Approve Regulations on the Pension fund of Ukraine which are applied.

Regulations on the Pension fund of Ukraine

1. The pension fund of Ukraine is the central executive body which activities go and coordinated by the Cabinet of Ministers of Ukraine through the Minister of social policy, realizes state policy concerning provision of pensions and accounting of persons which are subject to obligatory national social insurance.

2. The pension fund of Ukraine in the activities is guided by the Constitution and the laws of Ukraine, presidential decrees of Ukraine and resolutions of the Verkhovna Rada of Ukraine adopted according to the Constitution and the laws of Ukraine, acts of the Cabinet of Ministers of Ukraine, other acts of the legislation.

3. The main objectives of the Pension fund of Ukraine are:

realization of state policy concerning provision of pensions, obligatory national social insurance in connection with temporary disability and obligatory national social insurance from labor accident and occupational disease which entailed disability, provisions of housing subsidies and privileges for payment of housing and communal services, acquisition of solid and liquid oven household fuel and the liquefied gas;

accounting of persons which are subject to obligatory national social insurance, persons who have the right to privileges, and also receivers of housing subsidies;

introduction of offers to the Minister of social policy of ensuring forming of state policy of the specified questions;

implementation of insurance payments and provision of social services according to the laws of Ukraine "About obligatory national pension insurance" and "About obligatory national social insurance";

prevention of labor accidents and occupational diseases;

conducting check of justification of issue, the prolongation of leaves of disability and documents which are the basis for their forming based on information containing in electronic systems and registers;

control of use by insurers and insured persons of insurance means;

accomplishment of other tasks determined by the law.

4. The pension fund of Ukraine according to the tasks assigned to it:

1) generalizes practice of application of the legislation on the questions which are within its competence develops suggestions for improvement of legal acts, acts of the President of Ukraine, the Cabinet of Ministers of Ukraine, regulatory legal acts of the ministries and in accordance with the established procedure represents them to the Minister of social policy;

2) also management of solidary system of obligatory national pension insurance, of obligatory national social insurance in connection with temporary disability and obligatory national social insurance from labor accident and occupational disease which entailed disability performs management;

Studies 3) and analyzes situation in the sphere of provision of pensions, compulsory national social insurance in connection with temporary disability and obligatory national social insurance from labor accident and occupational disease which entailed working capacity loss provides carrying out yearly actuarial calculations of financial condition of system of obligatory national pension insurance, obligatory national social insurance in connection with temporary disability and obligatory national social insurance from labor accident and the occupational disease which entailed disability;

4) is developed by the budget statement of the Pension fund of Ukraine and gives it to the Minister of social policy for introduction in accordance with the established procedure for consideration to the Cabinet of Ministers of Ukraine, performs effective distribution of financial resources for provision of pensions, implementation of insurance payments and provision of social services according to the law, provides timely and in full financing of pension payment, the help on burial and and social services which according to the legislation are performed at the expense of the means of the Pension fund of Ukraine and other sources determined by the legislation constitutes the performance report of the budget of the Pension fund of Ukraine;

Creates 5) and keeps the register of insured persons of the State register of obligatory national social insurance (further - the register of insured persons) and as a part of the specified register - the register of payers of insurance premiums in solidary system of obligatory national pension insurance;

Will organize 6), coordinates and controls work of territorial authorities on:

to ensuring compliance by the companies, organizations, organizations irrespective of pattern of ownership and citizens of Ukraine, foreigners and stateless persons who on legal causes are in the territory of Ukraine, requirements of acts of the legislation on provision of pensions;

to ensuring receipts from payment of collection on compulsory national pension insurance, other means, to accounting of their receipts according to the legislation;

to entering of data into the register of insured persons and their use;

entering of data into the Register of receivers of housing subsidies, the Register of persons having the right to privileges which are structural subsystems of the Unified social register, and use of such data;

issue of the certificate of bonus right, provided taking into account the income;

ensuring functioning of information and analytical system of social insurance;

control of observance of requirements of the legislation on obligatory national pension insurance, correctness of charge, calculation, completeness and timeliness of payment of insurance premiums for obligatory national pension insurance (further - insurance premiums) and other payments; target use of the means intended for payment of housing subsidies and privileges for payment of housing and communal services, acquisition of solid and liquid oven household fuel and the liquefied gas; use of insurance means, correctness of use by insurers using risk - the oriented approaches, and also maintaining and reliability of accounting and the reporting on their receipts and uses; reliability of the documents submitted for award of pension and the information about persons who are subject to obligatory national social insurance; appointment (recalculation) and pension payment, monthly perpetual monetary pay to judges in resignation and other payments which according to the legislation are performed at the expense of means of the Pension fund of Ukraine, other sources determined by the legislation;

to collection in stipulated by the legislation procedure for timely not assessed and/or not paid amounts of insurance premiums and other payments;

to application of the financial sanctions provided by the law and imposings of administrative penalties;
