About approval of the Regulations on military commissariats of the Kyrgyz Republic

For the purpose of implementation of requirements of Articles 14, of 15, "About general conscription of citizens of the Kyrgyz Republic, about military and alternative services", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides 17 Laws of the Kyrgyz Republic:

1. Approve Regulations on military commissariats of the Kyrgyz Republic according to appendix.

2. Recognize to invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Regulations on military commissariats of the Kyrgyz Republic" of April 13, 2000 No. 201;

2) the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on military commissariats of the Kyrgyz Republic" of April 13, 2000 No. 201" of December 11, 2012 No. 824;

3) the order of the Government of the Kyrgyz Republic "About modification of the order of the Government of the Kyrgyz Republic "About approval of the Regulations on military commissariats of the Kyrgyz Republic" of April 13, 2000 No. 201" of April 12, 2018 No. 204;

4) Item 1 of the order of the Government of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic for the purpose of reduction in compliance with the codes of the Kyrgyz Republic accepted within the undertaken judicial reform" of December 25, 2018 No. 616.

3. This resolution becomes effective after ten days from the date of official publication.

Regulations on military commissariats of the Kyrgyz Republic

Chapter 1. General provisions

1. This Regulations on military commissariats of the Kyrgyz Republic (further - the Provision) determine the basic principles of creation of system of military commissariats of the Kyrgyz Republic, their subordination, tasks, accountability, content and providing, and also procedure for their interaction with local public administrations and local government bodies of the Kyrgyz Republic.

2. Military commissariats are local authorities of military management in areas and the cities.

3. Military commissariats in the work are guided by the Constitution of the Kyrgyz Republic, the laws of the Kyrgyz Republic, decrees, orders of the President of the Kyrgyz Republic, resolutions and orders of the Cabinet of Ministers of the Kyrgyz Republic, orders, directives and orders of the Minister of Defence, chief of the General Staff of Armed Forces of the Kyrgyz Republic and this Provision.

4. For carrying out organized sending recruits and persons liable for call-up to military service and training sessions the Republican assembly point and assembly points are created.

6. The organization of activities of military commissariats exercises the Head organizational and mobilization department of the authorized state body knowing questions of defense.

7. Military commissariats contain on the states approved by the authorized state body knowing questions of defense.

Completing of established posts of military commissariats by the military personnel is performed by the Head organizational and mobilization department on representation of military commissioners according to their organizational and regular structure approved by the authorized state body knowing questions of defense. Matching of the military personnel, appointment them to positions in military commissariats, and also release of the military personnel from their positions are performed according to regulations on procedure for passing of military service under the contract. Special preparation and retraining of the military personnel of military commissariats is performed in general training system of officers of Armed Forces of the Kyrgyz Republic, and also on special rates and charges.

9. Military commissariats notify executive bodies and local self-government of the Kyrgyz Republic on structure of the device of strengthening of military commissariats (*), including specialists doctors, average medical personnel and technical workers), means of communication, transport and other appliances raised for accomplishment of the tasks assigned to military commissariats.
