3. To impose control of execution of this order on the supervising vice-minister of national economy of the Republic of Kazakhstan.
4. This order becomes effective since July 1, 2026 and is subject to official publication.

1. These rules of employment and termination of the employment contract with employees of the state company, application of measures of encouragement and imposing of collection on them (further - Rules) are developed according to Item 7 of article 139 of the Law of the Republic of Kazakhstan "About state-owned property" and determine procedure for employment and termination of the employment contract with employees of the state company, application of measures of encouragement and imposing of collection on them.
2. Procedure for employment and termination of the employment contract with employees of the state company, application of measures of encouragement and imposing of collection on them provided by these rules do not extend to civil servants of the state companies.
Revenues to civil service and carrying out tender to occupation of vacant position of the civil servant, except for the first head and the teacher of the state organization of education, and also the first head of the state sports organization are performed according to the procedure, No. 1017 determined by the order of the Minister of health and social development of the Republic of Kazakhstan of December 25, 2015 "About approval of Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant, except for the first head and the teacher of the state organization of education, and also the first head of the state sports organization" (it is registered in the Register of state registration of regulatory legal acts for No. 12696).
3. Tender on occupation of vacant position of the state company on the right of economic maintaining (further - competition) will be organized and carried out by the state company on the right of economic maintaining having vacant and (or) temporarily vacant position (further - the companies).
4. Employment of employees of the company is performed according to the decision of the employer according to the procedure of appointment or on tender.
5. Position assignment in the company is performed on condition of compliance of person to imposed qualification requirements to the corresponding vacant position.
6. Employment of employees of the company is performed by execution of an employment agreement and the publication of the act of the employer.
The basis for employment on tender is the positive conclusion of the contest committee (further - the commission).
For position assignment in the company the applicant submits to the company documents, stipulated in Item 1 Article 32 of the Labor code of the Republic of Kazakhstan (further - the Code).
7. The main requirements in case of selection of the candidate for position in the company are education on necessary profile, the professional training level, and also compliance to the qualification requirements imposed to employees of the company (further - qualification requirements).
8. Employment on competitive basis is performed on vacant and (or) temporarily vacant positions according to the list of positions of the employees of the company replaced on competitive basis, the determined director.
9. Deputy managers of the state company are appointed to position and dismissed by authorized body of the corresponding industry or local executive body or the office of the akim of the city of district value, the village, settlement, rural district on representation of the head of the state company.
The nomenclature of the employees of the company appointed to position by authorized body of the corresponding industry (local executive body) on representation of the head is established in the charter of the company.
10. The employee of the company for its written application is transferred to work in other state legal entity in coordination between heads of the relevant companies.
11. In case of availability in the company of vacant position, the relevant company places the announcement of carrying out tender on Internet resource the company and authorized body of the corresponding industry (local executive body) at least in 15 (fifteen) calendar days prior to date of completion of documents acceptance.
12. Participants of tender are persons who filed the documents specified in Item 19 of these rules before the end date of documents acceptance specified in the announcement.
13. Candidates for occupation of vacant position of the company (further - candidates) are the participants of tender allowed to interview based on the decision of the commission.
