview for the immigrants arriving to permanent residence to the Republic of Kazakhstan (further - Rules) and include passing of the five-stage digital assessment on the basis of automatic assignment of points by in advance determined criteria applied concerning persons applying for permanent residence and receipts of the status of kandas.

2. In these rules the following concepts are used:

1) the applicant – physical person from among immigrants and the members of his family (in the presence) applying for permanent residence in the Republic of Kazakhstan including on receipt of the status of kandas;

2) system of criteria assessment of immigration potential – the structured tool based on mark model intended for quantitative assessment and ranging of applicants on immigration on the basis of set of social and demographic, educational, language, professional and other adaptation indicators;

3) the notification on passing of criteria assessment of immigrants for permanent residence in the Republic of Kazakhstan – the document of local executive body concerning social protection and employment of the population about the admission or about refusal in the admission to the further state services "Issue of Permission to Foreigners and Stateless Persons to Permanent Residence in the Republic of Kazakhstan" and "Assignment of the Status of Kandas", accepted based on results of passing of system of criteria assessment of immigration potential;

4) local executive body concerning social protection and employment of the population – the local executive body of area, the cities of republican value, the capital determining the directions in the field of social protection and employment of the population;

5) the employee of department (department, group) migratory service (further – the employee of compulsory health insurance) – the official of divisions of migratory service of Departments of police of areas, cities of republican value and the capital who performs processing and consideration of the applications on receipt of permission to permanent residence in the Republic of Kazakhstan;

6) permission to permanent residence in the Republic of Kazakhstan (further – RPP) – the document issued by law-enforcement bodies to foreigners and stateless persons in case of observance of the requirements established by the legislation of the Republic of Kazakhstan, and granting them the right to permanent residence in the territory of the Republic of Kazakhstan;

7) the residence permit of the foreigner in the Republic of Kazakhstan (further – the residence permit) – the identity document of the foreigner in the territory of the Republic of Kazakhstan and confirming receipt of RPP by it in the Republic of Kazakhstan;

8) the portal of migratory processes "migration.enbek.kz" (further - the portal) – subsystem of digital ecosystem the "Electronic employment exchange" (enbek.kz) providing accounting and movement of migrants, and also monitoring of provision of services in the field of migration;

9) foreign institutions of the Republic of Kazakhstan – the diplomatic and equated to them representations being located abroad, and also consular establishments of the Republic of Kazakhstan.

3. These rules do not extend to the foreigners and persons without citizenship arriving to the Republic of Kazakhstan for the purpose of implementation of labor activity, business immigration, investor and tourist activities, education for humanitarian and political motives.

Chapter 2. Procedure for conducting testing and questioning, implementation of checks, passings of interviews for the immigrants driving on permanent residence to the Republic of Kazakhstan

4. Testing on the KAZTEST system for knowledge of Kazakh of the immigrants arriving for permanent residence in the Republic of Kazakhstan including for assignment of the status of kandas is carried out through the KAZTEST digital system to online format according to the Rules on system of assessment of level of proficiency in Kazakh of "KAZTEST" approved by the order of the Minister of science and the higher education of the Republic of Kazakhstan of September 23, 2024 No. 458 (further – Rules KAZTEST) (it is registered in the Register of state registration of regulatory legal acts No. 35109).

Testing for knowledge of Kazakh is held in online format. Testing duration – 1 hour 10 minutes. Testing includes the following blocks consisting of 60 questions with one version of the correct answer:
