About approval of the Regulations on development and implementation of interstate programs in the industrial sphere

For the purpose of realization of Item 9 of article 92 of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 2 of the Protocol on industrial cooperation (appendix No. 27 to the specified Agreement) Eurasian intergovernmental council solved:

1. Approve the enclosed Regulations on development and implementation of interstate programs in the industrial sphere.

2. Determine that the requirement about participation in implementation of the interstate program in the industrial sphere of the interested subjects at least from 3 state members of the Eurasian Economic Union, stipulated in Item 3 Provisions approved by this Decision does not extend to interstate programs in the industrial sphere which order about development is accepted Council of the Eurasian economic commission to the introduction of this Decision in force.

3. Recognize invalid:

The decision of Eurasian intergovernmental council of February 2, 2018 No. 1 "About approval of the Regulations on development, financing and implementation of interstate programs and projects in the industrial sphere";

The decision of Eurasian intergovernmental council of February 3, 2023 No. 1 "About modification of the Regulations on development, financing and implementation of interstate programs and projects in the industrial sphere".

4. This Decision becomes effective after 30 calendar days from the date of its official publication, but not earlier than January 1, 2026.

Regulations on development and implementation of interstate programs in the industrial sphere

I. General provisions

1. This Provision determines forms, procedure and the mechanism of development and implementation of the interstate programs in the industrial sphere (further - programs) aimed at the development of industrial cooperation within the Eurasian Economic Union (further - the Union) on mutually advantageous basis.

2. For the purposes of this provision concepts which mean the following are used:

"initiative about development of the program" - the motivated offer containing information on feasibility of development of the program;

"the initiator of development of the program" - the participant of Eurasian technological framework determined according to the regulations on forming and functioning of Eurasian technological frameworks approved by Eurasian intergovernmental council, either the public authority or the organization of state member of the Union authorized by the government of state member;

"national customers" - the public authorities of state members of the Union participating in development and program implementation and control of the course of the actions and (or) works which are carried out in the territory of state member within the program;

"the national customer coordinator" - one of national customers coordinating activities of national customers of state member of the Union in case of development and program implementation;

"responsible for program implementation" - the participant of Eurasian technological framework or the other person determined by Council of the Eurasian economic commission, the performing coordination of activities for development and program implementation, and also preparation of the summary annual statement about results of its realization;

"subprogramme" - the structural element of the program created for implementation of actions within the solution of one of the tasks of the program set for achievement of its objects;

"program" - the joint program with the participation of state members of the Union for realization of complex of the subprogrammes and (or) projects interconnected on resources, terms of implementation for the purpose of providing effective solution of the set integration tasks within the Union in the field of innovative development and industrial cooperation;

"project" - the structural element of the program representing the organizational and economic, research, developmental, production and other actions for creation of product directed to goal achievement of the program;

"participants of the program" - the national customers and participants of Eurasian technological frameworks providing development and program implementation and (or) participating in financing of its development and realization and also the legal entities and individual entrepreneurs involved to its realization according to the civil agreements signed with responsible for program implementation, either the national customer coordinator, or national customers.

3. The program is implemented in the project format providing participation of the interested subjects at least from 3 state members of the Union (further - state members), with official confirmation of national customers coordinators and national customers by the governments of the corresponding state members. The program is developed for the period necessary for achievement of the objects set in it (but no more than for 5 years).

Subprogrammes and projects which are performed by implementation of actions, interconnected on resources, participants of the program and to the terms approved as a part of subprogrammes and projects can be structural elements of the program. The program can represent set of parts (segments) of state programs which are implemented by state members in the corresponding industries, procedure for development which realization, financing and control over the implementation it is established according to the legislation of state members.

4. The program shall correspond:

a) to the purposes of coordination of interstate and (or) cross-industry bonds and ensuring interaction of technologically integrated industries and the separate companies, deepenings of cooperation bonds, creations of optimal conditions for development of industrial production;

b) to basic novelty and prospects of the technical, organizational and other solutions necessary for wide circulation of innovations and increase in competitiveness of industrial output.
