RESOLUTION OF BOARD OF THE NATIONAL BANK OF UKRAINE

About approval of the Regulations on procedure for use of technology of cloud computing and modification of the Regulations on the organization of financial accounting in banks of Ukraine

According to Articles 7, of 15, 56 Laws of Ukraine "About the National Bank of Ukraine", article 4 of the Law of Ukraine "About cloudy services", for the purpose of determination of procedure for use of technology of cloud computing by banks, suppliers of financial services, operators of payment systems, members of payment service providers, technological operators of payment services the Board of the National Bank of Ukraine decides:

1. Approve Regulations on procedure for use of the enclosed technology of cloud computing (further - the Provision).

2. The paragraph one of Item 5 of the Section I of the Regulations on the organization of the financial accounting in banks of Ukraine approved by the resolution of Board of the National Bank of Ukraine of July 04, 2018 No. 75 (with changes) to state in the following edition:

"5. The bank independently develops technologies of banking operations.".

3. Banks, the suppliers of financial services, operators of payment systems, members of payment service providers, technological operators of payment services (further - organization) using cloudy services shall within six months from the date of entry into force of provision provide to the National Bank of Ukraine information of rather current agreement about use of cloudy services signed between organization and the supplier of cloudy services (further - information on the agreement). Information on the agreement is provided by organization by method, stipulated in Item 33 Sections V of the Provision. The organization shall bring into accord with requirements of provision the current agreement about use of cloudy services within six months from the date of entry into force of the Provision.

4. To department of safety (Alexander Palamarchuk) after official publication to inform organizations information on adoption of this resolution.

5. To impose control over the implementation of this resolution on the Head of the National Bank of Ukraine Andrey Pyshny.

6. The resolution becomes effective since November 1, 2025.

Regulations on procedure for use of technology of cloud computing

I. General provisions

1. This Provision is developed according to the laws of Ukraine "About the National Bank of Ukraine", "About cloudy services" and determines procedure for use of technology of cloud computing by banks, suppliers of financial services, operators of payment systems, members of payment service providers, technological operators of payment services.

2. Terms in this Provision are used in such value:

1) chain cloudy services - cloudy services in case of which accomplishment the supplier of cloudy services involves other supplier of cloudy services (further - the partner of the supplier of cloudy services);

2) the main business processes - set of the interconnected or interacting types of activity directed to creation of certain product or service, action, transaction the tasks which are carried out by organization - the user of cloudy services, information systems (including the functions transferred on outsourcing), the organizations having direct and significant effect on goal achievement of activities - the user of cloudy services, and violation of implementation of control actions for such actions, transactions, tasks can cause essential damage to organization - the user of cloudy services and/or his clients and/or can lead to violation of requirements of the legislation of Ukraine;

3) organization - the user of cloudy services - bank, the supplier of financial services, the operator of payment systems, the member of payment service providers, the technological operator of payment services using cloudy services (services in provision of cloudy resources by means of technology of cloud computing) for accomplishment of the main business processes.

Other terms used in this Provision get on in the values determined in the Law of Ukraine "About cloudy services" both other laws of Ukraine and regulatory legal acts of the National Bank of Ukraine (further - National Bank).

3. Requirements of this provision extend to organization - the user of cloudy services.

4. The organization - the user of cloudy services shall inform National Bank on all services, the cloudy services provided to it by the supplier within the agreement signed between them, according to the requirements established by the Section V of this provision. The National Bank has the right to request from organization - the user of cloudy services information on use of cloudy services and to check conditions of provision of cloudy services for compliance to the requirements established by this Provision.

II. General principles of use of technology of cloud computing and use of cloudy services

5. Organization - the user of cloudy services by means of technology of cloud computing has the right to use the following cloudy services:

1) infrastructure as service (IaaS, in English of Infrastructure as a Service);

2) platform as service (PaaS, in English platform as service);

3) the software as service (SaaS, in English of Software as a Service);

4) safety as service (SECaaS, in English of Security as a Service);

5) other services corresponding to determination of cloud services.

6. Organization - the user of cloudy services has the right to independently choose the supplier of cloudy services.

7. Organization - the user of cloudy services has the right to use cloudy services by the following methods:

1) private cloud;

2) collective cloud;

3) public cloud;

4) hybrid cloud.

8. Use of cloudy services is performed based on the agreement on cloudy services signed between organization - the user of cloudy services and the supplier of cloudy services (further - the Agreement). The agreement is signed in one of the following forms:

1) in the form of the paper document with sign manuals of the parties;

2) in electronic form with qualified digital signatures of the parties or advanced digital signatures of the parties with qualified certificates.

Requirements to the Agreement are determined in the Section IV of this provision.
