About some measures for implementation of the Law of the Kyrgyz Republic "About burial and funeral case"

For the purpose of implementation of Articles 10, "About burial and funeral case", according to article 8 of the Law of the Kyrgyz Republic "About regulatory legal acts of the Kyrgyz Republic", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides 13 Laws of the Kyrgyz Republic:

1. Approve the Procedure for cost determination of services in burial according to appendix.

2. Bring in the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About delegation of separate rule-making powers of the Cabinet of Ministers of the Kyrgyz Republic to state bodies and executive bodies of local self-government" of March 3, 2023 No. 115 the following change:

in the List of the separate rule-making powers of the Cabinet of Ministers of the Kyrgyz Republic delegated to state bodies and executive bodies of local self-government of the Kyrgyz Republic, approved by the above-stated resolution:

- add with Item 2-3 of the following content:

"2-3. To executive bodies of local self-government according to the cost of the services in burial provided by Articles 10, 13 Laws of the Kyrgyz Republic "About burial and funeral case.".

3. To provide to the Ministry of Economy and Trade of the Kyrgyz Republic together with the State agency on cases of public service and local self-government under the Cabinet of Ministers of the Kyrgyz Republic methodical support of executive bodies of local self-government on application of the above-stated Procedure.

4. This resolution becomes effective after ten days from the date of official publication.

Procedure for cost determination of services in burial

Chapter 1. General provisions

1. This Procedure for cost determination of services in burial (further - the Procedure) is single methodical instruction for forming of the rates for provision of services for burial rendered by specialized services concerning funeral case of local government bodies, the relevant municipal companies (organizations).

For the purpose of ensuring legal definiteness and systemacity of regulation this Procedure coordinates procedure of establishment of rates for the following types of service for burial:

- document creation, necessary for burial;

- provision and delivery of coffin, shroud, tabyt, necessary for burial;

- body vestments;

- transportation of the dead on the cemetery (crematorium), provision of ritual transport;

- burial (digging and zakopka of grave), cremation with the subsequent issue of ballot box with ashes for burial in columbarium or wall of grief.

Action of this Procedure extends to specialized services concerning funeral case and the local government bodies performing activities in the field of funeral services.

Chapter 2. Procedure for approval and approval of rates for provision of services on burial

2. For review rates for provision of services on burial by specialized services on funeral case, the relevant municipal companies (organizations) represent to territorial subdivisions of authorized body in the field of anti-monopoly regulation the following materials:

- the cover letter (in any form);

- draft of the price list of rates in duplicate;

- main technical and economic and financial performance of the company (organization);

- balance statement;

- the analysis of application of applicable fares in total and quantitative expression;

- costing;

- the comparative table of indicators of calculation (actual cost, cost for previous period, cost on existing rules);

- reasons for the reasons in case of change of the price level (rates);

- reasons for the accepted amount of profit (profitability);

- explanatory note (including characteristic of works, services).

The received materials are checked by the contractor of authorized body in the field of anti-monopoly regulation originally regarding completeness of representation and correctness of registration.

Settlement materials are represented in one copy, the draft of the price list of the prices (rates) - in duplicate. All documents provided in electronic form shall be the scanned copies of originals with signatures of the head and chief accountant and are certified by seal the subject. 3. For correctness and reliability of the provided materials responsibility is born by the director (organizations) providing services in burial.

4. In case of lack of the materials specified in Item 2 presents of the Procedure the provided materials are not considered by territorial subdivision of authorized body in the field of anti-monopoly regulation.

The refusal or return of documents for completion goes to the company (organization) providing services in burial no later than 5 (five) working days from the date of their receipt to territorial subdivision of authorized body in the field of anti-monopoly regulation and shall contain list of the lacking or requiring completion of documents and information.

During consideration of settlement materials, if necessary, additional data and other documents, including financial, necessary for refining and determination of price levels (rates) and profitability can be requested. The term of provision of additional data and other documents cannot exceed 10 (ten) working days from the date of receipt of the letter.

5. The provided materials are considered by territorial subdivision of authorized body in the field of anti-monopoly regulation in time, not exceeding 10 (ten) working days from receipt date of all settlement materials specified in Item 2 presents of the Procedure.

6. The companies (organization) providing services in burial after decision making about approval of rates shall submit rates in executive body of local self-government within week term.
