This resolution partially shifts the Delegated regulations (EU) No. 2020/689 of the Commission of December 17, 2019 about amendment of Regulations (EU) 2016/429 of the European parliament and Council regarding rules of supervision, programs of liquidation and the status of wellbeing by some list and emerdzhentny diseases (CELEX: 32020R0689), published in the Official magazine of the European Union by L 174 of June 3, 2020, with the last changes made by the Delegated regulations of the Commission (EU) 2023/1798 of July 10, 2023.

1. Approve Veterinary sanitary standard about supervision, programs of liquidation and the status of wellbeing by some list and emerdzhentny diseases.

2. To impose control over the implementation of this resolution on the National agency on safety of foodstuff.

3. This resolution becomes effective from the effective date the Law No. 196/2024 about health of animals.

The veterinary sanitary standard about supervision, programs of liquidation and the status of wellbeing by some list and emerdzhentny diseases (further - the Regulation) partially shifts the Delegated regulations (EU) No. 2020/689 of the Commission of December 17, 2019 about amendment of Regulations (EU) 2016/429 of the European parliament and Council regarding rules of supervision, programs of liquidation and the status of wellbeing by some list and emerdzhentny diseases (CELEX: 32020R0689), published in the Official magazine of the European Union by L 174 of June 3, 2020, with the last changes made by the Delegated regulations (EU) 2023/1798 of the Commission of July 10, 2023.

Chapter I. General provisions

1. The this Regulation supplements veterinary and sanitary regulations on supervision, programs of liquidation and the status of wellbeing by some list and emerdzhentny diseases of land animals, water animals and other animals and is accepted for accomplishment of provisions of the Law No. 196/2024 about health of animals (further - the Law No. 196/2024).

2. For the purpose of this Regulation the following concepts are applied:

2.1. honey bees - insects of type of Apis mellifera;

2.2. the animals vaccinated according to the strategy of DIVA - the animals vaccinated within vaccination according to the strategy of DIVA;

2.3. category A disease - list disease which usually does not meet in the territory of the Republic of Moldova and in case of which detection immediate taking measures to its liquidation is necessary as it is specified in Item a) parts (1) article 9 of the Law No. 196/2024;

2.4. category B disease - the list disease which is subject to control in the Republic of Moldova for the purpose of its liquidation as it is specified in Item b) parts (1) article 9 of the Law No. 196/2024;

2.5. category C disease - the list disease important for the separate territories and concerning which measures for prevention of its distribution in certain territories of the Republic of Moldova which officially have the status of wellbeing by this disease or concerning which there are programs of liquidation for the corresponding list disease are necessary as it is specified in Item c) to part (1) article 9 of the Law No. 196/2024;

2.6. category D disease - list disease concerning which measures for prevention of its distribution in connection with its drift on the territory of the Republic of Moldova are necessary as it is specified in Item d), parts (1) article 9 of the Law No. 196/2024;

2.7. category E disease - the list disease which is subject to supervision in the territory of the Republic of Moldova as it is specified in Item e) parts (1) article 9 of the Law No. 196/2024;

2.8. cattle or animal of type of cattle - the animal from archiodactyla belonging to the sorts Bison, Bos (including subgenus of Bos, Bibos, Novibos, Poephagus) and Bubalus (including Anoa subgenus), and also the posterity received from crossing of these types;

2.9. goats or animal of type of goats - the animal from archiodactyla belonging to the sort Capra and also the posterity received from crossing of these types;

2.10. dog - the animal who is on content belonging to Canis lupus type;

2.11. the wandering circus - the exhibition or fair which is including animals or representations with animals and having intention to move between the different countries;

2.12. domestic polecat - the animal belonging to type of Mustela putorius furo;

2.13. livestock of birds - set of the domestic or wild birds with the identical sanitary status containing in one room or barrier and components single epidemiological education; in case of content of poultry indoors, all birds who are in one room join here;

2.14. embryo - initial phase of development of animal when its transfer in female recipient is possible;

2.15. seed grain - sperm of animal or animals, as in invariable type, and processed or divorced;

2.16. the vehicle - automobile or rail vehicles, water and aircrafts;

2.17. the vessel with fishing aquarium - the vessel used in aquaculture, equipped with aquarium or storage tank and transportations of live fishes in water;

2.18. number with animals - any number including the animals containing for the purpose of exhibition or fair and which can be part of circus;

