About bases of state policy of national memory of the Ukrainian people

The Verkhovna Rada of Ukraine on behalf of the Ukrainian people,

in view of resolutions of the Parliamentary Assembly of the Council of Europe No. 1096 (1996) of June 27, 1996 about liquidation of heritage of the former communist totalitarian regime, No. 1481 (2006) of January 25, 2006 about need of the international condemnation of crimes of totalitarian communist regime, the resolution of Parlamentskoy Assamblei OBSE SC (09) 3 R of June 29 - on July 3, 2009 about inadmissibility of glorification of the totalitarian modes,

considering that the Ukrainian people suffered huge losses as a result of making criminal communistic and national socialist (Nazi) the totalitarian modes in the territory of Ukraine of crimes of genocide, crimes against humanity, crimes of aggression, war crimes and other human rights violations which effects are still finally not overcome,

in view of that the Ukrainian people resisted foreign domination and combated for independence which consequence recovery of the Ukrainian statehood turned out to be on August 24, 1991,

acknowledging responsibility of the democratic, constitutional state for recovery of historical justice and celebration of memory of persons who fought for independence of Ukraine, and the victims of the totalitarian modes,

aiming at understanding around difficult questions of the past, consolidation of society around general history, values of human dignity, freedom, democracy, equality, supremacy of law and respect for human rights,

understanding rashizm as new kind of totalitarian ideology and the practician which are the cornerstone of the mode created in the state aggressor and are based on traditions of the Russian chauvinism and imperialism, practicians of communist regime of the USSR and national socialism (Nazism),

considering that in the armed aggression against Ukraine which began in February, 2014, the state aggressor manipulates interpretations of historical events,

understanding that one of components of the armed aggression of the Russian Federation is the aspiration to deprive of Ukrainians of their historical memory,

considering increase in interest of society in history, and especially history XX of Ukraine of century,

adopts this Law which determines the purpose, the basic principles, tasks, the legal basis of state policy of national memory of the Ukrainian people, and also the main activities of subjects of policy of national memory.

Section I. General provisions

Article 1. Determination of terms

In this Law the following terms are used in the following sense:

1) the War of independence of Ukraine - fight for independence, sovereignty, territorial integrity and immunity of Ukraine against aggression of the Russian Federation which began on February 19, 2014. War is consequence of the consistent Russian imperial policy directed to denial and destruction of the Ukrainian statehood and identity of the Ukrainian people and includes temporary occupation by the Russian Federation of the Autonomous Republic of Crimea and the city of Sevastopol; counteraction of aggression by conducting anti-terrorist operation, implementation of actions for ensuring national security and defense, repulse and control of the armed aggression of the Russian Federation in the Donetsk and Luhansk regions; implementation of the actions necessary for ensuring defense of Ukraine, protection of safety of the population and interests of the state in connection with the armed aggression of the Russian Federation against Ukraine;

2) state policy of national memory of the Ukrainian people (further - policy of national memory) - the direction of state policy directed to creation of legal, organizational, economic conditions and guarantees of recovery and preserving national memory of the Ukrainian people, research and promoting of history of Ukraine;

3) crimes against the Ukrainian people - genocides, massacre, tortures, deportations and other crimes against humanity, war crimes, prosecutions for political, social, class, national, religious and other motives, other crimes committed against the Ukrainian people communistic and national socialist (Nazi) by the totalitarian modes, other political regimes, in particular the Holodomor of 1932-1933, mass artificial hunger of 1921-1923, 1946-1947, repressions of communist totalitarian regime 1917-1991, Holocausts and Nazi prosecutions, genocide of the Crimean Tatar people, other repressive measures of the Russian imperial policy, and also crimes committed by the state aggressor;

4) historical anti-Ukrainian propaganda - distribution of obviously unreliable information about stories of Ukraine for the purpose of public glorifikation or justification of imperialism and totalitarianism, the corresponding political regimes, public denial of crimes against the Ukrainian people, impact on public opinion in Ukraine or other states for the denial of subjectivity of Ukraine and the rights of the Ukrainian people affirmed in the Constitution of Ukraine;

5) komemorativny action - the action organized by public authorities, local government bodies, organizations, the organizations, their officials, other persons or subjects which purpose is the celebration of historical events and/or persons;

