About approval of Rules of compensation of the property losses caused to subjects of small and medium entrepreneurship as a result of emergency situation of natural nature

According to subitem 141-1) of Item 15 of the Regulations on the Ministry of national economy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 24, 2014 No. 1011, I ORDER:

1. Approve the enclosed Rules of compensation of the property losses caused to subjects of small and medium entrepreneurship as a result of emergency situation of natural nature.

2. To provide to department of the state support and protection of entrepreneurship of the Ministry of national economy of the Republic of Kazakhstan in the procedure established by the legislation state registration of this order in the Ministry of Justice of the Republic of Kazakhstan and its placement on Internet resource of the Ministry of national economy of the Republic of Kazakhstan after its first official publication.

3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.

4. This order becomes effective after ten calendar days after day of its first official publication.

Rules of compensation of the property losses caused to subjects of small and medium entrepreneurship as a result of emergency situation of natural nature

Chapter 1. General provisions

1. These rules of compensation of the property losses caused to subjects of small and medium entrepreneurship as a result of emergency situation of natural nature (further – Rules) are developed according to subitem 141-1) of Item 15 of the Regulations on the Ministry of national economy of the Republic of Kazakhstan approved by the order of the Government of the Republic of Kazakhstan of September 24, 2014 No. 1011 and determine procedure for compensation of the property losses caused to subjects of small and medium entrepreneurship as a result of emergency situation of natural nature (further – Compensation of property losses).

2. Action of these rules does not extend to compensation of the property losses caused to subjects of small and medium entrepreneurship as a result of emergency situation of natural nature which are subject to compensation according to Rules of compensation of the damage caused to physical persons and legal entities as a result of emergency situation of natural nature in the field of agricultural industry, approved by the order of the Minister of Agriculture of the Republic of Kazakhstan of May 17, 2024 No. 167 (it is registered in the Register of state registration of regulatory legal acts No. 34383).

3. In these rules the following basic concepts and reducings are used:

1) the equipment – assets, set of machines, mechanisms, devices, the devices used for work or production and also their component parts, accessories, stock, vehicles, tools used for the purpose of organizational technological support of activities of the company or the organization;

2) the Commission – the commission on recognition of the owner of property injured with emergency situation of natural nature, created by the decision of the akim of the area (the city of regional value);

3) Regional commission – the collegiate organ created by local executive body, performing consideration of documents, carrying out inspections and decision making by determination of compensation amount of property losses of the subjects of small and medium entrepreneurship suffered as a result of emergency situation of natural nature.

Chapter 2. Procedure for compensation of the property losses caused to subjects of small and medium entrepreneurship as a result of emergency situation of natural nature

Compensation of property losses, is made by cost recovery of the lost property or cost of works on recovery of the damaged property, to subjects of small and medium entrepreneurship, injured with emergency situation of natural nature (further – the owner of property), except for the property insured according to the procedure, stipulated by the legislation the Republic of Kazakhstan about insurance and insurance activity, and also property, the property right or other corporeal right on which it is registered after emergence of emergency situation of natural nature.

In case of availability of insurance indemnity, provision of compensation from other sources is not made.

5. The financing source of compensation of property losses is determined by Regional commission, at the expense of budgetary funds of the local executive bodies provided on mitigation of consequences of emergency situations of natural nature according to the budget legislation of the Republic of Kazakhstan and/or at the expense of means of the organizations, voluntary contributions of citizens, funds and public associations, other sources which are not contradicting the current legislation of the Republic of Kazakhstan.
