About creation of the special economic zone "Atyrau"

According to the subitem 2) of article 10 of the Law of the Republic of Kazakhstan "About special economic and industrial zones" the Government of the Republic of Kazakhstan DECIDES:

1. Create the special economic zone "Atyrau" (further – SEZ "Atyrau") for the period till December 31, 2036.

2. Approve enclosed:

1) Regulations on SEZ "Atyrau";

2) target indicators of SEZ "Atyrau".

3. This resolution becomes effective from the date of its signing.

Regulations on the special economic zone "Atyrau"

Chapter 1. General provisions

1. The special economic zone "Atyrau" (further – SEZ) is located in the territory of the Atyrau area within administrative-territorial borders of the city of Atyrau along the route Atyrau – Dossor and Zhylyoysky district of Atyrau area in borders according to appendix to this Provision.

The territory of SEZ constitutes 450 hectares and is integral part of the territory of the Republic of Kazakhstan.

2. SEZ is created for the purpose of:

1) the accelerated development of modern high-productive, competitive productions, forming of qualitatively new level of provision of services, investment attraction, implementation of new technologies in industry of economy and the region, and also population employment increase;

2) developments of industries of processing industry and production of chemical, petrochemical, metallurgical, nonmetallic mineral products, metal working, rubber and plastic products and other products with high value added.

3. Activities of SEZ are regulated by the Constitution of the Republic of Kazakhstan, the Law of the Republic of Kazakhstan "About special economic and industrial zones" (further – the Law) and other legislation of the Republic of Kazakhstan.

If the international treaty ratified by the Republic of Kazakhstan establishes other rules, than those which contain in the legislation on special economic zones are applied rules of the international treaty.

4. In the territory of SEZ the special legal regime is set.

Chapter 2. Management of the special economic zone "Atyrau"

5. Control of SEZ is exercised according to the Law.

Chapter 3. The taxation in the territory of the special economic zone "Atyrau"

6. The taxation in the territory of SEZ is regulated by the tax legislation of the Republic of Kazakhstan.

Chapter 4. Customs regulation

7. In the territory of SEZ or its part customs procedure of free customs zone is effective.

8. The territory of SEZ in which customs procedure of free customs zone is applied is the customs control zone. The territory of SEZ shall be equipped for the purpose of carrying out customs control. Requirements to arrangement of the territory of SEZ, including requirements for barrier and equipment of perimeter of such territory system of video surveillance, are established by authorized body in the field of customs affairs.

Chapter 5. Procedure for stay of foreign citizens in the territory of the special economic zone "Atyrau"

9. In the territory of SEZ the procedure for entrance, departure, transit and stay of foreign citizens and stateless persons, and also their vehicles established by the legislation of the Republic of Kazakhstan and international agreements ratified by the Republic of Kazakhstan is effective.

Chapter 6. Final provisions

10. The conditions established in this Provision can change the order of the Government of the Republic of Kazakhstan.

11. SEZ is abolished on the bases provided by the Law.

12. In case of abolition of SEZ in connection with the expiration on which it was created, akimat of Atyrau area:

1) not later than three months before the expiration of the specified term is published in mass media by the announcement of the forthcoming abolition of SEZ, procedure and the terms of reception of applications and claims connected with its abolition;

2) is provided by explanation to the legal entities and physical persons performing activities in the territory of SEZ, procedure for renewal of the goods which are in its territory under other customs procedure;

3) after abolition of SEZ is represented in a month to the President of the Republic of Kazakhstan and to the Government of the Republic of Kazakhstan by the report on results of activities of SEZ.

13. In case of early abolition of SEZ the order of the Government of the Republic of Kazakhstan the procedure shall be complete not later than in six-months time with observance of procedures, stipulated in Item the 12th this provision.

14. The activities of SEZ which are not settled by this Provision are performed according to the current legislation of the Republic of Kazakhstan.
