About federal state supervision in the field of use of atomic energy

1. Approve the enclosed Regulations on federal state supervision in the field of use of atomic energy.

2. Determine that realization of the powers provided by Regulations on federal state supervision in the field of use of atomic energy is performed by Federal Service for Environmental, Technological and Nuclear Supervision within the limiting Russian Federation established by the Government of the number of employees of its central office and territorial authorities, and also budgetary appropriations provided to Service in the federal budget on management and management in the sphere of the established functions.

Regulations on federal state supervision in the field of use of atomic energy

1. This Provision establishes procedure of federal state supervision in the field of use of atomic energy (further - the state supervision).

This Provision does not govern the relations connected with development, production, testing, operation and utilization of nuclear weapon and military nuclear power plants.

2. The state supervision is exercised by the Federal Service for Environmental, Technological and Nuclear Supervision which is authorized body of state regulation of safety when using atomic energy according to the Federal Law "About Use of Atomic Energy", the Federal Law "About Protection of the Rights of Legal Entities and Individual Entrepreneurs when Implementing the State Control (Supervision) and Municipal Control", other Federal Laws and regulatory legal acts of the President of the Russian Federation, the Government of the Russian Federation, and also this Provision.

3. The Federal Service for Environmental, Technological and Nuclear Supervision exercises the state supervision by forces of structural divisions of central office and territorial authorities with attraction in need of experts and the expert organizations.

4. The following officials of Federal Service for Environmental, Technological and Nuclear Supervision have the right to exercise the state supervision:

a) head of Service, his deputies;

b) assistants, advisers to the head of Service whose official regulations provide powers on implementation of the state supervision;

c) heads of structural divisions of central office of Service, their deputies whose official regulations provide powers on implementation of the state supervision;

d) chiefs of departments of structural divisions of central office of Service, their deputies whose official regulations provide powers on implementation of the state supervision;

e) federal government civil servants of category "specialists" of the leading and senior groups of positions of structural divisions of central office of Service whose official regulations provide powers on implementation of the state supervision;

e) heads of territorial authorities of Service, their deputies;

g) assistants, advisers to heads of territorial authorities of Service whose official regulations provide powers on implementation of the state supervision;

h) chiefs of departments of territorial authorities of Service, their deputies whose official regulations provide powers on implementation of the state supervision;

i) federal government civil servants of category "specialists" of the leading and senior groups of positions of territorial authorities of Service whose official regulations provide powers on implementation of the state supervision.

5. The state supervision exercised according to the procedure, provided by this Provision, includes:

a) systematic observation of execution by legal entities (separate divisions of legal entities), their heads and other officials (further - the checked faces) the requirements established by international treaties of the Russian Federation, the Federal Laws and other regulatory legal acts of the Russian Federation in the field of use of atomic energy (further - mandatory requirements), behind observance of conditions of action of permissions (licenses) for the right of conducting works by them in the field of use of atomic energy (further - conditions of action of licenses), and also the analysis and forecasting of condition of execution of mandatory requirements and conditions of action of licenses when implementing by the checked faces of activities in the field of use of atomic energy;

b) the organization and conducting checks (inspections) of execution by the checked faces of mandatory requirements, observance of conditions of action of licenses by them, and also accomplishment of instructions of Federal Service for Environmental, Technological and Nuclear Supervision;

c) acceptance in cases of identification of violations of mandatory requirements and conditions of action of licenses of measures for their suppression, stipulated by the legislation the Russian Federation.

6. On separate subjects to use of atomic energy which list affirms the Government of the Russian Federation the Federal Service for Environmental, Technological and Nuclear Supervision performs the mode of constant state surveillance according to the procedure, established by the Government of the Russian Federation.

7. Systematic observation of execution by the checked faces of mandatory requirements, observance of conditions of action of licenses by them, the analysis and forecasting of condition of execution of mandatory requirements and observance of conditions of action of licenses are performed by Federal Service for Environmental, Technological and Nuclear Supervision based on results of the performed by it and other actions connected with implementation of the state control, and also the data represented by the checked faces according to the procedure, established in accordance with the legislation of the Russian Federation in the field of use of atomic energy, containing information:

a) about observance of conditions of action of licenses;

b) about the events influencing safety when using atomic energy and about their consequences;

c) about availability and movement of nuclear materials, radioactive materials and radioactive waste, and also about their export and import;

d) about discrepancy to requirements of federal regulations and the rules of use of atomic energy made and applied on subjects to use of atomic energy of the equipment, important for safety;

e) about results of investigation of violations on subjects to use of atomic energy;

e) about security status of nuclear installations, radiation sources and Items of storage;

g) about the availability of new data or changes in the data provided at stage of receipt of permission (license) for the right of conducting works in the field of use of atomic energy and concerning safety of the licensed types of activity.

8. On analysis results of the data received from the checked faces, the Federal Service for Environmental, Technological and Nuclear Supervision performs:
