Based on part three of subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of December 22, 2010 No. 670 "About some questions of payment of natural gas, electrical and heat energy" the Ministry of anti-monopoly regulation and trade of the Republic of Belarus and the Department of Energy of the Republic of Belarus POSTANOVLYAYUT:

1. Approve the Instruction for determination of customer groups of electrical and heat energy on which rates for electrical and heat energy can be differentiated it (is applied).

2. Recognize invalid resolutions of the Ministry of anti-monopoly regulation and trade of the Republic of Belarus and the Department of Energy of the Republic of Belarus according to appendix.

3. This resolution becomes effective after its official publication.

The instruction for determination of customer groups of electrical and heat energy on which rates for electrical and heat energy can be differentiated

Chapter 1. General provisions

1. This Instruction determines customer groups on which in the Republic of Belarus rates for the electrical and heat energy released to legal entities and individual entrepreneurs by the power supplying organizations being part of the national production association of power industry of Belenergo can be differentiated (further – the power supplying organizations).

2. For the purposes of this Instruction the following terms and their determinations are used:

category of tariff groups (further – category) – set of the tariff groups united on one or more general criterion of grouping of consumers. For category of tariff group the level of rate for electrical and (or) heat energy is not determined;

main type of economic activity (further – type of activity) – the type of activity of the legal entity, its structural division including performed on separate object of the legal entity, individual entrepreneur, determined by five-digit digital code (subclass) according to the nation-wide qualifier of the Republic of Belarus OKRB 005-2011 "Types of economic activity" approved by the resolution of the State committee on standardization of the Republic of Belarus of December 5, 2011 No. 85 (further – OKRB 005-2011) on which the size of the indicator accepted as criterion for determination of core activity exceeds its size on any other type of activity. As criterion for determination of core activity of the individual entrepreneur, the legal entity, its structural division including performed on separate object of the legal entity the actual volume of production (works, services) estimated for the period multiple to quarter, by the accruing result since the beginning of the current year is used. Until forming of information on the actual volume of production (works, services) as the accruing result since the beginning of the current year information on the actual volume of production (works, services) created for the period, multiple to quarter by the accruing result since the beginning of last year is used. In the absence of information on the actual volume of production (works, services) the corresponding planned target is applied;

the consumer – the legal entity, its structural division, separate object (electroinstallation, the heatusing installation, the receiver of electrical energy) of the legal entity, the individual entrepreneur using electrical and (or) heat energy;

tariff group – customer group for which the level of rate for electrical and (or) heat energy can be determined differentially in the procedure established by the legislation on the prices and pricing;

superbystry charging stations – the charging stations like Mode 4 with an established electric power over 175 kW intended for charging of electric vehicles;

electric copper – the copper intended for transformation of electrical energy to heat energy for the purpose of heating, heating and hot water supply, connection to which power network is made without use of plug connections.

Other terms and their determinations are applied in values, stipulated in Item 4 Presidential decrees of the Republic of Belarus of March 12, 2020 No. 92 "About stimulation of use of electric vehicles", Item 3 of the Rules of electric utility service approved by the resolution of Council of Ministers of the Republic of Belarus of October 17, 2011 No. 1394, Item 3 of the Rules of heat supply approved by the resolution of Council of Ministers of the Republic of Belarus of September 11, 2019 No. 609.

3. This Instruction is applied:

The ministry of anti-monopoly regulation and trade for the purposes of establishment of rates for electrical and (or) heat energy;

Department of Energy in case of coordination in accordance with the established procedure basic fares on electrical and (or) heat energy;

the national production association of power industry Belenergo, the power supplying organizations for the purposes of application of rates for electrical and (or) heat energy.

4. Application of rates for electrical and (or) heat energy is performed depending on reference of the consumer to the corresponding tariff group.

5. Grouping of consumers is made depending on:

5.1. the type of activity performed by the legal entity, its structural division including on separate object of the legal entity, the individual entrepreneur;

5.2. uses of electrical and (or) heat energy are more whole;

5.3. amounts of consumption of the electrical and (or) heat energy released by the power supplying organizations;

5.4. sizes of the attached capacity (regarding electrical energy);

5.5. sources of financing of the legal entity;

5.6. territorial arrangement (stay) and other characteristics.

6. Reference of consumers to categories and (or) tariff groups is performed by the power supplying organization in case of the conclusion of the agreement of electric utility service, the contract of electric utility service with the owner of the block station, the agreement of heat supply or in case of modification and (or) amendments in these agreements based on the information provided by consumers, including concerning the subscribers, lessees, loan recipients, leasing recipients, and confirming justification of reference of consumers, their subscribers, lessees, loan recipients, leasing recipients to the corresponding categories and (or) tariff groups on form according to appendix 1.

Reliability of the provided data specified in part one of this Item is provided with the consumer, his subscribers, lessees, loan recipients, leasing recipients.

In case of change of type of activity:

subscribers, lessees, loan recipients, leasing recipients of the consumer notify on such change of the consumer;

the consumer notifies the power supplying organization on such changes in the relation of and the subscribers, lessees, loan recipients, leasing recipients.

When obtaining by the power supplying organization of the notification specified in parts three of this Item, reference of the consumer, his subscriber, lessee, loan recipient, the leasing recipient to the tariff group corresponding to new type of activity it is performed from the 1st day of the first month of the quarter following the period, multiple to quarter for which information on volume of production is created (works, services).

7. Reference of consumers to tariff groups depending on amounts of consumption of the electrical and (or) heat energy released by the power supplying organizations is performed by the power supplying organization based on data:
