Based on Item 2 of the Presidential decree of the Republic of Belarus of June 13, 2023 "About taking measures in the field of pricing" the Council of Ministers of the Republic of Belarus DECIDES: No. 171

1. Enter regulation:

goods prices, made (imported) and (or) realized in the territory of the Republic of Belarus by legal entities and individual entrepreneurs, according to appendix (further – goods);

rates for works (services) in burial performed (rendered) in the territory of the Republic of Belarus legal entities and individual entrepreneurs (further – works (service) in burial), the services in burial except for guaranteed;

prices for products, intended for food of students in Suvorov Military Schools (further – Suvorov Military School students), cadets, and also the students studying in military forming and paramilitary organizations (further – students), in cases when in case of the conclusion of agreements on catering services food of the specified categories of students is provided.

2. Operation of this resolution extends on legal entities and the individual entrepreneurs selling products specified in paragraph four of Item 1 of this resolution under catering services of Suvorov Military School students, cadets, and also students within the signed agreements on catering services of the specified categories of students (further – subjects of food).

3. Determine that:

3.1. limiting maximum allowances of importers, limiting maximum wholesale allowances, trade allowances (taking into account the wholesale allowance) on goods are applied in the values specified in appendix;

3.2. the limiting maximum standard rate of profitability used for determination of the amount of the profit which is subject to inclusion in selling prices of producers on goods and in rates for works (services) in burial constitutes 50 percent;

3.3. the cost of raw materials and the materials used when rendering works (services) in burial joins in rate for work (service) in burial at the price of their acquisition and actually incurred expenses on delivery;

3.4. retail price on products intended for food of Suvorov Military School students, cadets, and also students is established proceeding from the cost of the corresponding ration established respectively by the Ministry of Defence, the Ministry of Emergency Situations, the State boundary committee in coordination with the Ministry of Finance and limiting maximum markup;

3.5. the limiting maximum markup constitutes:

in organizations of general secondary education – 40 percent;

in the organizations of education which are not specified in the paragraph the second this subitem and also out of the location of organization of education:

under catering services without compensation by the subject of food of expenses and costs according to part one of subitem 1.13 of Item 1 of the Presidential decree of the Republic of Belarus of May 16, 2023 No. 138 "About lease and free use by property" – 40 percent;

under catering services with full recovery the subject of food of the expenses and costs specified in paragraph four of this subitem – 50 percent.

4. The remaining balance of goods formed at importers and subjects of trade on the date of entry into force of this resolution is implemented:

before new receipt of the same goods – at the prices which are not exceeding the level which developed on the date of entry into force of this resolution;

in case of new receipt of the same goods from the effective date this resolution – at the prices not above created according to this resolution on again arrived goods.

In case of acquisition at the subjects of trade performing wholesale trade, remaining balance of the goods formed on the date of entry into force of this resolution, the trade allowances (without the wholesale allowance) which are not exceeding specified in appendix can be applied by the subjects of trade performing retail trade to the acquisition prices provided that before the date of entry into force of this resolution concerning goods state regulation of the prices by establishment of the maximum wholesale (trade) allowances was not performed.

In addition to the data containing in commodity-transport delivery note and the consignment note the data connected with establishment of regulated prices for goods by the subjects of trade performing wholesale trade in case of sales of goods according to parts one and the second this Item and also information that the implementable goods belong to the remaining balance formed on the date of entry into force of this resolution are specified.

5. Selling prices on the goods developed from raw materials supplied by the customer and intended for realization in the territory of the Republic of Belarus are created by the customer proceeding from the cost of raw materials, expenses connected with its acquisition and conversion, the established taxes and other obligatory payments, arrived, but it is not higher than the level of selling prices created by the producer on the similar goods made of own raw materials.

6. The procedure for determination of cost of goods, works (services) in burial for forming of selling price (rate) is established by the Ministry of Housing and Public Utilities together with the Ministry of anti-monopoly regulation and trade.

7. This resolution becomes effective in month after its official publication.
