1. Approve the enclosed Rules of accreditation of subjects of scientific and (or) scientific and technical activities.

2. To provide to committee of science of the Ministry of science and the higher education of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on the Internet resource of the Ministry of science and the higher education of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Legal department of the Ministry of science and the higher education of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

4. To impose control of execution of this order on the supervising vice-minister of science and the higher education of the Republic of Kazakhstan.

5. This order becomes effective after ten calendar days after day of its first official publication.

Rules of accreditation of subjects of scientific and (or) scientific and technical activities

Chapter 1. General provisions

1. These rules of accreditation of subjects of scientific and (or) scientific and technical activities (further - Rules) are developed according to Item 112 of the order of the Government of the Republic of Kazakhstan of August 19, 2022 No. 580 "About some questions of the Ministry of science and the higher education of the Republic of Kazakhstan" and determine procedure for carrying out accreditation of subjects of scientific and (or) scientific and technical activities, submission of documents for carrying out accreditation (further - accreditation), their considerations and issue of certificates on accreditation by authorized body in the field of science (further - authorized body).

2. In these rules the following concepts are used:

1) the certificate on accreditation - the document confirming official recognition by authorized body of the scientific, scientific and technical activities, for form performed by the physical or legal entity according to appendix to these rules;

2) accreditation - the procedure as a result of which the legal entities and physical persons which are subjects acquire official recognition of compliance of their activities to the requirements and standards established by the legislation of the Republic of Kazakhstan;

3) authorized body in the field of science (further - authorized body) - the state body performing cross-industry coordination and management in the field of science and scientific and technical activities.

Chapter 2. Procedure for carrying out accreditation

According to Item 1 of article 6 of the Law of the Republic of Kazakhstan "About science" (further - the Law) subjects of scientific and (or) scientific and technical activities are the physical persons and legal entities (further - subjects) performing scientific and (or) scientific and technical activities.

Subjects are:

1) legal entities - the organizations performing scientific and (or) scientific and technical activities;

2) the physical persons performing scientific and (or) scientific and technical activities - scientific, technical and other workers, and also the scientists who are independently performing scientific and (or) scientific and technical activities.

4. Accreditation is performed authorized body, in paper form through office, or through non-commercial joint-stock company "The Government for Citizens state corporation (further - the State corporation).

5. The organizations for which scientific and technical activities are not core activity the scientific divisions having in the structure, for the purpose of the solution of the tasks enshrined in their constituent documents can undergo accreditation in authorized body for the purpose of receipt of the certificate on accreditation.

6. Accreditation of subjects is performed at the expense of their own means.

7. The certificate is provided for participation in tenders of scientific, scientific and technical projects and programs, projects of commercialization of the results of scientific and (or) scientific and technical activities financed from the government budget and other sources which are not prohibited by the legislation of the Republic of Kazakhstan.

8. The list of the submitted documents, the bases for refusal in rendering accreditation are established in the List of the main requirements to rendering the state service "Accreditation of Subjects of Scientific and (or) Scientific and Technical Activities" (further - the List of the main requirements) approved by the order of the Minister of Education and Science of the Republic of Kazakhstan of May 12, 2020 No. 196 "About approval of Rules of rendering the state service "Accreditation of Subjects of Scientific and (or) Scientific and Technical Activities" (it is registered in the Register of state registration of regulatory legal acts at No. 20626).

9. The authorized body makes the decision on accreditation of subjects or refusal in accreditation:

for legal entities - within 19 (nineteen) working days;

for physical persons - within 5 (five) working days.

Renewal of the certificate on accreditation in case of change of surname, name, middle name of physical person and (or) the name of the legal entity:

for physical persons - within 10 (ten) working days;

for legal entities - within 20 (twenty) working days.

10. The certificate on accreditation is granted for a period of 5 (five) years.

11. The certificate on accreditation is granted:

to the legal entity - the head or the authorized person under list based on the power of attorney;

to physical person - directly to the applicant or the authorized person under notarially attested power of attorney or his representative whose powers are drawn up according to Article 68 of the Administrative procedural Procedure Code of the Republic of Kazakhstan.

12. The authorized body provides production, accounting and storage of forms of certificates on accreditation.
