Based on part (4) article 22 of the Law No. 221/2007 on veterinary and sanitary activities (repeated publication: The official monitor of the Republic of Moldova, 2021, Art. No. 13-20, 10), with subsequent changes, DECIDES: the Government

1. Approve Veterinary sanitary standard about protection and wellbeing of animals during transportation it (is applied).

2. To impose control of execution of this resolution on the National agency on safety of foodstuff.

3. Declare invalid the Order of the Government No. 793/2012 about approval of Veterinary sanitary standard about protection and wellbeing of animals during transportation (The official monitor of the Republic of Moldova, 2012, Art. No. 222-227, 855), with subsequent changes.

Veterinary sanitary standard about protection and wellbeing of animals during transportation

The veterinary sanitary standard about protection and wellbeing of animals during transportation shifts:

- Regulations (EU) No. 1/2005 of December 22, 2004 about protection of animals during transportation and the related transactions about amending Directives 64/432/EEC and 93/119/EC and Regulations (EU) No. 1255/97 (CELEX: 32005R0001), the European Union published in the Official magazine L 003 of January 5, 2005, with the subsequent changes made by Regulations (EU) 2017/625 of the European parliament and Council of March 15, 2017;

- Regulations (EU) No. 1255/97 of Council of June 25, 1997 about criteria of community, the expectations and changes of itinerary provided in appendix to the Directive 91/628/EEC established concerning Items (CELEX: 31997R1255), published in the Official magazine of the European Union by L 174 of July 2, 1997, with the subsequent changes made by Regulations (EU) No. 1/2005 of Council of December 22, 2004;

- The delegated regulations (EU) 2023/842 of the Commission of February 17, 2023 supplementing Regulations (EU) 2017/625 of the European parliament and Council concerning rules of carrying out official control for check of observance of requirements of wellbeing of animals in transit with the courts intended for transportation of live animals (CELEX: 32023R0842), published in the Official magazine of the European Union by L 109 of April 24, 2023.

Chapter I. General provisions

1. For the purpose of use of this Veterinary sanitary standard about protection and wellbeing of animals during transportation (further - the Regulation) the concepts stated in Veterinary sanitary standard about requirements to health and certification of animals in case of the trade (import and export) in cattle and pigs approved by the Order of the Government No. 913/2018 and Veterinary sanitary standard on the protection of animals during killing approved by the Order of the Government No. 369/2015 are applied.

2. The this Regulation is applied to transportation of live vertebrate animals for the purpose of protection of animals against sufferings during transportation and ensuring trade in live animals in situations when high standards of wellbeing of animals, including the special control exercised concerning the freights imported on customs area or exported from it are observed and also:

2.1. for the transportation of animals performed by the farmers using farm vehicles or own transport in cases when geographical conditions require transportation of separate categories of animals for seasonal distant-pasture livestock production;

2.2. for transportation by farmers of own animals by the vehicles on distance less than 50 kilometers from their object.

3. The this Regulation does not extend on:

3.1. the transportations performed by farmers on very short distances, for example, between pastures or between various places on farm;

3.2. transportations of pets to or from the veterinarian, or the transportations which are not connected with economic activity;

3.3. the transportations of pets regulated by other, less strict rules, than those which are applied to farm animals;

3.4. for scientific research, special requirements or transportation of animals can have certain modes of transport, such as transportation of animals it is direct in veterinary offices or clinics, according to the recommendation of the veterinarian.

4. For the purpose of this Regulation the following concepts are used:

4.1. animal there are vertebrate and invertebrate animals;

4.2. competent authority - the body responsible for the organization of official control and other official activities in the agrofood sphere;

4.3. trip - all transport transaction from the place of sending to the destination including unloading, placement and loading in certain intermediate points of transportation;

4.4. long trip - the transportation exceeding eight hours since the moment of movement of the first animal from batch;

4.5. the centers of collection - the place such as farms, collection points and markets where domestic horses or pets of cattle, sheep, goats or pigs coming from various farms are grouped together with the parties creation purpose;

4.6. container - any kind of box, box, container or other rigid construction used for transportation of animals and not being the vehicle;

4.7. the owner - physical person or legal entity, except for carrier which bears responsibility for animals or is responsible for the treatment of animals, constantly or temporarily;

4.8. feral horses are horses whom it is impossible to connect or put on halter without having caused them unnecessary nervousness, pain or suffering;

4.9. inspection of the state port control - the inspection which is carried out by bodies of the state port control;

4.10. the attendant - person who is directly responsible for wellbeing of animals which accompanies them during trip;

4.11. the destination - the emptying point of animal from the vehicle and content at least 48 hours before sending or slaughter;

4.12. the vehicle - automobile or rail vehicles, sea or the aircrafts used for transportation of animals;

4.13. the official veterinarian - the veterinarian appointed by competent authority, having either the status of the worker, or other quality having the corresponding qualification for implementation of official control and other official activities;

4.14. the vessel for live animals - the vessel used or for transportation of pets of type horse or pets of cattle, sheep, goats or pigs, except the vessel transporting animals in mobile containers;

4.15. organizer:

4.15.1. carrier which signed the subagreement at least, with one carrier on part of transportation; or
