1. Approve the Instruction about procedure for restriction of access to the web pages containing the information intended and used for preparation or making of crimes and on removal of the corresponding content from source it (is applied).

2. The instruction about procedure for restriction of access to the web pages containing the information intended and used for preparation or making of crimes and on removal of the corresponding content from source is applied only for the purpose of execution of the Law No. 20/2009 on the prevention and fight against crime in the field of computer information and does not mention the regulations regulating other procedures of the termination of access to illegal materials.

3. To the Ministry of Internal Affairs and Service of information and safety to take necessary measures for implementation of the Instruction about procedure for restriction of access to the web pages containing the information intended and used for preparation or making of crimes and on removal of the corresponding content from source.

4. This resolution becomes effective from the date of publication in the Official monitor of the Republic of Moldova.

The instruction about procedure for restriction of access to the web pages containing the information intended and used for preparation or making of crimes and on removal of the corresponding content from source

Chapter I. General provisions

1. The instruction about procedure for restriction of access to the web pages containing the information intended and used for preparation or making of crimes and on removal of the corresponding content from source (further - the Instruction) establishes procedures for identification of the web pages containing the information intended and used for preparation or making of crimes for execution of the order on restriction of access to the web page or about removal of on-line content from source and also for interaction between the Ministry of Internal Affairs and/or Service of information and safety and service providers of Internet access, service providers of hosting of on-line content and/or suppliers of content for the purpose of implementation of measures for restriction of access or removal of content from source.

2. In this Instruction the following concepts are used:

2.1. The IP address (Internet Protocol Address) - the numerical address allowing to identify resource on the Internet and to exchange data with this resource;

2.2. The URL address (Uniform Resource Locator) - the unified address in text format identifying resource (web page) on the Internet;

2.3. the service provider of Internet access - the supplier of electronic communication services providing Internet access;

2.4. the service provider of hosting of content - the company or the organization providing their server space for storage and management of websites, appendices or other online resources;

2.5. the supplier of content - the subject or the organization extending or providing digital content, for example, texts, images, video, audio, appendices or any other type of the information material which is available on the Internet;

2.6. the supplier of services/content - the service provider of Internet access, the service provider of hosting of on-line content and the supplier of content;

2.7. system of domain names (DNS - Domain Name System) - the distributed system of names used for identification of computers on the Internet or in other networks based on the IP protocol.

3. The web page is considered intended and used for preparation or making of crimes if information published or otherwise provided on it, including in the form of references, corresponds to one or several criteria established in Items a) - g) parts (1) article 4-2 of the Law No. 20/2009 on the prevention and fight against crime in the field of computer information.

4. The web pages containing the information intended and used for preparation or making of crimes come to light specialized division on prevention and fight against crime in the field of computer information as a part of the Ministry of Internal Affairs or Service of information and safety (further - specialized division) on own initiative or based on the messages which arrived from any physical person or legal entity of public or private law.

5. The message on existence of the web page containing the information intended and used for preparation or making of crimes, sent to specialized division by physical person or legal entity shall conform to requirements for submission of claims.

Chapter II. The procedure of restriction of access to the web pages containing the information intended and used for making of crimes and removals of content from source

6. After identification of one or several web pages containing the information intended and used for preparation or making of crimes, the specialized division takes the following actions:

6.1. draws up the statement of verification of the web page / веб-страниц according to the sample specified in appendix;

6.2. within 24 hours:

6.2.1. issues the order on removal of on-line content from source (further - the order on removal of content from source) if content can be removed from source by service providers of hosting of on-line content or suppliers of content in the territory of the Republic of Moldova; and/or

6.2.2. issues the order on restriction of access to the web pages containing the information intended and used for preparation or making of crimes (further - the order on access restriction) if removal of content from source is impossible; and/or

6.2.3. makes the decision on refusal in the publication of the order on removal of content from source or the order on access restriction.

7. The order on removal of content from source or the order on restriction of access is told suppliers of services/content in physical format or, if necessary, in electronic format through government e-mail of specialized division. The address URL to which access shall be limited, is reported in text format.

8. The publication of the order on restriction of access or about removal of on-line content from source is performed with respect for the following principles:

8.1. legality;
