About provision of services of employment rehabilitation for integration of persons with limited opportunities in labor activity

Based on part (3) Article 10 and part (2) article 15 of the Law No. 547/2003 on the public assistance (The official monitor of the Republic of Moldova, 2004, Art. No. 42-44, 249), with subsequent changes, and also parts (4) Article 29 and part (4) article 29-1 of the Law No. 105/2018 on assistance of employment of the population and insurance on unemployment (The official monitor of the Republic of Moldova, 2018, Art. No. 295-308, 448), with subsequent changes, DECIDES: the Government

1. Approve:

1.1. Standard regulations on provision of services of employment rehabilitation, according to appendix No. 1;

2.1. The minimum quality standards for services of employment rehabilitation, according to appendix No. 2.

2. To perform expenses on provision of services of employment rehabilitation for the account and within the financial assignments which are annually approved on these purposes in the budget of the Ministry of Labour and Social Protection, and other sources according to the legislation.

3. To impose control over the implementation of this resolution on the Ministry of Labour and Social Protection.

4. Declare invalid the Order of the Government No. 272/2017 about the services in employment rehabilitation provided by the Republican experimental prosthetic and orthopedic and rehabilitation center (The official monitor of the Republic of Moldova, 2017, Art. No. 144-148, 348), with subsequent changes.

5. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

Standard regulations on provision of services of employment rehabilitation

Chapter I. General provisions

1. The standard regulations on provision of services of employment rehabilitation (further - the Provision) establish procedure for the organization, functioning, financing and provision of services of employment rehabilitation as services of support and assistance of social inklyuziya, integration, reintegration and/or preserving employment of persons with limited opportunities.

2. Services of employment rehabilitation are the services of support for the purpose of employment intended for persons with the limited opportunities oriented to recovery and compensation of functional and professional capabilities for the purpose of long-term social and professional integration.

3. Employment rehabilitation represents the integrated service of the help and support to persons with limited opportunities which includes measures for assessment, recovery of functions of organism, professional orientation, consultation and professional training.

4. For the purpose of this provision the following concepts are used:

the beneficiary - person who corresponds to the conditions provided by this Provision and uses services of employment rehabilitation;

the service provider of employment rehabilitation (supplier) - the legal entity of public or private law accredited according to the legislation which provides services of employment rehabilitation to persons with limited opportunities according to this Provision;

multi-profile group - the group of specialists according to this Provision created by the supplier which provides working capacity assessment, planning, realization and monitoring of services of employment rehabilitation depending on individual needs of the beneficiary, according to the individualized plan of the help.

Chapter II. Purpose, tasks and principles of services of employment rehabilitation

5. The purpose of services of employment rehabilitation is development, preserving or recovery of working capacity, assistance of integration or reintegration of persons with limited opportunities on the labor market in the conditions of equality and nondiscrimination

6. Tasks of services of employment rehabilitation are:

6.1. assessment and the analysis of functional, cognitive and professional capabilities for the purpose of determination of proper measures of intervention for employment rehabilitation, integration or reintegration on the labor market;

6.2. development of the individualized plan of the help in area of employment rehabilitation;

6.3. recovery and compensation of functional and professional capabilities for the purpose of increase in autonomy and assistance of social and professional integration, when ensuring active participation of persons with limited opportunities, observance of their rights and promotion of equal opportunities;

6.4. assistance to interdepartmental cooperation in the field of employment rehabilitation;

6.5. ensuring consultation and professional training for long-term integration of persons with limited opportunities on the labor market.

7. The principles of the organization and functioning of services of employment rehabilitation are:

7.1. the approach oriented per capita in case of which the beneficiary is in the center of process of employment rehabilitation;

7.2. respect for human rights, advantages, equalities and nondiscriminations in case of access to services of employment rehabilitation;

7.3. active participation of the beneficiary and receipt of the informed consent on all planned measures;

7.4. individualized approach according to professional rehabilitation potential;

7.5. interdepartmental cooperation for ensuring the continuous integrated and coordinated support.

