1. Approve the enclosed Rules of creation of government commission on investigation of the accidents which are not connected with labor activity and accident on hazardous production facility in case of which five and more people died.

2. This resolution becomes effective after ten calendar days after day of its first official publication.

Chapter 1. General provisions

1. These rules of creation of government commission on investigation of the accidents which are not connected with labor activity and accident on hazardous production facility in case of which five and more people died are developed according to the subitem 71) of article 11 of the Law of the Republic of Kazakhstan "About civil protection" and determine procedure for creation of government commission by investigation of the accidents which are not connected with labor activity and accident on hazardous production facility in case of which five and more people died (further - government commission).

2. The purpose of creation of government commission is investigation of the accidents which are not connected with labor activity and accident on hazardous production facility in case of which five and more people died (further - accidents).

Chapter 2. Procedure for creation of government commission

The state body responsible for forming and realization of state policy in the corresponding industry in which there was accident (further - state body), within a day from the moment of accident informs in writing the President or the Prime Minister of the Republic of Kazakhstan on the happened accident with the offer on feasibility of creation of government commission.

Informing is performed in cases of possible influence of accident on social and (or) social and political situation and (or) need of coordination of interdepartmental interaction of the central and local executive bodies, and also in the absence of illegal actions of the third parties.

In case of lack of need of creation of government commission by state bodies measures for establishment of accident causes are independently taken.

4. Based on the order of the President or the Prime Minister of the Republic of Kazakhstan the state body develops the draft of the order of the Prime Minister of the Republic of Kazakhstan about creation of government commission and submits it for approval in Government office of the Republic of Kazakhstan.

5. Government commission is created as a part of the chairman, the vice-chairman and members of government commission.

Government commission are included:

1) the Prime Minister of the Republic of Kazakhstan or the Deputy prime minister of the Republic of Kazakhstan or the first head of state body as the chairman;

2) the Deputy prime minister of the Republic of Kazakhstan either the first head of state body or the deputy first head of one of the interested state bodies as the vice-chairman;

3) deputy first heads of the interested state bodies, akims or deputy akims of areas, cities of republican value and the capital as members of government commission;

4) other officials as members of government commission.

6. The decision of government commission is drawn up by the protocol which is signed by the chairman, the vice-chairman and members of government commission.
