1. Approve the Provision and structure of the State Commission on Radio Frequencies of the Republic of Tajikistan (appendices 1 and 2).

2. Recognize invalid the order of the Government of the Republic of Tajikistan of August 2, 2004 as No. 331 "About the State Commission on Radio Frequencies of the Republic of Tajikistan".

Regulations on the State Commission on Radio Frequencies of the Republic of Tajikistan

1. General provisions

1. The regulations on the State Commission on Radio Frequencies of the Republic of Tajikistan (further – the Provision) determine the purpose, tasks, powers and the organization of activities of the State Commission on Radio Frequencies of the Republic of Tajikistan (further – State commission).

2. State commission is the interdepartmental consultative body performing the activities on joint basis and is the state body on realization of single policy of management of radio frequencies providing long-term policy of distribution planning and use of radio-frequency range, national resource, ensuring electromagnetic compatibility of radio-electronic means of users in the territory of the country and protecting interests of the state in the international organizations.

3. State commission in the activities is guided by the Constitution of the Republic of Tajikistan, other legal acts of the Republic of Tajikistan, the international legal acts recognized by the Republic of Tajikistan, and also this Provision.

2. Purposes and tasks of state commission

4. Main objectives of State commission is the following:

- planning of effective and bespomekhny use of public range of radio frequencies, including their private use;

- development of the National plan of distribution of radio frequencies;

- coordination of installation of all types of radio stations in the territory of the Republic of Tajikistan for the purpose of rational use of the existing line items;

- development of recommendations and procedure for use of range of radio frequencies;

- development of the concept of development of system of range of radio frequencies in the Republic of Tajikistan;

- determination of line item and assistance in representation of interests of the Republic of Tajikistan at the international negotiations on questions of radio-frequency range.

5. The main objectives of State commission are:

- realization of policy in the field of distribution and use of radio-frequency range on the basis of tendencies of development of radio-electronic means;

- development of the perspective plan of use of radio-frequency range various types of radio-electronic means;

- allocation of strips (nominals) of frequencies for development, productions, uses and purchases of radio-electronic means of different function;

- development of single technical policy in the field of ensuring electromagnetic compatibility of radio-electronic funds for the territories of the Republic of Tajikistan;

- control of execution of decisions of the State Commission on Radio Frequencies;

- coordination of policy in the field of distribution and use of radio-frequency range with countries of the Commonwealth of Independent States;

- preparation of materials for actions of International Union of Telecommunication and the Regional union in the field of communication;

- providing the international legal protection of interests of the Republic of Tajikistan concerning planning, appointments and uses of radio frequencies;

- the organization of the international coordination and registration of national purposes of frequencies in International Union of Telecommunication;

- streamlining of use of radio-frequency range, development for this purpose projects of regulatory legal acts and recommendations;

- development of measures for increase in efficiency of use of radio-frequency range;

- approval and realization of regulations of territorial placement of frequencies of the radio-electronic means providing their electromagnetic compatibility;

- development of the concept of development of system of radio-frequency range and development of technical policy in the field of distribution and use of radio-frequency range taking into account scientific and technical progress in the field of creation of modern telecommunication means and future needs of the Republic of Tajikistan for the networks and systems of telecommunication using radio-electronic means;

- consent on use of strips of frequencies for specific types of radio-electronic means and creation of send-receive systems;

- consent on development and production of the means and radio devices complying the established technical requirements;

- ensuring use of range of radio frequencies with users of government institutions;

- coordination in accordance with the established procedure allocations of frequencies with structures of communication of foreign states and registration of allocations of frequencies in International Union of Telecommunication;

- preparation of draft agreements between the Communication service under the Government of the Republic of Tajikistan and departments of communication of the adjacent states about coordination of use of frequencies in border regions;

- development of work materials for delegation of the Communication service under the Government of the Republic of Tajikistan at negotiations on coordination of use of radio frequencies and ensuring electromagnetic compatibility of radio-electronic means, offers on structure of delegation, the analysis of reports of delegation and the organization of execution of the reached agreements;

- joint development with the interested organizations of actions for international protection of purposes of frequencies for radio-electronic means of the republic, the organization of their accomplishment and control of their execution;

- preparation of offers for the world, regional and administrative conferences of International Union of Telecommunication on distribution of strips and planning of radio frequencies, modification of Regulations of radio communication;

- coordination and registration in accordance with the established procedure in International Union of Telecommunication of purposes of frequencies for radio-electronic means of the diplomatic representations and the international organizations performing activities in the territory of the Republic of Tajikistan;