Chapter III. Organization and provision of services of employment rehabilitation

8. The supplier performs the following powers in the field of provision of services of employment rehabilitation:

8.1. will organize and provides provision of services of employment rehabilitation according to the principles of equal opportunities, nondiscrimination and social inklyuziya;

8.2. provides availability of the personnel necessary for provision of services of employment rehabilitation, within the approved staff list;

8.3. will organize and provides initial and continuous training of the personnel involved in provision of services of employment rehabilitation;

8.4. makes the decision on the admission of applicants to services of employment rehabilitation based on multi-profile assessment;

8.5. establishes the schedule and duration of provision of services of employment rehabilitation depending on individual needs of beneficiaries;

8.6. cooperates with National employment agency of the population, the Republican center of the psychopedagogical help, in appropriate cases - with other organizations of medical rehabilitation, suppliers of educational services, territorial agencies of the public assistance, and also with employers;

8.7. provides observance of the rights of beneficiaries during provision of services of employment rehabilitation.

9. Services of employment rehabilitation are provided by specialists of Service of employment rehabilitation, including: the psychologist, the psychoteacher, in appropriate cases - the social assistant, the specialist doctor on work medicine / ergoterapevty, the kinesitherapist, and also other specialists, depending on individual needs of beneficiaries.

10. The social assistant who at the same time is the manager (head / conductress) of services of employment rehabilitation performs the following powers:

10.1. provides management of services of employment rehabilitation;

10.2. develops the individualized plan of the help of the beneficiary based on multi-profile assessment;

10.3. participates in implementation of measures, provided in the individualized plan of the help;

10.4. estimates the needs for continuous personnel training;

10.5. establishes and realizes individualized measures of intervention;

10.6. provides cooperation with National employment agency of the population, the Republican center of the psychopedagogical help, in appropriate cases - with other organizations of medical rehabilitation, suppliers of educational services, territorial agencies of the public assistance, and also with employers.

11. The psychologist / psychoteacher performs the following powers:

11.1. carries out assessment of needs for psychosocial rehabilitation and formulates recommendations about employment rehabilitation;

11.2. gives psychological consultation and emotional support;

11.3. applies methods and technology of psychological intervention, specific to employment rehabilitation;

11.4. participates in development and implementation of the individualized plan of the help.

12. The specialist doctor on work medicine / ergoterapevt/the kinesitherapist performs the following powers:

12.1. estimates working capacity and potential of social and professional integration;

12.2. determines the needs for employment rehabilitation;

12.3. establishes and applies individualized measures of intervention;

12.4. promotes development of the skills necessary for implementation of professional activity;

12.5. participates in development and implementation of the individualized plan of the help.

13. Other involved personnel perform the following powers:

13.1. provides assessment and employment rehabilitation according to individual requirements;

13.2. reveals the needs for providing with supportive applications;

13.3. gives support in development of skills of use of supportive applications;

13.4. promotes recovery and/or compensation of the broken functional capabilities within the professional competence;

13.5. participates in development and implementation of the individualized plan of the help.

14. Beneficiaries of services of employment rehabilitation are persons with limited opportunities which lost workplace, are in job search or are employed and need additional support for integration / reintegration into labor activity.

15. The direction of beneficiaries to services of employment rehabilitation is performed:

15.1. territorial subdivisions of employment of the population;

15.2. territorial agencies of the public assistance through territorial subdivisions of the public assistance, and also the structures responsible for the public assistance in municipium of Chisinau or in autonomous territorial education Gagauzia;

15.3. employers - with the consent of person with limited opportunities;

15.4. according to the statement / petition of the potential beneficiary.

Chapter IV. Procedure for acceptance and provision of services of employment rehabilitation

16. Services of employment rehabilitation are provided based on the petition of the bodies / organizations specified in Item 15, of person accompanied with the personal record with limited opportunities.

