About approval of requirements for fight against the expressed game dependence (ludomaniy)

According to the paragraph to the second "About state regulation of activities for the organization and carrying out gamblings" the Cabinet of Ministers of Ukraine decides parts one of article 16 of the Law of Ukraine:

Approve requirements for fight against the expressed game dependence (ludomaniy) which are applied.

Requirements which concern fight against the expressed game dependence (ludomaniy)

1. These requirements determine actions which shall be performed by organizers of gamblings during implementation of activities for the organization and carrying out gamblings, for the purpose of fight against game dependence (ludomaniy).

2. Terms in these requirements are used in the following value:

the expressed game dependence (ludomaniya) - pathological or problem game dependence of the player;

the game behavior is set of the actions, decisions, reactions and psychological states of the player connected with its participation in gamblings including motivation to participation in game, the choice of types of games, decision making about participation in game, its beginning, duration, breaks in game and its termination, the size of rates, reactions to prize and loss, and also the emotional and cognitive relation to process of game;

pathological game dependence - the game behavior which is shown loss of control of time (lasting) gambling and costs for game, excessive interest in gambling that leads to negative financial effects (excess of expenses on game over personal incomes of the player, availability of debt obligations), the expressed violations of mood because of loss in game, violation of the strong-willed sphere and denial of the problems arising owing to uncontrollable participation in gamblings, lack of the critical relation to the condition and game behavior and opportunity to regulate them (to control);

personnel - the workers of the organizer of gamblings who are directly interacting with players;

problem game dependence - the game behavior which is shown incidental loss of control of time (lasting) gambling and costs for it, the high emotional pressure moderated by the violation of mood and temporary negative emotions connected with loss with preserving in general the critical relation to the condition and game behavior and opportunity to regulate them.

Other terms are used in the value given in the Law of Ukraine "About state regulation of activities for the organization and carrying out gamblings" (further - the Law), the Law of Ukraine "About advertizing" and other regulatory legal acts governing the relations in the field of the organization and carrying out gamblings.

3. The organizer of gamblings during implementation of activities in the field of the organization and carrying out gamblings:

1) is limited by participation of physical person in gamblings in the cases determined by the Law;

2) adheres to the principles of responsible game established Mintsifra;

3) according to the address of the player is made impossible to it by access to personal account, does not allow replenishment of game balance and participation in gamblings by it;

4) is provided by non-admission of creation of personal account and replenishment of game balance to physical person without carrying out its identification (verification, establishment of data), and also in case of inclusion of the player in the Register of persons which limits access to gambling institutions and/or participation in gamblings, and persons which did not reach 21-year age;

5) is provided by establishment of limits of expenses on gambling and time of participation of the player in gambling in case of not establishment by their player independently which cannot exceed the limits set Mintsifra and control of observance of such limits;

6) the web - the website, in particular by placement of the hours displaying urgent time observes the requirements established by part twelve of article 24 of the Law concerning placement on the Internet on the website of information on real time on each page;

7) is provided by availability in personal account of the player of information messages concerning duration of participation of the player in gambling and expenses on gambling through regular periods with confirmation by the player of acquaintance with such information messages and with possibility of adoption by the player of the decision to stop or continue game;

8) provides to the player information on his game behavior (the spent time for game, expenses on game etc.) for certain period (day, week, month) and provides storage of such information and access for the player to it during the entire period of use of personal account of the player;

9) is performed by tracking of game behavior of the player and in case of identification of signs of the expressed game dependence (ludomaniya) stops participation of such player in gambling that does not exempt the organizer of gamblings from obligation of implementation of payment (issue) of prize (prize) according to rules of carrying out gamblings which right arose at the player until such termination;

10) informs the player on signs of pathological and problem game dependence and provides to such player information (contact information, phone number of support service) on organization activity, healthcare institutions and/or health workers who treat game dependence, suppliers of social service of social psychological recovery of persons with game dependence that shall be available in printed form activities in places of implementation for the organization of gamblings or shall be available on websites in case of implementation of activities in the field of the organization and carrying out gamblings on the Internet;

11) performs consulting support of players concerning game dependence by means of online forms and/or phone of support service;

12) in places of implementation of activities in the field of the organization and carrying out gamblings in open entry for players and visitors places information materials of rather game dependence and responsible game, in particular about restriction of age of the player, chances of prize, the principles of responsible game, signs of pathological and problem game dependence and about places where it is possible to receive the help in case of game dependence, stated in state language and translated into English;

13) is provided by periodic briefings with personnel concerning the principles of responsible attitude to gamblings and actions directed to prevention (prevention) of emergence of game dependence;

14) is provided by informing players on rules of the organizer of gamblings, rules of visit of gambling institution, rules of carrying out gamblings, and also on possible loss and loss of means;
