1. Approve the enclosed Traffic rules of water transport during the spawning period, forbidden for fishery, and also in reservoirs and (or) sites, forbidden for fishery, according to appendix 1 to this order.

2. Recognize invalid some orders according to the list according to appendix 2 to this order.

3. To provide to committee of fishery of the Ministry of Agriculture of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) placement of this order on official Internet resource of the Ministry of Agriculture of the Republic of Kazakhstan after its official publication.

4. To impose control of execution of this order on the supervising vice-Minister of Agriculture of the Republic of Kazakhstan.

5. This order becomes effective after sixty calendar days after day of its first official publication.

Traffic rules of water transport during the spawning period, forbidden for fishery, and also in reservoirs and (or) sites, forbidden for fishery

Chapter 1. General provisions

1. These rules of water traffic during the spawning period, forbidden for fishery, and also in reservoirs and (or) sites, forbidden for fishery (further – Rules) are developed according to the subitem 13) of article 9-1 of the Law of the Republic of Kazakhstan "About protection, reproduction and use of fauna", the subitem 4) of Item 1 of article 12 of the Law of the Republic of Kazakhstan "About permissions and notifications" and the subitem 1) of article 10 of the Law of the Republic of Kazakhstan "About the state services" (further – the Law on the state services) and determine procedure for water traffic during the spawning period, forbidden for fishery, and also in reservoirs and (or) sites, forbidden for fishery, and also procedure for rendering the state service "Approval of the Mode of Navigation during the Spawning Period, Forbidden for Fishery, and also in Reservoirs and (or) Sites, Forbidden for Fishery" (further – the state service).

2. Action of these rules extends to all fishery reservoirs, except for stores of drain waters, and also reservoirs used in the fish nurseries, spawning and growing, pond and lake and commodity farms used for cultivation of fishes and other water animals.

3. In these rules the following basic concepts are used:

1) authorized body in the field of fishery (further – authorized body) – the central actuator performing management in the field of protection, reproduction and use of fish resources and other water animals and also within the powers cross-industry coordination;

2) the vessel – the vessel of internal water swimming which is not the small size vessel, the self-propelled or non-self-propelled floating construction used for the purpose of navigation including the swimming vessel "river sea", the ferry boat, the vessel of the technical fleet (dredging and dnoochistitelny shells, the floating crane and other technical constructions of this sort);

3) the web portal of "the electronic government" (further – the portal) – the information system representing single window of access to all consolidated government information including the regulatory legal base, and to the state services, services in issue of technical specifications on connection to the networks of subjects of natural monopolies and services of subjects of the quasi-public sector rendered electronically;

4) the digital signature (further – the EDS) – set of electronic digital symbols created by means of the digital signature and confirming reliability of the electronic document, its accessory and invariance of content.

Chapter 2. Procedure for water traffic during the spawning period, forbidden for fishery, and also in reservoirs and (or) sites, forbidden for fishery

4. In spawning the period are not allowed:

1) movement of all types of water transport with operating engines during the period, forbidden for fishery, on fishery reservoirs and (or) sites, and also in places, forbidden for fishery, without approval of territorial subdivision of department of authorized body in the field of fishery;

2) to stop to water transport within places, except for stops, forbidden for fishery, at settlements, rybopriyemny Items for buoyage and in urgent cases on fishery reservoirs and (or) sites.
