1. Approve Regulations on prevention, control and elimination of the illegal, not declared and non-regulated fishery it (is applied).

2. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

3. This resolution becomes effective since July 3, 2027.

Regulations on prevention, control and elimination of the illegal, not declared and non-regulated fishery

This Provision:

- partially shifts Regulations (EC) No. 1005/2008 of Council of September 29, 2008 about establishment of system of Community for prevention, control and elimination of the illegal, not declared and non-regulated fishery, modification of Regulations (EEC) No. 2847/93, (EU) to No. 1936/2001 and (EU) No. 601/2004 and cancellation of Regulations (EU) No. 1093/94 and (EU) No. 1447/1999, published in the Official magazine of the European Union by L 286 of October 29, 2008 (CELEX: 32008R1005), with the last changes made by Regulations (EU) 2023/2842 European parliament and Council of November 22, 2023;

- partially the Regulations (EU) shift No. 1010/2009 of the Commission of October 22, 2009 about establishment of detailed rules of application of provisions of Regulations (EU) No. 1005/2008 of Council about establishment of system of Community for prevention, control and elimination of the illegal, not declared and non-regulated fishery published in the Official magazine of the European Union by L 280 of October 27, 2009 (CELEX: 32009R1010), with the last changes made by Implementation regulations (UE) 2020/423 of the Commission of March 19, 2020.

Chapter I. General provisions

1. The regulations on prevention, control and elimination of the illegal, not declared and non-regulated fishery (further - the Provision) regulate functioning of system of prevention, control and elimination of the illegal, not declared and non-regulated fishery (further - NNN-fishery) which consists in the documentation of each batch of fish and products of fishery received as a result of fishery in the wild nature by verification of the certificate on catch at the time of import of batch to the country.

2. In value of Item 1, this Provision provides to the National agency on safety of foodstuff (further - the Agency) the system containing enough means allowing it to achieve the planned goals on prevention, control and elimination of NNN-fishery.

3. 1 system provided in Item is applied to all adjacent types of activity performed in the territory of the Republic of Moldova which follow from set of actions for NNN-fishery in the sea waters which are under jurisdiction or sovereignty of other countries and in the high sea.

4. In value of this provision the following concepts are used:

4.1. the certificate on catch - the official document issued by competent authority of the flag State having quotas for catch of fish, including performing catch of fish according to national and international rules of responsible and sustainable fishery which is requested by exporters and importers in the course of activities for international trade in products of fishery which establishes legality and origin of the products of fishery caught in the seas and oceans;

4.2. the illegal, not declared and non-regulated fishery - the illegal, not declared or non-regulated actions for catch of fish;

4.3. illegal fishery - the actions for catch of fish performed by fishing boats:

4.3.1. in the sea waters which are under jurisdiction of certain state without the permission of this state or in defiance of its laws and rules;

4.3.2. which go under the flag of the states which are contracting parties within the regional organization for management of fishery, but perform activities, breaking the measures for preserving and management taken by this organization which shall be observed by the relevant states, or breaking provisions of the applicable international law;