17. The personal record includes the following documents:

17.1. the statement / petition of person with limited opportunities;

17.2. copy of the certificate of recognition of extent of restriction of opportunities;

17.3. copy of the individualized plan of the help;

17.4. copy of the certificate of the personality / ID card and education documents and/or professional qualification;

17.5. the profile of employment of person including data on professional situation, working conditions, employment opportunities (the characteristic of person and post or potential position, condition on workplace, vacant positions in organization and requirements to position, other relevant data).

18. The term of consideration of the document package transferred and registered at the supplier constitutes 10 days.

19. Acceptance is performed based on the individual assessment which is carried out by multi-profile group of the supplier taking into account need of measures of employment rehabilitation.

20. The individualized plan of the help is developed for each beneficiary.

21. The individualized plan of the help is developed by multi-profile group with participation of the beneficiary or, if necessary, his legal representative.

22. The individualized plan of the help includes recommendations about employment rehabilitation with the notification of the concerned parties participating in process.

23. Provision of services of employment rehabilitation will be organized by the supplier according to this Provision and adapts to individual needs of the beneficiary.

24. Duration of services of employment rehabilitation constitutes no more than 18 days according to assessment of multi-profile group, in case of respect for individual requirements and principles of the approach oriented per capita, inklyuziya, equal opportunities and nondiscrimination.

25. The supplier performs monitoring and assessment of implementation of the individualized plan of the help throughout the entire period of provision of services of employment rehabilitation.

26. Services of employment rehabilitation include:

26.1. multi-profile assessment of individual needs for employment rehabilitation;

26.2. detection of needs for intervention depending on skills and labor potential;

26.3. development of the individualized plan of the help with specific measures, responsible persons and terms of realization;

26.4. implementation of measures, provided by the individualized plan of the help;

26.5. support for development of skills of use of supportive applications;

26.6. recovery of the functional and motive capabilities necessary for implementation of professional activity;

26.7. provision of psychosocial support and psychological consultation;

26.8. assistance to access to services of territorial subdivisions of employment of the population;

26.9. provision of recommendations and consultations concerning employment and professional retraining.

27. Services of employment rehabilitation are subject to certification by the supplier. The sample of the certificate affirms competent authority.

28. The certificate is submitted to territorial subdivision of employment of the population or the employer who petitioned for provision of services of employment rehabilitation.

29. Provision of services of employment rehabilitation can be suspended immediately in case of absence of the beneficiary for receipt of services or is stopped within three days from the date of submission of the written application by it or in case of change of the state of health and/or professional situation which directly influence service provision.

30. The decision on the suspension / termination of services of employment rehabilitation is accepted by multi-profile group and is brought in writing to the attention of the beneficiary / employer with indication of the reasons and the rights of the beneficiary to the address with the statement for service renewal.

Chapter V. Monitoring and assessment

31. Upon completion of provision of services of employment rehabilitation the responsible social assistant provides monitoring and assessment of integration, reintegration or preserving employment of person with limited opportunities which used employment rehabilitation.

32. Monitoring of beneficiaries is performed for the purpose of assessment of extent of their integration, reintegration and preserving employment, in appropriate cases, bucketed 6 and 12 months from the date of the termination of provision of service and include 3,:

32.1. situation concerning employment of the beneficiary;

32.2. preserving and stability of employment relationships;

32.3. risks of professional exclusion and need of establishment of additional measures of support.

33. The supplier represents to the Ministry of Labour and Social Protection the semi-annual / annual statement about provision of services of employment rehabilitation (accounting of persons who addressed for services, and the actual number of beneficiaries, type of the provided rehabilitation and the number of days of rendering services of rehabilitation etc.).

Chapter VI. Procedure for financing of services of employment rehabilitation

34. Financing of services of employment rehabilitation is performed at the expense of means of the government budget, budgets of municipium of Chisinau and autonomous territorial education Gagauzia, the financial resources allocated by the private supplier and also from other sources according to the legislation.

