1. Approve the enclosed Rules of establishment of restrictions and prohibitions on use of fish resources and other water animals, their parts and derivatives.

2. To provide to committee of fishery of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

3. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of establishment of restrictions and prohibitions on use of fish resources and other water animals, their parts and derivatives

Chapter 1. General provisions

1. These rules of establishment of restrictions and prohibitions on use of fish resources and other water animals, their parts and derivatives are developed according to the subitem 22) of article 9-1 of the Law of the Republic of Kazakhstan "About protection, reproduction and use of fauna" (further - the Law) and determine procedure for establishment of restrictions and prohibitions on use of fish resources and other water animals, their parts and derivatives (further - restrictions and prohibitions).

2. Restrictions and prohibitions are established for the purpose of preserving and reproduction of fish resources and other water animals.

3. In these rules the following concepts are used:

1) authorized body in the field of fishery (further - authorized body) - the central executive body performing management in the field of protection, reproduction and use of fish resources and other water animals and also within the powers cross-industry coordination;

2) biological reasons - the evidence-based conclusion on use of fauna, determination of admissible amount of withdrawal of objects of fauna, and also on the activities capable to affect objects of fauna and the circle of their dwelling.

4. Restrictions and prohibitions are established on the bases specified in Item 2 of article 14 of the Law.

5. Restrictions and prohibitions are established:

1) in places of use: in all territory of the Republic of Kazakhstan, at the interregional, basin level, in borders of separate administrative and territorial units or their parts, and also on fishery reservoirs and (or) sites;

2) on use terms: on permanent basis (without specifying of effective periods), for certain term, or with transfer of earlier fixed terms;

3) on application of methods, methods and types of tools of fishing of fish resources and other water animals, their parts and derivatives;

4) by types of fish resources and other water animals (in need of change of regulations of withdrawal of objects of fish resources and other water animals);

5) by the number of users objects of fish resources and other water animals, their parts and derivatives;

6) on fight measures with the illegal, not reported, unregulated fishing, and also illicit trafficking in products made of water biological resources.

Chapter 2. Procedure for establishment of restrictions and prohibitions on use of fish resources and other water animals, their parts and derivatives

6. Restrictions and ban are imposed taking into account geographical and climatic features of areas (the fields of distribution) of dwelling of fishes and other water animals.

7. Department of authorized body signs the contract with accredited subjects of scientific and (or) scientific and technical activities and, having the certificate of accreditation with the respective area of accreditation according to the procedure, No. 335 determined by the order of the Minister of science and the higher education of the Republic of Kazakhstan of July 25, 2023 "About approval of the rules "Accreditations of Subjects of Scientific and (or) Scientific and Technical Activities" (it is registered in the Register of state registration regulatory legal acts at No. 33182) for carrying out monitoring of objects of fauna, their habitat and accomplishment of scientific research.

8. Scientific research in the field of protection, reproduction and use of fish resources and other water animals, their parts and derivatives is performed annually at the expense of the budgetary funds and other sources which are not prohibited by the legislation of the Republic of Kazakhstan on reserve reservoirs of local value and reservoirs of the international and republican value.

9. Results of the conducted researches in the form of biological reasons are reported to department of authorized body no later than the end of calendar year.

10. Department of authorized body in currents of 30 (thirty) calendar days considers biological reasons for the scientific organizations.

11. In the presence of the bases, stipulated in Item 2 articles 14 of the Law, and based on biological reasons, the authorized body makes the decision on introduction of restrictions and prohibitions on use of fish resources and other water animals, their parts and derivatives, establishes places and terms of their use according to the subitem 28) of article 9-1 of the Law.
