According to Item 30 of article 26 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) and the subitem 2) Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" PRIKAZYVAYU:

1. Approve:

1) Rules of representation to credit bureaus in body of state revenues of data from the credit report on debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the collection and (or) microfinancial organizations, according to appendix 1 to this order;

2) form of data from the credit report on debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the collection organizations, according to appendix 2 to this order;

3) form of data from the credit report on debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the microfinancial organizations, according to appendix 3 to this order.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) within five working days from the date of signing of this order the direction it the copy in electronic form in the Kazakh and Russian languages in the Republican state company on the right of economic maintaining "Institute of the legislation and legal information of the Republic of Kazakhstan" the Ministries of Justice of the Republic of Kazakhstan for official publication and inclusion in Reference control bank of regulatory legal acts of the Republic of Kazakhstan;

2) placement of this joint order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after its official publication;

3. This order becomes effective after ten calendar days after day of its first official publication and is effective till December 31, 2025 inclusive.

Rules of representation to credit bureaus in body of state revenues of data from the credit report on debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the collection and (or) microfinancial organizations

Chapter 1. General provisions

1. These rules of representation to credit bureaus in body of state revenues of data from the credit report on debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the collection and (or) microfinancial organizations (further – Rules) are developed according to Item 30 of article 26 of the Code of the Republic of Kazakhstan "About taxes and other obligatory payments in the budget" (Tax code) and the subitem 2) of Item 3 of article 16 of the Law of the Republic of Kazakhstan "About the state statistics" and determine procedure for provision by credit bureau in body of state revenues of data from the credit report by debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the collection organizations and (or) the microfinancial organizations.

Chapter 2. Procedure for representation to credit bureaus in body of state revenues of data from the credit report on debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the collection and (or) microfinancial organizations

2. The committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan (further – Committee) in time no later than November 25 of the year following after accounting year creates as of December 31 of accounting year the list of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property.

3. The committee within 10 (ten) calendar days from the date of forming of the list of the physical persons specified in Item 2 of these rules sends the information about physical persons (individual identification number) to credit bureau in the automated procedure through the information system "Smart Data Finance" of Committee.

4. The credit bureau within 10 (ten) working days from the date of obtaining from Committee of information about physical persons (individual identification number) transfers to Committee in the automated procedure through the information system "Smart Data Finance" of Committee the following data from the credit report:

on debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the collection organizations – in form according to appendix 2 to this order;

on debt of physical persons which had obligation on submission of the declaration on assets and liabilities, about the income and property, before the microfinancial organizations – in form according to appendix 3 to this order.

5. The committee and credit bureaus in case of receipt of the data provided by this rule provide observance of requirements of the legislation of the Republic of Kazakhstan on nondisclosure and non-admission of leakage of the data which are the tax and protected by the law other secret.
