About modification of the Order of the Government No. 898/2015 about approval of the Framework regulations on the organization and functioning of Service on assistance and protection of the victims of human trafficking and the Minimum quality standards

Based on part (6) article 17 of the Law No. 241/2005 on the prevention and suppression of human trafficking (The official monitor of the Republic of Moldova, 2005, Art. No. 164-167, 812), with subsequent changes, DECIDES: the Government

1. In the Order of the Government No. 898/2015 about approval of the Framework regulations on the organization and functioning of Service on assistance and protection of the victims of human trafficking and the minimum quality standards (The official monitor of the Republic of Moldova, 2016, Art. No. 2-12, 5) to make the following changes:

1.1. in the resolution:

1.1.1. in the name and in all text of the word of "the victims of human trafficking" shall be replaced with words "the victims and the expected victims of human trafficking";

1.1.2. state Items 3 and 4 in the following edition:

"3. The service provides services within the bodies of the public power, the public or private institutions or the organizations founded by suppliers of social services, physical persons or legal entities irrespective of type of property or form of business on assistance and protection of the victims and expected victims of human trafficking. The service can function as the legal entity of public or private law (Center) with separate material resources and financial management or as structural division without legal position within the subject (Service), using its material resources and financial resources according to the delegated powers. Irrespective of legal form of the organization, service providers approve the regulations on the organization and functioning on the basis of the Framework regulations on the organization and functioning of services of the help and protection of the victims and the expected victims of human trafficking and the minimum quality standards.

4. Service providers represent to the National coordination center of the National mechanism of the direction for protection and the help to the victims of crimes under the Ministry of Labour and Social Protection and to territorial structure of the public assistance the annual statement about activities with indication of the achieved results till January 31 of the year following reporting.";

1.1.3. in Item 6 the text "Ministry of Labour, Social Protection and Family" shall be replaced with words "Ministry of Labour and Social Protection";

1.2. state appendices No. 1 and 2 in the following edition:

"Appendix No. 1

The framework regulations on the organization and functioning of Service on assistance and protection of the victims and expected victims of human trafficking

Chapter I. General provisions

1. The framework regulations on the organization and functioning of Service on assistance and protection of the victims and expected victims of human trafficking (further - the Provision) establish procedure for the organization and functioning of Service on assistance and protection of the victims and expected victims of human trafficking (further - Service).

2. According to this Provision of person skin colors, national, ethnic and social origin, the social status, nationality, language, religion or beliefs, age, sex, gender identity, marital status, sexual orientation, restriction of vomozhnost, the state of health, the HIV status, views, political affiliation, property status, the birth or any other criterion can use services without any form of discrimination, irrespective of race.

3. The service is provided within authorities, organizations or the public or private organizations founded by suppliers of social services, physical persons or legal entities irrespective of type of property or form of business which have the location in the Republic of Moldova and are accredited according to the law as suppliers of social services.

4. The service performs the activities according to legislation provisions, this Provision and the Minimum quality standards or other regulations. The service fully observes the international obligations and obligations of the Republic of Moldova concerning protection and the help to the victims and expected victims of human trafficking. The methodical bases determining procedure for the organization, coordination and application of procedures of acceptance, assessment, planning and intervention are stated in the Operational management on business management, arriving in Service of the help and protection of the victims and expected victims of human trafficking (further - the Operational management of Service).

5. Capacity and infrastructure are adapted for the purposes and tasks of service, and also for specific needs of beneficiaries, providing suitable rooms for accommodation, professional activity and everyday life. The service provides services separately for women and for men. Depending on sex of the adult, vapors "mother child" or "father child", and also vapors consisting of the child and his legal representative are allowed to placement. The separate organization of services of Service provides protection, safety and adaptation of measures of intervention to specific needs of each group of beneficiaries.

6. The service is coordinated and controlled by the founder.

7. Requirements of this provision are applied to employees and volunteers of Service, beneficiaries, and also to representatives of public or private institutions which interact with Service or visit it.

8. In this Provision the concepts and terms determined in the regulatory base in the field of the prevention and fight against human trafficking, the penal legislation in the field of the public assistance and social services are used.

Chapter II. Purpose, tasks and principles of activities

9. The purpose of Service consists in free provision of the specialized services directed to the prevention and fight against human trafficking and the accompanying crimes and also on assistance and ensuring protection of the victims and expected victims of human trafficking, proceeding from specific needs of each beneficiary.

10. Tasks of Service are:

10.1. immediate providing measures of the help and protection, including temporary placement in the safety conditions and confidentiality adapted for requirements and features of each beneficiary;

10.2. assessment of requirements and development of the individualized plan of the help in Service;

10.3. support of social and economic reintegration by means of assistance to access to medical, psychological, social, legal, educational services, and also services in employment;

10.4. monitoring of progress of beneficiaries and tracking of results of intervention in the period of use of services of placement and/or day services;

10.5. providing the security measures directed to prevention of repeated victimization and coercions from dealers in people;

10.6. redirection to specialists at the local level for monitoring of situation after intervention completion;

10.7. intersectoral cooperation in activities for the prevention and fight against human trafficking;

10.8. ensuring continuous training and superviziya of personnel.

11. Services are provided on the basis of the following principles:

11.1. legality;

11.2. equality and nondiscrimination;

11.3. respect for fundamental human rights and realization of the special rights of the victims and expected victims of human trafficking;

11.4. priority respect for the highest interest of the child;

11.5. consent priority;

11.6. respect for human dignity and confidentiality;

11.7. individualized and multi-profile approach;

11.8. freedom of expression and opinion;

11.9. availability;

11:10. efficiency;

11:11. mezhsektoralnost;

11:12. access to justice;

11:13. protection and safety of the victim;

11:14. cooperation and partnership, including international cooperation.

Chapter III. Beneficiaries

12. Beneficiaries of Service are the victims and the expected victims of human trafficking according to the Law No. 241/2005 on the prevention and fight against human trafficking, being citizens of the Republic of Moldova or foreign citizens whose rights are guaranteed by the Law No. 270/2008 on shelter in the Republic of Moldova, the Law No. 274/2011 on integration of foreigners in the Republic of Moldova and the Law No. 200/2010 on regime of foreigners in the Republic of Moldova.

13. Categories of beneficiaries include:

13.1. adults, being the victims and the expected victims of human trafficking;

13.2. vapors the parent / the legal representative - child(children) - the victims and the expected victims of human trafficking.

14. Services adapt to the sensitivity level and individual needs of beneficiaries.

15. The children who became the victims of human trafficking receive the help within Social service "The center of accommodation of the children separated from parents" with observance of the minimum quality standards applicable to this service.

Chapter IV. Types of service

16. Persons allowed in Service free of charge receive, depending on the revealed requirements, services in placement or day services.

17. Services in placement include:

17.1. acceptance and protection in the safe circle;

17.2. temporary accommodation / placement, the corresponding food, including services in hygiene;

17.3. if necessary - clothes, footwear and hygienic sets;

17.4. information consultation on questions of the rights of the beneficiary and access to services;

17.5. legal help / consultation / or help in registration documents/assistance in access to services of primary and qualified legal aid;
