1. Approve the enclosed Rules of actions of officials of bodies of state revenues in case of stop of automotive vehicles.

2. To provide to committee of state revenues of the Ministry of Finance of the Republic of Kazakhstan in the procedure established by the legislation of the Republic of Kazakhstan:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on Internet resource of the Ministry of Finance of the Republic of Kazakhstan after its official publication;

3) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of Finance of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1) and 2) of this Item.

3. This order becomes effective after ten calendar days after day of its first official publication.

Rules of actions of officials of bodies of state revenues in case of stop of automotive vehicles

Chapter 1. General provisions

1. These rules of actions of officials of bodies of state revenues in case of stop of automotive vehicles (further - Rules) are developed according to Item 8 of article 18-1 of the Code of the Republic of Kazakhstan "About customs regulation in the Republic of Kazakhstan" (further - the Code) and determine operations procedure of officials of bodies of the state revenues included in structure of mobile group (further - the official), in case of stop of automotive vehicles.

2. In these rules the following basic concepts are used:

1) stop of the automotive vehicle - the deliberate termination of movement of the automotive vehicle including which is not performing international carriages of goods out of the customs control zone, for carrying out customs control for the purpose of check of observance of international treaties of the Republic of Kazakhstan, the customs legislation of the Eurasian Economic Union (further - EEU), customs and other legislation of the Republic of Kazakhstan;

2) mobile group - the exit group of officials consisting of two and more officials authorized to provide observance of international treaties of the Republic of Kazakhstan, the customs legislation of EEU, customs and other legislation of the Republic of Kazakhstan, in zones and out of customs control zones.

3. Officials perform stop of the automotive vehicle with observance of the traffic regulations approved by the order of the Minister of Internal Affairs of the Republic of Kazakhstan of June 30, 2023 No. 534 "About approval of Traffic regulations, Basic provisions according to the admission of vehicles to operation, the list of field and special services which transport is subject to the equipment special light and sound signals and coloring according to special tsvetografichesky schemes" (it is registered in the Register of regulatory legal acts at No. 33003), and also according to the procedure, provided by articles 18 and 18-1 of the Code and these rules.

Chapter 2. Operations procedure of officials of bodies of state revenues in case of stop of automotive vehicles

4. In case of stop of the automotive vehicle the official performs the following actions:

1) is included breast by the video recorder (video counter);

2) gives signal by means of the loud-speaking device or gesture of hand or staff in the direction of the automotive vehicle with simultaneous signal of whistle, clear to person managing the automotive vehicle including which is not performing international carriages of goods (further - the driver);

3) after stop of the automotive vehicle approaches the automotive vehicle, it is represented and upon the demand of the driver shows the official ID or the ID card for acquaintance;

4) is explained by the basis of stop of the automotive vehicle and hands to the driver according to Item 1 of article 18-1 of the Code the requirement about stop of the automotive vehicle, and also notifies in oral form of use of the video recorder (video counter).

5. Within check of the automotive vehicle by the official during the period which is not exceeding 2 (two) hours from the moment of stop of the automotive vehicle it is performed:

1) reconciliation of the state number of the automotive vehicle, identification number (VIN) of the automotive vehicle with the data specified in the registration document the automotive vehicle;

2) customs examination and (or) customs examination of the automotive vehicle and the goods which are in it according to articles 412 and 413 of the Code, and also the order of the Minister of Finance of the Republic of Kazakhstan of February 14, 2018 No. 188 "About approval of Rules of carrying out customs examination and survey" (it is registered in the Register of state registration of regulatory legal acts at No. 16464) (further - the Order No. 188);
