About approval of the Instruction about procedure for state registration of acts of civil status in the Kyrgyz Republic

For the purpose of optimization of the services provided by bodies of civil registration according to part 3 of article 41 of the Law of the Kyrgyz Republic "About acts of civil status", articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:

1. Approve the Instruction about procedure for state registration of acts of civil status in the Kyrgyz Republic according to appendix.

2. To the ministry of digital development and innovative technologies of the Kyrgyz Republic, the Ministry of Foreign Affairs of the Kyrgyz Republic and Administration of the President of the Kyrgyz Republic (in coordination) to take the necessary measures following from this resolution.

3. Recognize invalid:

1) the order of the Government of the Kyrgyz Republic "About approval of the Instruction about procedure for state registration of acts of civil status in the Kyrgyz Republic" of March 11, 2021 No. 90;

2) Item 7 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic for the purpose of implementation of use of digital documents in the territory of the Kyrgyz Republic" of November 18, 2022 No. 637;

3) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some decisions of the Government of the Kyrgyz Republic in the sphere of registration of the population" of November 21, 2022 No. 649;

4) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some orders of the Government of the Kyrgyz Republic in the sphere of registration of the population" of March 15, 2023 No. 143;

5) Item 5 of the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some orders of the Government of the Kyrgyz Republic and the Cabinet of Ministers of the Kyrgyz Republic concerning implementation and use of digital documents in the sphere of registration of the population in the territory of the Kyrgyz Republic" of June 29, 2023 No. 329;

6) the resolution of the Cabinet of Ministers of the Kyrgyz Republic "About modification of some orders of the Government of the Kyrgyz Republic in the sphere of registration of the population" of April 30, 2024 No. 213.

4. This resolution becomes effective after four months from the date of official publication.

The instruction about procedure for state registration of acts of civil status in the Kyrgyz Republic

Chapter 1. General provisions

1. State registration of acts of civil status is made by bodies of civil registration.

2. The following acts of civil status are subject to state registration of acts of civil status:

1) birth;

2) marriage;

3) annulment of marriage;

4) change of surname, name, middle name;

5) death.

3. Bodies of civil registration are:

1) authorized state body in the sphere of civil registration;

2) diplomatic representations and consular establishments of the Kyrgyz Republic.

Powers on state registration of acts of civil status with the restrictions set by the legislation of the Kyrgyz Republic in the sphere of civil registration of the Kyrgyz Republic can be delegated to local government bodies (ayyl to okmot).

4. Bodies of civil registration perform:

1) state registration of acts of civil status;

2) issue of repeated certificates on state registration of acts of civil status, statements from acts of civil status, and also references and notices on availability and/or lack of civil registrations by all types of civil registrations (at the request of the applicant);

3) modification, corrections in civil registration;

4) recovery or cancellation of civil registrations.

5. The state registration of acts of civil status given based on the statement in electronic form by means of the State portal of electronic services (further - GPEU "Tunduk") and/or the Tunduk mobile application, is performed by authorized state body in the sphere of civil registration.

6. State registration of acts of civil status is made once in the place of the address of applicants or in the place of receipt of the electronic statement by creation of record of the act of civil status in the automated information system of civil registrations (further - AIS "ZAGS") in electronic form.

7. In the presence of possibility of receipt of necessary data from system of interdepartmental electronic interaction Tunduk (further - SMEV "Tunduk") reclamation of documents in paper or electronic type from the applicant is not performed.

8. If all necessary data are available in the unified state register of the population (further - EGRN), record of the act of civil status in AIS "ZAGS" is created automatically.

9. In case of confirmation of record of the act of civil status in AIS "ZAGS" the certificate on state registration of the act of civil status in digital format is automatically created.

10. The certificate on state registration of the act of civil status is on paper granted at the request of the applicant, on the certificate the QR code allowing to establish authenticity of the certificate is put down, and also the certificate is sealed official and by the signature of the employee of body of civil registration in case of need of its further apostilization or legalization.

11. The procedure for state registration of acts of civil status for persons concerning whom security measures are performed stipulated by the legislation the Kyrgyz Republic in the sphere of protection of the rights of participants of criminal trial, is determined by the Cabinet of Ministers of the Kyrgyz Republic.

12. Statements for state registration of acts of civil status, introduction of corrections and changes in civil registration, issue of repeated certificates, statements, references, notices, recovery, cancellation of civil registrations are created in AIS "ZAGS" in electronic form, signed by applicants by means of the digital signature or the device for receipt of the digital signature and stored in AIS "ZAGS" in electronic form, except the separate notarized applications submitted according to this Instruction.

13. Identification of the citizen of the Kyrgyz Republic is performed on the basis:

1) the personal data containing in EGRN and graphical representation of person;

2) checks on compliance of its surname, name, middle name and on availability of biometric data in EGRN.

14. Identification of the foreign citizen, stateless person or refugee is made by visual checking of their person with the photo in the document proving their identity and implementation of control photography.

15. All applications submitted online are created by means of GPEU "Tunduk" and/or the Tunduk mobile application and signed by the digital signature of the applicant.
