About approval of Regulations about the organization and functioning of the State agency for intellectual property

According to Items b) and e) article 7 of the Law No. 136/2017 on the Government (The official monitor of the Republic of Moldova, 2017, No. 252, the Art. 412), with subsequent changes, part (7) Article 14 and part (1) article 15 of the Law No. 98/2012 on the central branch public management (The official monitor of the Republic of Moldova, 2012, Art. No. 160-164, 537), with subsequent changes, and also part (1) article 6 of the Law No. 114/2014 on the State agency on intellectual property (The official monitor of the Republic of Moldova, 2014, Art. No. 282-289, 600), with subsequent changes, DECIDES: the Government

1. To reorganize the state agency on intellectual property by transformation from the central administrative authority subordinated to the Government, into the administrative authority subordinated to the Ministry of Justice, with form of business - the agency.

2. Establish limiting manpower ceiling of the State agency on intellectual property in number of 127 units, with the annual salary fund according to the legislation.

3. Release of personnel as a result of reorganization, in case of impossibility of its transfer, is performed according to the Law No. 158/2008 on the state position and the status of the government employee, and also with the labor law.

4. Before position assignment of the director of the State agency of intellectual property of power on management of the Agency continue to be performed by the CEO of the State agency on intellectual property.
