About approval of the Procedure for creation and the organization of activities of Council for management of the special financial investment territory of "Tamchy" with particular legal regime and the status
For the purpose of implementation of article 7 of the Law of the Kyrgyz Republic "About the special financial investment territory of "Tamchy" with particular legal regime and the status", according to articles 13, of the 17th constitutional Law of the Kyrgyz Republic "About the Cabinet of Ministers of the Kyrgyz Republic" the Cabinet of Ministers of the Kyrgyz Republic decides:
1. Approve the Procedure for creation and the organization of activities of Council for management of the special financial investment territory of "Tamchy" with particular legal regime and the status (further - Council) according to appendix.
2. To render the ministries, the state committee, administrative departments, local public administrations assistance in activities of Council.
3. To impose control of execution of this resolution on management of control of execution of decisions of the President and the Presidential Administration Cabinet of Ministers of the Kyrgyz Republic.
4. This resolution becomes effective from the date of official publication.

1. This Procedure is accepted according to article 7 of the Law of the Kyrgyz Republic "About the special financial investment territory of "Tamchy" with particular legal regime and the status" (further - the Law) and determines creation bases, structure, competence, powers, and also the organization of activities of Council for management (further - Council) the special financial investment territory of "Tamchy" with particular legal regime and the status (further - SFIT "Tamchy").
2. Council is the supreme permanent collegiate organ of strategic management and control of activities of SFIT "Tamchy" providing balance of interests of the Kyrgyz Republic and the investor.
3. Council performs the activities on the principles of transparency, responsibility and observance of the best international standards of corporate management.
4. The terms and determinations used in this Procedure are applied in that value in what they are used in the Law if other is not provided by this Procedure.
5. The purpose of creation of Council is providing strategic management, coordination and control of activities of SFIT "Tamchy" for its development as the leading international financial and investment center promoting attraction of direct foreign investments, development of the financial sector and strengthening of the status of the Kyrgyz Republic as competitive and reliable jurisdiction.
6. Tasks of Council are:
1) determination, approval and monitoring of realization of strategic directions and vision of development of SFIT "Tamchy";
2) ensuring compliance of activities of SFIT "Tamchy" to international standards in the field of regulation of the financial markets, and also counteractions to money laundering and financing of terrorism (including the FATF, IOSCO standards, Basel committee);
3) creating favorable conditions for development and diversification of financial services, including banking, insurance, share activity, financial technologies, blokcheyn and virtual assets;
4) ensuring steady activities of SFIT "Tamchy", including development of necessary infrastructure, personnel potential and educational programs (by example of the best international the practician, such as DIFC Academy, and also other leaders international the practician);
5) forming and maintenance of image of SFIT "Tamchy" as safe, transparent and reliable jurisdiction for the international investors and financial institutions;
6) control of target and effective fulfillment of the approved budget of SFIT "Tamchy";
7) approval of internal regulations and procedures of Council, and also realization of other powers following from the Law, the acts "SFIT" of Tamchy and this Procedure.
7. Council is created by the decision of the Cabinet of Ministers of the Kyrgyz Republic.
8. Initial appointment of members of council is performed by the Chairman of the Cabinet of Ministers of the Kyrgyz Republic.
The chairman of the board is elected members of council from the structure by a simple majority vote.
9. The subsequent appointment to vacant positions of new members of council, prolongation of powers of the acting members of council, and also appointment of the chairman of the board are performed by at least than three voices of members of council.
10. Council has the right to create specialized committees for preliminary consideration of key questions (on audit, risk management, ethics, personnel and remunerations, investment policy).
11. Council consists of the chairman of the board and nine members of council, including the head of managing company of SFIT "Tamchy".
12. Representatives of the Kyrgyz Republic and investors are part of Council.
13. The minimum quantitative structure for ensuring competence of Council - seven members.
14. The nominated persons having the international experience in the field of commercial case, finance, banking, law, insurance case, financial accounting, the capital markets or any other competence can be members of council.
15. Effective period of powers of members of council constitutes five years.
16. Powers of members of council can be prolonged any number of times according to the provisions provided by the Section 3 presents of the Procedure.
17. Powers of the member of council stop ahead of schedule the chairman of the board in the following cases:
- submissions of the written application by the member of council about voluntary retirement in 30 calendar days;
- approaches of impossibility to fulfill duties for health reasons, confirmed with the medical certificate;
- recognitions of person incapacitated or it is limited by the capable become effective judgment;
