About approval of regulatory legal acts on ensuring financial stability of the insurance (reinsurance) organizations

For the purpose of realization of part 3 of article 82 of the Law of the Kyrgyz Republic "About insurance and insurance activity", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Determine that the maximum scope of responsibility on separate risk in the insurance contract cannot exceed 20 percent from the amount of own means.

2. Establish the following requirements to the minimum size of the authorized capital for:

1) the insurance (reinsurance) organization performing activities for voluntary and obligatory types of insurance and reinsurance including imputed insurance, annuity insurance and insurance by the Islamic principles takaful, in the amount of at least 150000000 (hundred fifty million) som;

2) the insurance (reinsurance) organization performing activities only for reinsurance - in the amount of at least 300000000 (three hundred million) som;

3) the insurance (reinsurance) organization performing activities only for reinsurance in the territory of free economic zones in the Kyrgyz Republic - in the amount of at least 100000000 (hundred million) som;

4) insurance (reinsurance) the broker - in the amount of at least 1000000 (one million) som.

The authorized capital of the insurance (reinsurance) organizations and insurance (reinsurance) brokers is created only in national currency in commercial banks of the Kyrgyz Republic.

3. Approve:

1) Rules of placement by insurance companies of insurance (technical) reserves according to appendix 1;

2) the Instruction about prudential standard rates for the insurance (reinsurance) organization according to appendix 2;

3) Regulations on procedure of payments of standard rates of contributions to insurance (technical) reserves of insurance companies of the Kyrgyz Republic according to appendix 3.

4. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure of payments of standard rates of contributions to insurance (technical) reserves of insurance companies of the Kyrgyz Republic" of August 5, 2009 No. 500;

10) the paragraph third Item 1 of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for submission of the reporting (information) and disclosure of information by subjects of the financial market" of September 4, 2018 No. 417;

11) Item 2 appendices to the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on procedure for submission of the reporting (information) and disclosure of information by subjects of the financial market" of September 4, 2018 No. 417" of May 13, 2019 No. 222.

5. This resolution becomes effective after ten days from the date of official publication.
