1. Approve Veterinarno-sanitary standard about protection and wellbeing of animals during transportation it (is applied).

2. This resolution becomes effective in 6 months from the date of publication in the Official monitor of the Republic of Moldova.

3. To impose control of execution of this resolution on the National agency on safety of foodstuff.

Veterinarno-sanitary standard about protection and wellbeing of animals during transportation

Chapter I General provisions

Scope

1. The Veterinarno-sanitary standard about protection and wellbeing of animals during transportation (further - the Regulation) is partial transposition of Regulations (EU) 1/2005 Councils of December 22, 2004 about protection of animals during transportation and the related transactions about amending Directives 64/432 EEC and 93/119CE and Regulations (EU) No. 1255/97, of the European Union published in the Official magazine the L No. 3 of January 5, 2005, and is applied to transportation of live vertebrate animals.

2. The this Regulation is applied without prejudice to the veterinary and sanitary legislation.

3. The Item 2 this Regulations is not applied:

a) for the transportation of animals performed by the farmers using farm vehicles or own transport in cases when geographical conditions require transportation of certain categories of animals for seasonal distant-pasture livestock production;

b) for the transportation of own animals performed by farmers, the vehicles on distance less than 50 km from their object.

4. The this Regulation does not extend to transportation of the animals who are not connected with economic activity, and transportation of animals is direct to or from veterinary offices or clinics.

5. The determinations used in this Regulation have the following values:

competent veterinary and sanitary authority - the Agency of veterinary sanitation and safety of animal products, territorial subdivisions of the Agency;

container - any box, the box, reservoir or other design of tough structure used for transportation of animals, and which is not the vehicle;

long transportation - the transportation exceeding 8 hours since the moment of movement of the first animal from this batch;

navigation systems - the satellite infrastructures providing services in timekeeping and the continuous, exact and guaranteed global positioning, or any technologies providing the services equated to requirements of this Regulation;

the organizer - carrier which had the subagreement, at least, with one carrier on part of transportation or the physical person or legal entity which signed the transportation agreement with several carriers or person who signed Section 1 of the traveling magazine provided in appendix No. 2;

the place of sending - the place where animals the first time are loaded on the vehicle provided that they were placed in the appropriate place at least 48 hours before sending;

the destination - the place where animals are unloaded from the vehicle and at least 48 hours before their sending contain or are exposed to slaughter;

the vacation spot or changes - any stop throughout transportation which is not destination including the place where animals change the vehicle with or without unloading;

the vessel roll-on-roll-off - the vessel which is equipped with necessary means for loading and unloading from automobile or rail vehicles;

transportation - the movement of animals performed by one or several types of vehicles and the related transactions, including loading, unloading, change and rest, before the end of unloading of animals in the destination;

feral horses are horses whom it is impossible to connect or put on halter without to causing in them excitement, pain and unnecessary suffering;

the vehicle - the means for transport supplied with wheels self-propelled or on trail car;

animals are live vertebrate animals.

Chapter II General terms of transportation and transportation documentation

General terms for transportation of animals

6. Animals cannot be transported or charged their transportation to somebody provided that it can lead to injury or unnecessary sufferings. For transportation of animals the following conditions shall be complied:

a) all measures shall be taken beforehand for reducing in-transit time and requirements satisfaction of animals during transportation (providing with the vehicles having veterinary and sanitary authorization, accompanying documents and traffic route; in case of long transportations the necessary amount of water and fodder according to the technical regulations provided in appendix No. 1 to this Regulation shall be provided);

b) animals shall be in good shape for transportation;

c) vehicles shall be designed, designed, be serviced and be operated so that to avoid injuries and sufferings of animals, and to ensure their safety;
