1. Approve the enclosed Rules of import, registration, realization and application of GSM locks (this - boxes).

2. To provide to committee of telecommunications of the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of artificial intelligence and digital development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. To impose control of execution of this order on the supervising vice-minister of artificial intelligence and digital development of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of import, registration, realization and application of GSM locks (this - boxes)

Chapter 1. General provisions

1. These rules of import, registration, realization and application of GSM locks (this - boxes) (further - Rules) are developed according to subitem 19-24) of Item 1 of article 8 of the Law of the Republic of Kazakhstan "About communication" (further - the Law) and determine procedure for import, registration, realization and application of GSM locks (this - boxes).

2. In these rules the following concepts are used:

1) the telecom operator - the physical person or legal entity registered in the territory of the Republic of Kazakhstan, rendering communication services and (or) operating communication networks;

2) the database of Association of global system of mobile communication (GSMA) - the international information resource intended for unambiguous identification of the producer and model of the subscriber device on its identification code, containing including, data on the blocked mobile devices included in the black list of GSMA at the international level;

3) the register of GSM locks (this - boxes) to which provision of services of cellular communication (further - the white list) - the list of GSM locks is authorized (this - boxes), data on which are successfully verified and included in the database of identification codes of subscriber devices of cellular communication according to Rules of registration of subscriber devices of cellular communication, information approved by the order of the acting minister and communications of the Republic of Kazakhstan of May 23, 2018 No. 226 (it is registered in the Register of state registration of regulatory legal acts for No. 17028) (further - Rules BDIK);

4) the register of GSM locks (this - boxes) to which provision of services of cellular communication is forbidden (further - the black list) - the list of the GSM locks (this - boxes) which are not included in the database of identification codes of subscriber devices of cellular communication on the following bases:

the identification code of GSM lock (this - boxing) is blacklisted databases of Association of global system of mobile communication (GSMA);

the identification code of GSM lock (this - boxing) is incorrect or changed;

the GSM lock (this - boxing) has no identification code assigned by manufacturing plant;

5) the register of GSM locks (this - boxes) which limits provision of services of cellular communication (further - the gray list) - the list of the GSM locks (this - boxes) which are not entered in white and black lists which are temporarily included in the database of identification codes of subscriber devices of cellular communication according to Rules BDIK;

6) mobile operator - the telecom operator providing services of cellular communication according to the legislation of the Republic of Kazakhstan;

7) GSM locks (this - boxes) - the devices allowing to transfer telephone traffic from networks of telecommunications public and VOIP networks directly to networks of cellular communication of the GSM standard and back;

8) automatic system of servicing of GSM locks (this - boxes) - the complex system of servicing giving to the owner opportunity of independent registration of the device by the USSD request or through the Personal account, or by use of other technical capabilities by mobile operator according to Rules BDIK;

9) the database of identification codes of GSM locks (this - boxes) (further - the database) - the hardware and software of management of the database, according to Rules BDIK, containing data about:

individual identification numbers (further - IIN) (for physical persons) or business and identification numbers (further - the BIN) (for legal entities) owners of GSM locks (this - boxes);

identification codes of GSM locks (this - boxes);

10) the Database operator of GSM locks (this - boxes) (further - the Database operator) - the legal entity determined according to the Law who provides forming functioning, maintaining, maintenance and development of the database of identification codes of GSM locks (this - boxes) and provides access to these resources according to Rules BDIK.

At the same time mobile operators independently incur all costs on upgrade of network, information systems and the software, and also perform fee of the Database operator for provision of access to database resources according to Rules BDIK;

11) identification code of GSM lock (this - boxing) - the code assigned by manufacturing plant for the communication device which is transferred to network of mobile operator in case of connection to it of this device;

12) verification of GSM lock (this - boxing) (further - verification) - verification of data on GSM lock (this - boxing).