35. Financial accounting of the expenses connected with provision of services of employment rehabilitation is conducted by the supplier according to the legislation.

Chapter VII. Special provisions

36. Responsibility for accomplishment of regulations of this provision is conferred on the supplier.

37. Control and assessment of financial and economic activities of the supplier are performed by industry bodies according to the legislation.

Appendix № 2

The minimum quality standards for services of employment rehabilitation

Informing and promotion - the standard 1

1. The supplier provides informing beneficiaries on the purpose, tasks, the principles and types of support within services of employment rehabilitation.

2. The expected result: beneficiaries are informed on the purpose and tasks, the principles, types of support and help provided within services of employment rehabilitation.

3. Fill rates:

3.1. the supplier informs potential beneficiaries on the purpose, tasks and the principles of services of employment rehabilitation;

3.2. actions for informing are performed with use of available methods (the brochure, the announcement, meetings, the website, social networks);

3.3. the supplier will organize meetings with other service providers - in the field of education, health care, with representatives of bodies of local public authority, non-profit organizations, employers - for the purpose of mutual informing on activities of the supplier, the offered benefits, operating conditions and possibility of cooperation.

Availability and openness - the standard 2

4. The supplier provides equal access to the provided services of employment rehabilitation for the beneficiaries corresponding to eligibility criterions.

5. The expected result: the provided services of employment rehabilitation are available, open and are provided according to individual needs of beneficiaries.

6. Fill rates:

6.1. the supplier performs acceptance of beneficiaries to services of employment rehabilitation based on the procedure established in the Provision;

6.2. services of employment rehabilitation are provided without discrimination and with respect for the principle of equal access for the beneficiaries corresponding to eligibility criterions;

6.3. the supplier documents the procedures and decisions concerning acceptance and access for beneficiaries to services of employment rehabilitation;

6.4. the supplier periodically performs monitoring of procedure for access for beneficiaries to services of employment rehabilitation;

6.5. services of employment rehabilitation adapt depending on individual needs of beneficiaries according to individualized plans of the help.

The approach based on the rights - the standard 3

7. Provision of services of employment rehabilitation is performed on the basis of observance, protection and realization of the rights of person with limited opportunities taking into account individual requirements.

8. The expected result: beneficiaries perform the rights on the terms of equality and advantage, feel respect and are actively involved in process of employment rehabilitation, also participations in decision making which concern them have freedom of choice.

9. Fill rates:

9.1. the supplier observes and protects the rights of persons with limited opportunities in case of provision of services of employment rehabilitation;

9.2. services of employment rehabilitation adapt depending on individual needs of the beneficiaries documented in individualized plans of the help;

9.3. beneficiaries are involved in decision making process, the concerning received leavings and support;

9.4. the supplier provides liberty of choice of beneficiaries concerning actions and services of employment rehabilitation which concern them;

9.5. the supplier periodically performs monitoring of level of satisfaction of beneficiaries concerning observance of their rights and participation in decision making.

Multi-profile approach - the standard 4

10. The supplier provides to the beneficiary integrated approach, involving the corresponding specialists at all stages of provision of services of employment rehabilitation.

11. The expected result: beneficiaries receive the multi-profile help depending on their individual requirements.

12. Fill rates:

12.1. manager (head / conductress) involves the corresponding specialists at all stages of provision of services of employment rehabilitation;

12.2. the tasks established and accepted by specialists are fixed in the individualized plan of the help of the beneficiary;

12.3. manager (head / conductress) documents interventions and results in reports on monitoring and assessment.

Confidentiality and personal data protection - the standard 5

13. The supplier guarantees confidentiality and creates conditions for ensuring collection, processing and storage of personal data of beneficiaries.

14. The expected result: personal data of beneficiaries are protected, their processing is performed according to the legislation, with ensuring confidentiality and safety.