2.19. oocytes - haploid cycles of ovogenesis, including secondary oocytes and ova;

2.20. sheep or animal of type of sheep - the animal from archiodactyla belonging to the sort Ovis and also the posterity received from crossing of these types;

2.21. reproductive poultry is poultry at the age of 72 hours and is more senior, intended for production of eggs for incubation;

2.22. the wellbeing period concerning carriers - in certain zone the period of failure to act of type of Culicoides determined according to provisions of Items 24-27 of Chapter II of appendix No. 5;

2.23. the period of compliance to requirements - period of time before the competent authority sends inquiry for the status of wellbeing due to illness or if it is necessary, before the electronic publication of the temporary declaration mentioned in subitem 215.1;

2.24. cat - the animal who is on content belonging to Felis silvestris type;

2.25. additional livestock of animals - livestock of the pets who are on content or wild animals from the list types which are subject to voluntary measures for prevention, supervision and control of diseases which are necessary for obtaining or maintenance of the status of wellbeing due to illness for target population of animals;

2.26. target population of animals - the population of animal list types determined depending on type and, on circumstances, category, important for actions for supervision, programs for liquidation or for the status of wellbeing due to illness for specific disease;

2.27. pig or animal of type of pigs - the animals from Suidae family archiodactyla listed in appendix 3 to the Law No. 196/2024;

2.28. not list type - type of animals or group of the animals who are not included in the list approved by competent authority for specific disease;

2.29. annual accidental supervision - supervision which includes at least one assessment of target population of animals, carried out in year for which the selection methods based on probabilistic approaches for selection of units for inspection are used;

2.30. the authorized unit of reproductive material - the center of collection of seed grain, team for collection of embryos, team for production of embryos, handling unit of reproductive material or storage center of reproductive material which were authorized according to part provisions (1) article 97 of the Law No. 196/2024;

2.31. the company protected from carriers - all premises of the company or their part protected from attacks of type of Culicoides by means of physical means and proper management, the status of the company protected from carriers is appropriated by competent authority according to provisions of Items 114, 115 and 116;

2.32. vaccination according to the strategy of DIVA (vaccination according to the strategy of differentiation of the vaccinated animals from infected) - vaccination in case of which the vaccines allowing, in combination with the corresponding methods of serological diagnostics, to reveal the infected animals in the vaccinated population are used;

2.33. sanitary emptying - the transaction directed to management of diseases in case of which the company is cleared of animals of aquaculture of list types and when it is possible, of water;

2.34. seasonal zone, free from BTV - all territory of the Republic of Moldova or one its zone in which the competent authority established the temporary status of wellbeing on infection the "blue language" virus (serotypes 1-24), (further - "infection of BTV") according to Item 100 provisions based on freedom period from carriers and demonstration of absence of disease at list animal species.

Chapter II. Programs of supervision, liquidation and status of wellbeing for diseases

Section 1 Supervision Development, target population of animals and methods of diagnostics

3. The competent authority develops supervision of list and emerdzhentny diseases of land animals and other animals taking into account:

3.1. the general requirements in the field of supervision based on:

3.1.1. the notification as it is provided in part (1) article 18 of the Law No. 196/2024;

3.1.2. the corresponding veterinary investigation of excess mortality and other signs of serious illness or considerable decrease in indicators of production without the established reason;

3.1.3. the investigation made by competent authority in case of suspicion on emergence of disease of category E or, in the presence of the bases, emerdzhentny disease;

3.1.4. the population of animals which is subject to supervision as it is provided in Items 5 and 6;

3.1.5. contribution of official checks and other official actions as it is provided in Items 11 and 12;

3.2. specific requirements in the field of supervision:

3.2.1. in the program of supervision;

3.2.2. within obligatory or voluntary programs for liquidation;

3.2.3. for confirmation and maintenance of the status of wellbeing due to illness;

3.2.4. within measures for control of diseases;

3.2.5. in the context of permission of certain companies;

3.2.6. for movement of land animals on the territory of the Republic of Moldova.

4. The competent authority develops supervision of list and emerdzhentny diseases of water animals taking into account:

4.1. the general requirements in the field of supervision based on:

4.1.2. the notification as it is provided in part (1) article 18 of the Law No. 196/2024;

4.1.3. the corresponding veterinary investigation of excess mortality and other signs of serious illness or considerable decrease in indicators of production without the established reason;
