1. Approve the Instruction about procedure for the organization of work to destination and to pension payment (benefits) to the military personnel and members of their families in pension bodies of the Ministry of Defence it (is applied).

2. Recognize invalid:

the resolution of the Ministry of Defence of the Republic of Belarus of September 25, 2012 No. 40 "About approval of the Instruction about procedure for the organization of work to destination both pension payment and benefits to military personnel and members of their families in pension bodies of the Ministry of Defence of the Republic of Belarus and recognition voided some resolutions of the Ministry of Defence of the Republic of Belarus and their separate structural elements";

the resolution of the Ministry of Defence of the Republic of Belarus of December 14, 2015 No. 33 "About entering of amendments and changes into the resolution of the Ministry of Defence of the Republic of Belarus of September 25, 2012 No. 40".

3. This resolution becomes effective after its official publication.

Chapter 1. General provisions

1. In this Instruction the procedure for the organization of work to destination and pension payment (benefits) to the military personnel and members of their families which provision of pensions is performed in pension bodies of the Ministry of Defence is determined.

2. For the purposes of this Instruction the following terms and their determinations are used:

renewal of pension payment (monthly allowance) – activities of officials (specialists) of pension bodies of the Ministry of Defence for establishment of the right of the applicant to receipt of pension (monthly allowance), for calculation of the size, determination of term, conditions and payment procedure of pension (monthly allowance) according to the Law of the Republic of Belarus of December 17, 1992 No. 2050-XII "About provision of pensions of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee, the State committee of judicial examinations, bodies and divisions on emergency situations and bodies of financial investigations" which payment (which) it was stopped earlier (is suspended);

military units – bodies of military management, structural divisions of the Ministry of Defence, the General Staff of Armed Forces and Armed Forces, connections, military units, organizations of education in which training on specialties for Armed Forces, other troops and military forming, and also military faculties and departments of organizations of the higher and secondary vocational education, the organization of Armed Forces and military commissariats is performed;

the applicant – person from among the military personnel (pensioners of the Ministry of Defence, receivers of pension) and members of their families who in writing addressed to pension bodies of the Ministry of Defence behind award of pension (benefit) or on the questions connected with conditions, regulations and payment procedure of pension (benefit) according to the Law of the Republic of Belarus "About provision of pensions of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee, the State committee of judicial examinations, bodies and divisions on emergency situations and bodies of financial investigations";

award of pension (monthly allowance) – activities of officials (specialists) of pension bodies of the Ministry of Defence for establishment of the right of the applicant to receipt of pension (monthly allowance) according to the Law of the Republic of Belarus "About provision of pensions of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee, the State committee of judicial examinations, bodies and divisions on emergency situations and bodies of financial investigations", on calculation of the size, determination of term of appointment, conditions and payment procedure of pension (monthly allowance), and also on establishment of the right of the applicant to receipt of allowances and increases to pension;

the pensioner of the Ministry of Defence – person to whom according to the Law of the Republic of Belarus "About provision of pensions of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee, the State committee of judicial examinations, bodies and divisions on emergency situations and bodies of financial investigations" in pension bodies of the Ministry of Defence it is appointed (is renewed) pension payment;

pension case – drawn up in pension bodies of the Ministry of Defence put, including the reduced and (or) electronic case containing set of documents in the original and (or) in the copy (certified in accordance with the established procedure) based on which it is granted and pension is paid to the pensioner of the Ministry of Defence;

pension documents – documents (electronic documents) which are the basis for appointment and pension payment (benefit) to the pensioner of the Ministry of Defence including determining the size and payment due date of pension (benefit), and also forms of documents and documents with certain degree of protection by provision of pensions;

pension bodies of the Ministry of Defence – the head financial and economic department of the Ministry of Defence and military commissariats;

pension of the Ministry of Defence – monthly state money payment which right is determined on conditions, on regulations and according to the procedure, established in the Law of the Republic of Belarus "About provision of pensions of the military personnel, faces of the commanding and ordinary structure of law-enforcement bodies, the Investigative Committee, the State committee of judicial examinations, bodies and divisions on emergency situations and bodies of financial investigations" which is appointed in the Ministry of Defence by the serviceman for the purpose of compensation of the income lost in connection with their dismissal from military service or in case of approach at them of disability, and to members of their families – in case of loss of the supporter;