15. Fill rates:

15.1. manager (head / conductress) has internal procedure on ensuring confidentiality and personal data protection;

15.2. the supplier provides training of workers and observance of rules of confidentiality and personal data protection;

15.3. the personnel sign the declaration on confidentiality, impartiality and nondisclosure of personal data;

15.4. beneficiaries are informed on processing of personal data and sign consent to processing of personal data;

15.5. manager (head / conductress) provides that the system of archiving and accounting of data was protected, preventing unauthorized access and loss of data.

The individualized plan of the help - the standard 6

16. The personnel of services of employment rehabilitation develop and realize the individualized plan of the help for each beneficiary.

17. The expected result: beneficiaries get support and the personalized services based on the individualized plan of the help.

18. Fill rates:

18.1. the multi-profile group at acceptance of the beneficiary based on results of assessment of requirements together with personnel within services develops the individualized plan of the help;

18.2. the personnel within services involve the beneficiary in development and implementation of the individualized plan of the help;

18.3. manager (head / conductress) based on the individualized plan of the help signs the agreement on cooperation with the beneficiary;

18.4. manager (head / conductress) provides informing the beneficiary on contents of the individualized plan of the help and the obligations assigned to it.

Interdepartmental cooperation - the standard 7

19. The supplier provides active cooperation with specialists and profile organizations (in the field of employment, education, health care) for the purpose of employment rehabilitation of beneficiaries.

20. The expected result: beneficiaries get access to the services adapted for their requirements by means of interdepartmental cooperation which promotes their employment rehabilitation, active participation and equal access to services.

21. Fill rates:

21.1. the supplier cooperates with organizations and other services for the purpose of implementation of individualized plans of the help for employment rehabilitation of the beneficiary;

21.2. the supplier will organize periodic meetings with other suppliers of social, professional, educational and medical services for exchange of information and the advanced practice;

21.3. the supplier documents interdepartmental interactions and meetings, determining and realizing specific measures for improvement of the services provided to beneficiaries;

21.4. the supplier confirms by means of reports and agreements on cooperation that beneficiaries have access to services of employment rehabilitation, reducing risk of social exclusion.

Human resources - the standard 8

22. The supplier has the qualified human resources providing provision of services according to the Provision, the Minimum quality standards, job descriptions and rules of ethical behavior.

23. The expected result: the service has qualified personnel of sufficient number, according to the legislation, for ensuring effective, safe and continuous provision of services.

24. Fill rates:

24.1. the supplier performs selection, employment and promotion of personnel according to the legislation;

24.2. the supplier approves job descriptions for all workers;

24.3. the supplier employs personnel based on the individual employment contract with observance of requirements of the legislation;

24.4. the personnel of services have routine medical examination in case of employment and periodically - according to regulations;

24.5. the personnel of services respect the rules of professional ethics and deontology in the course of accomplishment of service duties;

24.6. the supplier processes and stores the documents relating to human resources;

24.7. manager (head / conductress) performs monitoring of observance of standards, professional ethics and service quality of employment rehabilitation.

Protection against violence, neglect, operation, brutal and degrading treatment - the standard 9

25. The supplier guarantees protection of beneficiaries against any forms of violence, neglect, operation, brutal or degrading treatment, providing the safe and valid circle promoting preserving advantage and autonomy of the beneficiary.

26. The expected result: beneficiaries of services of employment rehabilitation are protected from any forms of violence, neglect, operation, brutal or degrading treatment.

27. Fill rates:

27.1. the supplier has and applies accurate procedure for prevention, identification, the notification, the message and permission of cases of violence, neglect, operation, brutal or degrading treatment within services;

27.2. the personnel are trained concerning protection of beneficiaries and to procedure for response to situations of violence, neglect, operation, brutal or degrading treatment;

27.3. beneficiaries are informed on forms and signs of violence, neglect, operation, and also of methods of the message on them, including in Service of the free telephone help (0 8001 0808).
