On regulation of activities of banks

(Extraction)

For the purpose of further enhancement of activities of banks, non-bank credit and financial organizations:

1. Determine that:

1.1. the list of banks, authorized to serve state programs, it is determined by Council of Ministers of the Republic of Belarus and National Bank;

1.2. compensation and other payments to employees of banks, non-bank credit and financial organizations (further - banks) are performed according to the procedure, established by National Bank according to the legislation on work;

1.3. banks create and use funds (except for reserve fund) by the profit remaining at their order after tax payment, charges (duties), other obligatory payments in republican and local budgets, including in the state trust budget funds, and also in state non-budgetary funds (further - profit), according to the procedure, established by National Bank;

1.4. expenses of banks on acquisition, construction of capital structures (buildings, constructions), acquisition (upgrade) of the equipment, vehicles and other fixed assets, except the property intended for transfer to finance lease (leasing) are performed by profit, funds of the banks formed by profit (except for reserve fund), and the sources determined by National Bank;

1.5. for office use.

2. To National Bank till January 1, 2026 to take measures for implementation of this Decree.

3. Declare invalid the Presidential decree of the Republic of Belarus of May 15, 2008 No. 271 "About some questions of regulation of activities of banks".

4. This Decree becomes effective in the following procedure:

Items 1 and 3 - since January 1, 2026;

other provisions of this Decree - after its official publication.
