1. Approve Rules of implementation of paid types of activity on sales of goods (works, services) by public institutions in the fields of education which money from realization remains at their order, uses of money from realization by public institutions in the field of education of goods (works, services) remaining at their order according to appendix 1 to this order.

2. Recognize invalid some orders according to the list according to appendix 2 to this order.

3. To provide to department of budgetary planning of the Ministry of Public Education of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet - resource of the Ministry of Public Education of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order submission to Legal department of the Ministry of Public Education of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of education of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of implementation of paid types of activity on sales of goods (works, services) by public institutions in the fields of education which money from realization remains at their order uses of money from realization by public institutions in the field of education of goods (works, services) remaining at their order are developed according to Item 5 of Article 102 of the Budget code of the Republic of Kazakhstan (further - the Code) and determine procedure of paid types of activity by sales of goods (works, services) by public institutions in the fields of education which money from realization remains at their order, uses of money from realization by public institutions in the field of education of goods (works, services) remaining at their order.

Chapter 2. Procedure of paid types of activity on sales of goods (works, services) by public institutions in the fields of education which money from realization remains at their order

Public institutions in the field of education according to article 63 of the Law of the Republic of Kazakhstan "About education" provide on paid basis with the conclusion of the agreement on rendering paid services goods (works, services), rendered over requirements of the state obligatory standards of education.

3. Public institutions in the field of education place information with indication of the list of paid types of activity on sales of goods (works, services) and the price list of goods prices (work, service) realized by public institutions in buildings of public institutions.

4. Paid types of activity on sales of goods (works, services) are provided by working curricula (programs) developed based on the state obligatory standards of formation of all education levels approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of August 3, 2022 No. 348 "About approval of the state obligatory standards of preschool education and training, initial, main average and general secondary, technical and professional, postsecondary education" (it is registered in the Register of state registration of regulatory legal acts at No. 29031) and approved with state bodies in the field of education.

5. Paid types of activity on sales of goods (works, services) are provided to students and (or) pupils based on statements in any form of the full age student and (or) pupil and parents or other legal representatives of the minor student and (or) the pupil according to the separate schedule.

According to the Administrative procedural Procedure Code of the Republic of Kazakhstan the statement for provision of paid types of activity is considered and on it the decision within 15 (fifteen) working days from the date of receipt in public institution of education is made if other is not provided by the laws of the Republic of Kazakhstan.

6. Relations of public institution of the education rendering services on paid basis, and studying (pupil), his parents and other legal representatives are regulated by the agreement according to the Civil code of the Republic of Kazakhstan.

7. Collection of cash for rendering paid types of activity on sales of goods (works, services) by public institutions of education is made based on cash receipt orders with obligatory application of cash registers.

Chapter 3. Procedure for the order, use by public institutions in the field of education, money from sales of goods (works, services)

8. The means arriving from rendering paid types of activity on sales of goods (works, services) by public institutions of education are spent according to plans of receipts and expenses of money from sales of goods (works, services) of public institution of education.

Plans of receipts and expenses of the money received by public institutions in the field of education from sales of goods (works, services) remaining at their order are constituted according to the Procedure of treasurer budget implementation and their cash servicing approved by authorized body on budgetary planning according to Item 8 of article 101 of the Code.

9. The means arriving from sales of goods, works, services over requirements of the state obligatory standards of education are spent in the following directions:

1) strengthening of educational material resources of organizations of education;
