According to Item 5 of article 5 of the Law of the Republic of Kazakhstan "About professional qualifications", I ORDER:

1. Approve:

1) the professional Land management standard according to appendix 1 to this order;

2) the professional standard "Melioration of the Degraded Lands" according to appendix 2 to this order;

3) the professional standard "Flood of Pastures" according to appendix 3 to this order.

2. To provide to department of agrarian science and education of the Ministry of Agriculture of the Republic of Kazakhstan in the established legislative procedure:

1) the direction of the electronic copy of this order in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective from the date of its first official publication.

Professional standard: "Land management"

Chapter 1. General provisions

1. The professional Land management standard (further – the professional standard) is developed according to article 5 of the Law of the Republic of Kazakhstan "About professional qualifications".

The professional standard is intended for determination of levels of the qualifications necessary for implementation by workers of certain type of professional activity, including accomplishment of certain labor functions, and also for application in case of development of educational programs of the organizations of the higher, postgraduate, technical and professional education.

This professional standard determines requirements to skill level and competence, to content, quality and working conditions, and also is intended for the solution of wide range of tasks in the organizations for works in the field of land relations.

The professional standard is applied to use by users:

1) workers – for understanding of qualifying standards to professional activity in the field of land relations, planning of the professional development and advanced training, and also forecasting of career promotion in the profile direction;

2) employers – for development of single requirements to content of professional activity in the field of land management, for updating of requirements to qualification of the workers meeting modern requirements of the labor market, forming of criteria during the hiring and certification of personnel, and also creation of programs of advanced training, development, promotion and staff rotation;

3) educational institutions – for determination of the purposes and contents of educational programs of training of specialists in the field of land relations, retraining and advanced training of heads and specialists of the profile directions, development of system of occupational retraining and advanced training of teachers and experts in the field of land relations;

4) the organizations performing activities for certification and assignment of qualification – for development of estimative materials in case of certification of personnel and development of criteria of qualification of workers on compliance level;

5) state bodies – for use of the professional standard as criteria, monitoring and market forecasting of work.

2. In this professional standard the following terms and determinations are applied:

1) land management – system of actions for studying of condition of lands, to planning and the organization of rational use of lands and their protection, education new to both streamlining of the existing objects of land management and establishment of their borders on the area (territorial land management), the organization of rational use by citizens and legal entities of the parcels of land for implementation of agricultural production;

2) lands public – by the legislation in the cities, settlements and rural settlements, consist of the lands used as means of communication (squares, streets, lanes, drives, roads, embankments) for satisfaction of cultural and community requirements of the population (parks, forest parks, squares, gardens, boulevards, reservoirs, beaches), polygons for burial of unutilized industrial wastes, polygons of household waste and the waste-processing companies, and other lands serving for satisfaction of needs of the city, the settlement, the rural settlement;

3) the earth of water fund – the lands occupied with water objects, the earth of the water protection zones of water objects and also the lands allocated for establishment of strips of branch and zones of protection of water intakes, hydraulic engineering constructions and other water management constructions, objects;

4) the earth of forest fund – forest lands (the lands covered with forest vegetation and not covered with it, but intended for its recovery - cuttings down, ashes, retina, glade and others) and not forest lands intended for forest management (glade, the road, the swamp and others);

5) the earth of the inhabited Items settlements – the lands used as space basis for accommodation, constructions of buildings, constructions, satisfactions of cultural and community needs of the population;

6) the earth of especially protected territories – the lands having special nature protection, scientific, historical and cultural, esthetic, recreational, improving and other valuable value which are withdrawn in with resolutions of state bodies or decisions of local government bodies fully or partially from economic use and turnover and for which the particular legal regime is set;

7) the earth of agricultural purpose – the environment component including soils, and natural resource, being the means of production in agricultural industry ensuring food security of the country, welfare of the population;

8) the earth of inventory – by the land right all lands which are not provided in property, ownership, use and lease. Lands, the property right, ownerships and uses by which it is stopped also concern to them (according to the land legislation);

9) land dispute is discussion and proof of the land rights with observance of the procedural procedure and equality before the law of all participants of land relations;

10) land rent – regular payment of the land user lessee to the owner of this parcel of land, i.e. the rent for the earth;

47) experience – conscious activities, knowledge and skills which can be acquired and effectively used during certain period.
