According to article 10 of the Law of Ukraine "About obligatory national social insurance", Items 9, 10 Regulations on the Pension fund of Ukraine, the Cabinet of Ministers of Ukraine approved by the resolution of July 23, 2014 No. 280, boards of the Pension fund of Ukraine

DECIDES:

1. Approve the Procedure for consideration by bodies of the Pension fund of Ukraine for claims to the decisions made by results of performed correctness of use by insurers of means of obligatory national social insurance which is applied.

2. To inspection department of use of means of obligatory national social insurance (Hizhnyak V.) together with Legal department (Ryabtseva T.) submit this resolution on state registration to the Ministry of Justice of Ukraine.

3. This resolution becomes effective from the date of its official publication.

Procedure for consideration by bodies of the Pension fund of Ukraine for claims to the decisions made by results of performed correctness of use by insurers of means of obligatory national social insurance

I. General provisions

1. This Procedure determines the procedure of representation and consideration of the Pension fund of Ukraine by head departments in the Autonomous Republic of Crimea, areas, the cities of Kiev and Sevastopol (further - the Pension fund) / Pension by fund of Ukraine of claims of insurers in case of appeal of decisions on return of insurance means and application of financial sanctions for violation of procedure for use of means of obligatory national social insurance, about application of financial sanctions for untimely return or return not in full of the insurance means provided by part six of article 8 of the Law of Ukraine "About obligatory national social insurance" (further - the Law).

2. The terms "insured person", "insurers" in this Procedure are used in the value given in the Law of Ukraine "About collection and accounting of single fee on obligatory national social insurance".

II. Execution of the claim

1. The claim to the decision of body of the Pension fund shall contain:

1) full name, the address of the location of the legal entity or surname, name, middle name (in the presence), the address of the declared/registered residence (stay) of physical person entrepreneur (further - FLP), person performing independent professional activity, number of the means of communication and the e-mail address (in the presence);

2) code on EGRPOU of the legal entity or for FLP, persons performing independent professional activity - registration number of accounting card of the taxpayer or series (in the presence) and passport number of the citizen of Ukraine / unique number of entry in the Unified state demographic register (in the presence) (for physical persons which because of the religious beliefs refuse adoption of registration number of accounting card of the taxpayer and reported about it relevant organ of the State Tax Service and have mark in the passport);

3) the name of body of the Pension fund which makes the appealed decision, date of its acceptance and registration number;

4) requirements of the applicant and their reasons;

5) date of creation of the claim.

2. The claim is signed by the complainant or his representative with own hand or with use of the qualified digital signature or advanced digital signature which is based on the qualified digital signature certificate.

The claim shall be stated in writing and submitted by the personal address, is sent by the mailing or submitted electronically, including with use of the web portal of electronic services of the Pension fund of Ukraine.

The complaint made electronically shall conform to requirements of the Law of Ukraine "About electronic documents and electronic document management".

If the claim for the benefit of the legal entity, FLP or person performing independent professional activity moves her representative, then the copy of the power of attorney or other document confirming powers of the representative is attached to the claim.

3. The documents testimonial of abnormality of the decision (which originals return to the complainant according to its requirement after the reconsideration of the case considered according to the claim), or copies of such documents are attached to the claim.
