About measures for increase in potential and competitiveness of the state organizations of health care of the Kyrgyz Republic

In the conditions of the remaining system problems in activities of the state organizations of health care of the Kyrgyz Republic which are shown in limitation of managerial and financial independence, insufficient flexibility in personnel policy and stimulation of workers, and also low competitiveness in comparison with private sector need of approbation of new approaches to regulation of their activities ripened.

The existing management model limits possibilities of the organizations of health care for effective use of own income, to attraction of additional resources and implementation of modern methods of management. It negatively affects quality of the provided medical and sanitary help, availability of innovative technologies and motivation of health workers.

For search of the optimal solutions allowing to provide financial stability, organizational flexibility and improvement of quality of the medical and sanitary help the aprobatsionny mode on provision to the separate state organizations of health care of managerial and financial autonomy is initiated in case of simultaneous preserving obligations on execution of the Program of the state guarantees for providing citizens with the medical and sanitary help.

For the purpose of increase in efficiency of activities of the state organizations of health care, development of their potential and competitiveness, creation of conditions for improvement of quality of the provided medical and sanitary help, according to article 31-1 of the Law of the Kyrgyz Republic "About regulatory legal acts of the Kyrgyz Republic", being guided by Articles 66, 71 Constitutions of the Kyrgyz Republic, I decide:

1. Introduce aprobatsionny regime on temporary regulation of activities of the state organizations of health care of the Kyrgyz Republic from January 1 to December 31, 2026.

2. To the Cabinet of Ministers of the Kyrgyz Republic for the purpose of realization of the aprobatsionny mode specified in Item 1 of this Decree:

1) to determine the list of the state organizations of health care of the Kyrgyz Republic at all levels of provision of the medical and sanitary help for which the aprobatsionny regime will be introduced;

2) to approve temporary procedure for regulation of activities of the state organizations of health care in the aprobatsionny mode and within the means provided for 2026 to health care sector with provision of the following powers by it without decline in quality and availability of medical services to the population:

- make decisions on forming of organizational structure according to the unified nomenclature of structural divisions and positions;

- make decisions on forming of the number of staff according to updated regular standard rates and the unified nomenclature of structural divisions and positions;

- establish forms and the amount of compensation, material stimulation and financial support to all employee categories within the salary fund and within the provided budget funds;

- to manage independently own income and released financial resources received as a result of structural and functional optimization and to prepare offers for automation of processes of work on results of the aprobatsionny mode;

- if necessary to grant the right to open bank accounts for transfer of the means received from rendering paid medical services in Eldik Bank open joint stock company for carrying out calculations;

- to independently create and approve rates for the rendered paid medical services according to procedure and in the limits approved by the Ministry of Health of the Kyrgyz Republic taking into account obligatory reduced rates for socially vulnerable segments of the population.

3. Determine that:

1) implementation of mechanisms of pricing of the operating and new medical and other services for the state organizations of health care in the aprobatsionny mode is not subject to regulation by the legislation of the Kyrgyz Republic on the state and municipal services;

2) conducting financial accounting and forming of accounting (financial) records is performed with use of the automated information system "Central Financial Accounting".

4. To the Ministry of Health of the Kyrgyz Republic:

1) together with the Ministry of Economy and Trade of the Kyrgyz Republic to develop methodology of forming of rates for paid services;

2) in two-month time to develop and submit for approval in the Cabinet of Ministers of the Kyrgyz Republic temporary procedure for regulation of activities of the state organizations of health care in the aprobatsionny mode;

3) in case of successful realization of the aprobatsionny mode on provision to the separate state organizations of health care of managerial and financial autonomy to initiate corresponding changes in regulatory legal acts of the Kyrgyz Republic.

5. To impose control of execution of this Decree on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.

6. This Decree becomes effective after seven days from the date of official publication.
