About approval of the Regulations on development, financing and implementation of interstate programs and projects in the industrial sphere

For the purpose of realization of Item 9 of article 92of the Agreement on the Eurasian Economic Union of May 29, 2014 and Item 2 of the Protocol on industrial cooperation (appendix № 27 to the Agreement on the Eurasian Economic Union of May 29, 2014) the Euroasian intergovernmental council decided:

1. Approve the enclosed Regulations on development, financing and implementation of interstate programs and projects in the industrial sphere.

2. This Decision becomes effective after 30 calendar days from the date of its official publication.

Regulations on development, financing and implementation of interstate programs and projects in the industrial sphere

I. General provisions

1. This Provision is developed for the purpose of implementation of subitem 4.4.3 of the Main directions of industrial cooperation within the Eurasian Economic Union approved by the Decision of the Eurasian intergovernmental council of September 8, 2015 № 9 (further - the Main directions).

2. This Provision determines forms, procedure and the mechanism of interaction of state members of the Eurasian Economic Union (further - state members), public authorities, the organizations, legal entities and physical persons of state members and the Eurasian economic commission (further - the Commission) in case of development, financing and implementation of interstate programs and projects within innovative and industrial cooperation (further respectively - programs, projects) and is aimed at providing goal achievement and tasks of industrial development of state members within the Eurasian Economic Union.

3. For the purposes of this provision concepts which mean the following are used:

"the initiator of development of the program (project)" - the legal entity who is the participant of Eurasian technological framework and given the corresponding Eurasian technological framework authority on initiation of development of the program (project). The government of state member or the public authority authorized by it can also act as the initiator;

the paragraph third is excluded;

"national customers" - the public authorities of state members participating in development, program implementation (project) and control of the course of the actions and (or) works which are carried out in the territory of state member within the program (project);

"the national customer coordinator" - one of national customers coordinating activities of other national customers from state member in case of development and program implementation (project);

the paragraph of the sixth is excluded;

"responsible for the program (project)" - one of national customers coordinators or the participant of Eurasian technological framework performing coordination of activities for development and program implementation (project) according to the decision of Council of the Commission;

"subprogramme" - the Section or part of the program created for projects implementation within the solution of one of tasks of the program or works on certain subject;

"program" - number of the subprogrammes and (or) projects connected with each other, management of which is coordinated for achievement of effective objectives and tasks and which would be unavailable under management of them separately;

"project" - the complex of the interconnected actions directed to creation of unique product in the conditions of temporary and resource restrictions or providing the operational solution of specific, highly specialized industry objectives;

"participants of the program (project)" - the national customers and participants of Eurasian technological frameworks providing development and program implementation (project) and (or) participating in financing of its development and realization and also the legal entities involved for its realization according to the civil agreements signed with responsible for the program (project), either the national customer coordinator, or national customers.

4. The program includes complex of the subprogrammes and (or) projects (organizational and economic, research, developmental, production, etc.) realized for the purpose of providing effective solution of objectives in the field of innovative and industrial development of state members interconnected on resources, participants of the program (project) and terms of implementation. The program can include several subprogrammes and (or) projects. At the same time the project can be or not be part of the program.

The program may contain information on the works having relation to it, but which are not connected with the separate projects entering the program.

The program can represent set of parts (segments) of state programs which are implemented by state members in the corresponding industries, procedure for development which realization, financing and control over the implementation it is established according to the legislation of state members.

The subprogramme is developed by the initiator of development of the program (project) for the solution of specific objective of the program and represents complex of the actions and (or) works directed to achievement of the established target indicators (indicators).

The project is developed by the initiator of development of the program (project) for the solution of highly specialized industry problem and represents complex of actions and (or) works. The project can be implemented both within the program (subprogramme), and regardless of accomplishment of programs (subprogrammes).

II. Requirements to the program (project)

5. The program (project) is implemented with the participation of at least 2 state members with official confirmation of national customers coordinators and national customers by the governments of the corresponding state members. The program is developed for the period necessary for achievement of the objects set in it, but no more than for 5 years, the subprogramme or the project - no more than for 3 years.

6. Requirements to contents of subprogrammes are similar to requirements to contents of the program.
