About approval of the Regulations on federal state supervision in the field of use of atomic energy

1. Approve the enclosed Regulations on federal state supervision in the field of use of atomic energy.

2. Realization of the powers provided by this resolution is performed by Federal Service for Environmental, Technological and Nuclear Supervision within the number of workers of federal executive bodies, and also budgetary appropriations provided to Service in the federal budget on management and management in the sphere of the established functions established by the Government of the limiting Russian Federation.

Regulations on federal state supervision in the field of use of atomic energy

I. General provisions

1. This Provision establishes procedure for the organization and implementation of federal state supervision in the field of use of atomic energy (further - the state supervision).

2. This Provision does not govern the relations connected with the state supervision in the field of development, production, testing, operation and utilization of nuclear weapon and military nuclear power plants.

3. The state supervision according to this Provision is exercised by Federal Service for Environmental, Technological and Nuclear Supervision and territorial authorities of Service.

4. The state supervision is exercised by the following officials of Federal Service for Environmental, Technological and Nuclear Supervision and territorial authorities of Service:

a) head of Service, deputy managers of Service;

b) heads of structural divisions of central office of Service, deputy managers of structural divisions of central office of Service whose official regulations provide powers on implementation of the state supervision;

c) federal government civil servants of category "specialists" of the leading and senior groups of positions of structural divisions of central office of Service whose official regulations provide powers on implementation of the state supervision;

d) heads of territorial authorities of Service, deputy managers of territorial authorities of Service;

e) chiefs of departments of territorial authorities of Service, deputy chiefs of departments of territorial authorities of Service whose official regulations provide powers on implementation of the state supervision;

e) federal government civil servants of category "specialists" of the leading and senior groups of positions of territorial authorities of Service whose official regulations provide powers on implementation of the state supervision.

5. The officials exercising the state supervision:

a) have the rights and carry out obligations which are provided by articles 27.12 and 27.16 of the Federal law "About Use of Atomic Energy" (further - the Federal Law), and also bear responsibility for non-execution or improper execution of the powers assigned to them in accordance with the legislation of the Russian Federation;

b) shall observe restrictions, the stipulated in Clause 27.10 Federal Laws.

6. The state supervision includes:

a) the organization and conducting checks (inspections) of observance by the checked legal entities specified in part one of article 27.1 of the Federal Law and the legal entities specified in paragraph five of part eleven of article 27.2 of the Federal Law (further - the checked faces), the mandatory requirements specified in part one of article 27.1 of the Federal Law (further - mandatory requirements), conditions of action of permissions (licenses), and also compliance of subjects to use of atomic energy, their elements and systems to mandatory requirements and conditions of action of permissions (licenses);

b) the organization and holding actions for control of safety on the subjects to use of atomic energy when implementing constant state surveillance provided by part nine of article 27.5 of the Federal Law;

c) implementation of the actions directed to prevention of violations of mandatory requirements, conditions of action of permissions (licenses) according to article 27.6 of the Federal Law;

d) taking measures, stipulated by the legislation the Russian Federation, on suppression of violations of mandatory requirements, conditions of action of permissions (licenses) in cases of identification of such violations;

e) systematic observation of observance of mandatory requirements, conditions of action of permissions (licenses).
