The parliament adopts this organic law.

This law shifts:

– Article 1-5; parts (1) and (2) Article 6; parts (2) – (4) Article 7; parts (1) and (3) Article 8; Article 9; part (1) Article 10; Articles 11, 12 and 13; part (1) Article 14; Articles 15, 16 and 17; part (1) Article 18; part (1) Article 21; parts (1), (3) and (4) Article 22; Article 23; Article 24-27; parts (1) – (5) and (7) Article 28; Articles 29 and 30; parts (1) – (4) Article 31; Articles 32, 33 and 34; part (4) Article 35; parts (1) and (2) Article 37; part (2) Article 39; Articles 40 and 41; parts (1) and (2) Articles 42, article 49 and Appendix I to the Regulations of the European parliament and Council (EC) No. 1379/2013 about the general organization of the markets in the sector of products of fishery and aquaculture making amendments to regulations of Council (EU) No. 1184/2006 and (EU) No. 1224/2009 and canceling Regulations of Council (EU) No. 104/2000, published in the Official magazine of the European Union by L 354 of December 28, 2013 with the last changes made by Regulations of the European parliament and Council (EC) No. 2020/560 of April 23, 2020 about modification of regulations (EC) No. 508/2014 and (EC) No. 1379/2013 about specific measures for mitigation of impact of epidemic of COVID-19 on the sector of fishery and aquaculture (CELEX: 32013R1379);

– part (1) Article 1; parts (1), (4) and Items (c), (e) and (g) of part (5) Article 2; Article 3; Items 3, 25, 28 and 30 parts (1) Article 4; part (1) Article 27; parts (1) and (3) – (6) Article 34; parts (1) – (3) Article 35; parts (1) – (3) Article 36; parts (2) and (3) Article 43; part (2) Article 44; parts (1) and (2) Article 45 and Article 51 of Regulations of the European parliament and Council (EC) No. 1380/2013 of December 11, 2013 about general policy in the field of the fishery making amendments to regulations of Council (EU) No. 1954/2003 and (EU) No. 1224/2009, and also canceling regulations of Council (EU) No. 2371/2002 and (EU) No. 639/2004 and the Decision of the Council No. 2004/585/EC published in the Official magazine of the European Union by L 354 of December 28, 2013 with the last changes made by Regulations of the European parliament and Council (EU) No. 2022/2495 of December 14, 2022 (CELEX: 32013R1380).

Chapter I General provisions

Article 1. Scope of application

(1) This law establishes the regulatory base concerning policy in the sector of aquaculture and the organization of the market of products of fishery and aquaculture which provides:

a) organization and management of the sector of aquaculture;

b) the organization of scientific research, technology development and innovations in the sector of aquaculture;

c) the organization of the market of products of fishery and the aquaculture realized in the territory of the Republic of Moldova;

d) prevention, control and elimination of the illegal, not declared and non-regulated fishery.

(2) This law extends to the legal entities performing activities for cultivation, selection and reproduction of fish by means of use of technologies, specific to this sector, and also to the legal entities performing the any kind of activities connected with stages of chain of production, conversion, realization, distribution and retail trade by products of fishery and aquaculture, or owning the company performing these types of activity.

Article 2. Purpose and tasks

(1) the Purpose of this law is strengthening of regulatory and institutional base and creation of the organizational, economic and legal conditions favorable for sustainable development of the sector of aquaculture that will provide:

a) increase in production of fish and products of aquaculture in fish-breeding farms by means of use of modern and high-productive technologies;

b) improvement and enhancement of the types existing in the Republic of Moldova, lines and cross-countries of fishes;

c) improvement of quality and product competitiveness, received in case of conversion of fish and products of fishery and aquaculture, and also their promotion in the internal and external markets;

d) support of producers and operators regarding use of modern and high-productive technologies, and also implementation of innovative projects in the sector of aquaculture.

(2) Tasks of this law are:

a) strengthening and increase in competitiveness of the sector of aquaculture;

b) operation, recovery and content of fishery water objects by their stocking / restocking by more valuable productive species of fish for ensuring competitive and high-quality production of fish and aquaculture;

c) the organization of the sector of aquaculture from the point of view of long-term steady environmental protection according to the purposes of achievement of economic benefits, benefits in the social sphere and in the field of employment of the population, to promoting supply of the population with fish and products of fishery and aquaculture;

d) the organization of the market of products of fish breeding and aquaculture it is effective, transparent also with observance of rules of competition concerning all products of fishery and aquaculture;

e) remedial action, products of fishery and the aquaculture connected with transparency and stability of the market of products of fishery and aquaculture on all chain of production, conversion, realization, distribution and retail trade;

f) creation of conditions for industry on production and conversion of products of fishery and aquaculture, viable and competitive from the economic point of view;

g) assistance to development of steady activities in the sector of aquaculture;

h) data collection, concerning the sector of aquaculture, ensuring transparency of their processing;

i) provision of reliable information to consumers by means of marking and labeling of products.

Article 3. Policy in the sector of aquaculture and the organization of the market of products of fishery and aquaculture

Policy in the sector of aquaculture and the organization of the market of products of fishery and aquaculture are based on the following principles:

a) accurate determination of obligations at all levels;

b) accounting of regional features;
