About burial and funeral case

(as amended on 31-05-2022)

This Law determines the general legal basis of implementation in Ukraine of activities for burial of the dead, governs the relations arising after death (death) of person on holding procedure of burial, and also establishes guarantees of the worthy relation to body (remains, ashes) of the dead and safety of the place of burial.

Section I. General provisions

Article 1. Concept of burial

Burial - the activities of relevant organs of the government, local government bodies, their officials within the powers determined by this Law, and also subjects of managing directed on:

providing the worthy relation to body (remains, ashes) of the dead (further - to body);

providing the right of citizens to burial of their body according to their declaration of will if that is available;

creation and operation of the objects intended for burial, content and safety of places of burials;

the organization and carrying out burials of the dead and/or dead (further - the dead);

rendering funeral services, realization of objects of ritual accessory.

Article 2. Determination of terms

In this Law the stated below terms are used in the following value:

declaration of will of the citizen concerning the relation to his body after death - the desire expressed in oral (in the presence of witnesses) or in writing, certified of the procedure established by the legislation;

the place of burial - the cemetery, crematorium, columbarium or other building or construction intended for the organization of burial of the dead;

the place of honourable burial - the specially allotted parcel of land in the territory of the cemetery or beyond its limits, intended for the organization of honourable burials, and also the National military memorial cemetery;

grave - the place at the cemetery, in crematorium, columbarium or in other building or construction intended for the organization of burial of the dead where the coffin with body of the dead or ballot box with ashes is buried;

The national military memorial cemetery - the volume and spatial object placed on the specially allotted parcel of land including the military cemetery, museum complex, the ritual building and other necessary constructions for the organization of honourable burials of the died (died) persons which protected independence, sovereignty and territorial integrity of Ukraine was provided by execution of service duties and oath of allegiance to the Ukrainian people;

namogilny constructions - the memorable constructions established on graves and immortalizing memory of the dead;

violation of grave, other place of burial:

unauthorized formation of texts, drawings, symbols or other images on the cemeterial constructions used for ceremony of burial and remembrance of the dead, namogilny constructions, crypts, ballot boxes with ashes, graves or other places of burial;

unauthorized damage, unearthing, destruction or in different way destruction of the cemeterial constructions used for ceremony of burial and remembrance of the dead, namogilny constructions, barriers, crypts, ballot boxes with ashes, graves or other places of burial;

use on purpose, not provided by the current legislation, or unauthorized use of the cemeterial constructions used for ceremony of burial and remembrance of the dead, namogilny constructions, crypts, ballot boxes with ashes, graves or other places of burial or making of other actions, aiming to disdain family or public memory of the dead, to show negligence to the place of burial and the public, religious principles and traditions in this sphere;

violation of body (remains, ashes) of the dead - making of obscene deliberate actions over body (remains, ashes) of the dead, unauthorized renting of clothes from body (remains, ashes) of the dead, moving to other place or partition or destruction of body (remains, ashes) of the dead, implementation of the act of necrophilia, use of parts of the buried body with ritual or others, the purposes which are not provided by the current legislation, or making of other actions aiming to disdain family or public memory of the dead, to show negative attitude to the dead, to cause insult to the family of the dead, to reveal neglect to the public, religious principles and traditions in this sphere;

crypt - the underground or deepened to the earth capital construction intended for burial within the place of the burial which is taken away in accordance with the established procedure;

ballot box with ashes - the reservoir intended for preserving ashes of the dead;

the cemetery - the parcel of land which is taken away in the procedure established by the law with the equipped graves and/or the constructed crematoriums, columbaria or other buildings and constructions intended for the organization of burial and content of places of burials;
