ORDER OF THE MINISTER OF HEALTH AND SOCIAL DEVELOPMENT OF THE REPUBLIC OF KAZAKHSTAN

About approval of Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant, except for the first head and the teacher of the state organization of education

According to the subitem 23) Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015 PRIKAZYVAYU:

1. Approve the enclosed Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant, except for the first head and the teacher of the state organization of education.

2. To provide to department of work and social partnership of the Ministry of health and social development of the Republic of Kazakhstan in the procedure established by the legislation:

1) state registration of this order in the Ministry of Justice of the Republic of Kazakhstan;

2) within ten calendar days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan the direction on official publication in periodic printing editions and information system of law of Ad_let;

3) placement of this order on Internet resource of the Ministry of health and social development of the Republic of Kazakhstan;

4) within ten working days after state registration of this order in the Ministry of Justice of the Republic of Kazakhstan submission to Department of legal service of the Ministry of health and social development of the Republic of Kazakhstan of data on execution of the actions provided by subitems 1), 2) and 3) of this Item.

3. Declare invalid the order of the Minister of health and social development of the Republic of Kazakhstan of May 21, 2015 No. 365 "About approval of Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant" (registered in the Register of state registration of regulatory legal acts for No. 11464, published in information system of law of Ad_let of July 16, 2015).

4. To impose control of execution of this order on the vice-Minister of health and social development of the Republic of Kazakhstan Nurymbetov B. B.

5. This order becomes effective since January 1, 2016 and is subject to official publication.

Rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant, except for the first head and the teacher of the state organization of education

Chapter 1. General provisions

1. These rules of revenues to civil service and carrying out tender on occupation of vacant position of the civil servant, except for the first head and the teacher of the state organization of education (further - Rules) are developed according to the subitem 23) of Article 16 of the Labor code of the Republic of Kazakhstan of November 23, 2015 (further - the Code) and determine procedure for revenues to civil service and carrying out tender on occupation of vacant position of the civil servant, except for the first head and the teacher of the state organization of education.

2. Tender on occupation of vacant position of the civil servant (further – competition) will be organized and carried out by the public institution, the state company having vacant and (or) temporarily vacant position (further – the organization).

3. The main requirements in case of selection of the candidate for position of the civil servant are education on necessary profile, the professional training level, and also compliance to the qualification requirements imposed to civil servants (further - qualification requirements).

4. Qualification requirements to workers and complexity of certain work types are established on the basis of the Single wage rate book of works and professions of work, tariff and qualification characteristics of professions of workers, the Job evaluation catalog of positions of heads, specialists and other employees, and also standard qualification characteristics of positions of heads, specialists and other employees of the organizations according to the subitem 16) of article 16 of the Code.

Chapter 2. Revenues to civil service

5. Revenues to civil service are performed according to the decision of the employer according to the procedure of appointment or on tender.

6. Acceptance on civil service is performed by execution of an employment agreement and the publication of the act of the employer.

The basis for acceptance on civil service on tender is the positive conclusion of the contest committee (further - the commission).

For position assignment of the civil servant the applicant submits to the organization documents, stipulated in Item 1 article 32 of the Code.

6-1. Revenues to civil service on competitive basis are performed on vacant and (or) temporarily vacant positions according to the list of positions of the civil servants replaced on competitive basis, the determined head of the organization.

7. No. 345 is excluded according to the Order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of 28.08.2020

8. Position assignment of the civil servant is performed on condition of compliance of person to imposed qualification requirements to the corresponding vacant position.

9. Appointment of the head of the state company is performed by authorized body of the corresponding industry (local executive body) according to the procedure, No. 70 approved by the order of the Minister of national economy of the Republic of Kazakhstan of February 2, 2015 "About approval of Rules of appointment and certification of the head of the state company, and also coordination of its candidate" (it is registered in the Register of state registration of regulatory legal acts for No. 10379).

Deputy managers of the state company are appointed to position by authorized body of the corresponding industry (local executive body) on representation of the head of this company.

The nomenclature of the employees of the state company appointed to position by authorized body of the corresponding industry (local executive body) on representation of the head is established in the charter of the company.

10. The civil servant according to its written application is transferred to work in other public institution (the state company) in coordination between heads of the relevant organizations.

11. No. 345 is excluded according to the Order of the Minister of Labour and Social Protection of the population of the Republic of Kazakhstan of 28.08.2020