6) memorial - object of monumental art which can include architectural, art, sculptural, landscape component and is built for the purpose of perpetuating of memory of significant faces or significant events in the history of the people, the state, edge, the settlement;

7) memorial board - the memorable sign established on immovable objects of cultural heritage, other constructions or other places of memory with the text opening communication made object or room of memory with historical events and/or persons;

8) memorial complex - the complex of objects of monumental art, architectural, art, sculptural, landscape elements built for the purpose of perpetuating of memory of significant faces or significant events in the history of the people, the state, edge, the settlement;

9) the place of memory of the Ukrainian people (further - the place of memory) - the territory localized in space and placed (established, built) on it the objects connected with history of Ukraine and used including, for implementation of komemorativny actions. The monument, memorable sign, memorial board can be designations of places of memory;

10) national memory - the set of knowledge, representations and valuable estimates of those events of the past kept by the Ukrainian people which exerted decisive impact on its history self-identification, gosudarstvoobrazovaniye and/or are perceived in society as the most significant;

11) rashizm - kind of totalitarian ideology and the practician which are the cornerstone of the Russian Nazi totalitarian regime created in the state aggressor and are based on traditions of the Russian chauvinism and imperialism, practicians communistic and national socialist (Nazi) the totalitarian modes;

12) the Ukrainian institute of national memory - the central executive body with the special status providing forming also realizes state policy in the field of national memory of the Ukrainian people which activities go and coordinated by the Cabinet of Ministers of Ukraine.

2. Other terms are used in this Law in the values given in the laws of Ukraine "About burial and funeral case", "About protection of cultural heritage" and other legal acts of Ukraine.

Article 2. Law coverage

1. This Law determines the main legal basis of forming and realization of policy of national memory.

2. This Law governs the relations arising between subjects of powers of authority, legal entities and physical persons, institutes of civil society in the course of forming and realization of policy of national memory.

Article 3. Legal basis of state policy of national memory of the Ukrainian people

1. The legal basis of policy of national memory is constituted by the Constitution of Ukraine, this Law and other laws of Ukraine, acts of the Verkhovna Rada of Ukraine, the President of Ukraine, the Cabinet of Ministers of Ukraine, other regulatory legal acts of Ukraine issued in pursuance of the Constitution and the laws of Ukraine and also the international agreements of Ukraine which consent to be bound is provided by the Verkhovna Rada of Ukraine.

2. If the international treaty of Ukraine which became effective in accordance with the established procedure establishes other rules, than those that are provided by this Law, rules of the international treaty are applied.

3. If the law of Ukraine, other regulatory legal act establish other rules, than those that are provided by this Law, the rules established by this Law are applied.

Article 4. Purpose of state policy of national memory of the Ukrainian people

1. The purpose of policy of national memory is forming of general understanding of the past by recovery and preserving national memory, support of researches on history of Ukraine and its promoting for strengthening of unity of the Ukrainian people.

2. The policy of national memory is component of bases of homeland security of Ukraine, important factor of forming of public immunity against human rights violations.

Article 5. Basic principles of state policy of national memory of the Ukrainian people

1. The basic principles of policy of national memory are:

1) supremacy of law;

2) openness and transparency of acceptance and accomplishment of management decisions;

3) equal rights and nediskriminatsionnost;

4) respect of human dignity;

5) systemacity;

6) political impartiality;

7) scientific character and respect for historical reliability;

8) non-admission of justification of genocide, crimes against humanity, aggressions, war crimes, human rights violations;

9) recognition of crime of the totalitarian modes, Russian imperial policy and rashizm;

10) recognition of burden of fight for independence of Ukraine;

11) freedom of the academic discussion and public dialogue;

12) full support of the state in implementation of scientific research on stories of Ukraine, activities of public associations and other institutes of civil society for research and promoting of history of Ukraine, holding komemorativny actions;

13) interdepartmental and intersectoral interaction in forming and realization of policy of national memory.

Article 6. Main objectives of state policy of national memory of the Ukrainian people

1. The main objectives of policy of national memory are:

1) ensuring steady public dialogue concerning the past of Ukraine;

2) counteraction to historical anti-Ukrainian propaganda and overcoming its effects;

3) assistance of safety and to open access to documents of National Archive Fund, in particular to archive information of repressive bodies;

4) celebration, perpetuating of memory and recovery of historical justice concerning the victims of crimes against the Ukrainian people;
