About implementation of the investment project

(Extraction)

For the purpose of further development of biopharmaceutical industry of the Republic of Belarus:

1. Realize in 2025-2030 the investment project on creation of modern import-substituting production of veterinary and medical medicines (further – the investment project) including construction new and reconstruction of the existing production capacities, construction of facilities of the housing estate, engineering and transport infrastructure (further – objects).

2. Determine that for implementation of the investment project:

2.1. for office use;

2.2. JSC Belvitunifarm provides voluntary conveyance till October 1, 2025:

property complex of the Dolzhaagro unitary enterprise in property of Lioznensky district;

real estate (appendix 2), other fixed assets used for functioning of fish nursery Bogushevsky in property of Sennensky district and economic maintaining the state company "sovkhoz of Masherov";

real estate (appendix 3), other fixed assets used for functioning of recreation facility of Krupenino in property of Vitebsk and economic maintaining the state company "LUChYoSA Tourist Hotel Complex";

the isolated room (accession number 200/D-193840), at the address: The Vitebsk region, Vitebsk, Ulitsa 1-ya Zhurzhevskaya, 19G-1, the name – Item of public catering, in property of Vitebsk and economic maintaining the state Company "Center of the Real Estate of Vitebsk";

2.3. JSC Belvitunifarm has the right in case of disposal in 2025 of the real estate objects specified in subitem 2.2 of this Item to carry their cost for date of transfer at the expense of the added capital formed as a result of revaluation of fixed assets within its remaining balance and retained earnings (uncovered loss) in the remained amount;

2.4. voluntary conveyance of the real estate objects specified in subitem 2.2 of this Item is performed on actual state, including without availability of technical data sheets, and also documents certifying state registration of creation of such objects;

2.5. the parcels of land necessary for construction and servicing of objects (further – the parcels of land), are provided to interested persons in temporary, permanent use or in lease without:

holding the auction and collection of payment for the right of their lease;

inclusions in the list of the free (unoccupied) parcels of land;

compensations of the losses of agricultural production connected with construction of underground linear constructions;

2.6. registration of materials on withdrawal of the parcels of land can be performed along with performance of works on designing and construction of facilities in the presence of the project documentation and the act of the choice of the location of the parcel of land (in cases if preliminary approval of the location of the parcel of land is required).

3. Exempt during implementation of the investment project from taxation by import customs duties (taking into account the international obligations of the Republic of Belarus) and the value added tax the processing equipment, component parts and spare parts to it (further – goods) imported on the territory of the Republic of Belarus for exclusive use for the purpose of implementation of the investment project.

The basis for release of goods from taxation is determined by import customs duties and the value added tax in appendix 4.

4. The goods imported on the territory of the Republic of Belarus within implementation of the investment project "Production organization of vaccines on the areas of JSC Belvitunifarm and exempted from taxation by import customs duties (taking into account the international obligations of the Republic of Belarus) and the value added tax according to Item 5 of the Presidential decree of the Republic of Belarus of November 3, 2021 No. 430 "About implementation of the investment project", are recognized imported within implementation of the investment project.

5. For the purpose of implementation of the investment project to grant to the Vitebsk regional executive committee the right to perform the powers provided in subitem 1.1 of Item 1 of the Presidential decree of the Republic of Belarus of July 2, 2025 No. 266 "About provision of powers in the field of construction" without approval of Council of Ministers of the Republic of Belarus.

Alienation by the buyer of the shares acquired according to this Decree, the order by them otherwise before full implementation of obligations is forbidden.

6. Determine that within two years after completion of implementation of the investment project acquisition at JSC Belvitunifarm of the veterinary and medical medicines having the self-produced certificate can be performed using procurement procedure from one source.

7. Declare invalid the Presidential decree of the Republic of Belarus of November 3, 2021 No. 430.

8. To provide to the Ministry of Health till January 1, 2026 leasing of JSC Belvitunifarm of real estate, other fixed assets which are in property of the Republic of Belarus and economic maintaining RUP of Belmedpreparata located in the item of Beshenkovichi of the Vitebsk region.

9. To the Vitebsk regional executive committee:

9.1. inform the State Customs Committee and the Ministry of Taxes and Tax Collection on end date of implementation of the investment project;

9.2. to provide in the purchase and sale agreement of shares including:

possibility of payment of share value by installments within year monthly equal shares with indexation of payments using the consumer price indexes published by National Statistical Committee or payment due date of the share value performed without provision of payment by installments;

obligations and mechanism of control of their accomplishment by the buyer;

unilateral refusal of the Vitebsk regional executive committee from agreement performance of purchase and sale of shares (without compensation of the expenses incurred by the buyer) with return of shares to property of the Vitebsk region on a grant basis in case of non-execution or execution with delay more than three months the buyer of obligation on share value payment;

responsibility of the buyer for non-execution or untimely execution (with delay no more than three months) obligations on share value payment, and also any of obligations in penalty payment type in the budget of the Vitebsk region in the amount of share value.

10. To confer the personal responsibility for accomplishment of this Decree on the chairman of the Vitebsk regional executive committee, the CEO of JSC Belvitunifarm and the director of the buyer.

11. To impose control over the implementation of this Decree on the State Control Committee.

12. This Decree becomes effective after its signing.
