About the register of organizers of cultural and spectacular actions

Based on part two of Item 3 of Article 213-1 of Kodeks Respubl_k_ Belarus аб cultures, parts two of article 35 of the Law of the Republic of Belarus of July 23, 2008 No. 424-Z "About Council of Ministers of the Republic of Belarus" the Council of Ministers of the Republic of Belarus DECIDES:

1. Approve Regulations on procedure for forming and maintaining the register of organizers of cultural and spectacular actions it (is applied).

2. Determine that:

the organization and holding cultural and spectacular actions (further, unless otherwise specified, – actions) with participation of the Belarusian and (or) foreign contractors are allowed only by the event managers included in the register of organizers of cultural and spectacular actions (further, unless otherwise specified, – the register) if other is not established by the President of the Republic of Belarus;

inclusion in the register grants to event managers the right to perform one or several types of activity:

the organization and holding actions with participation of the Belarusian and (or) foreign contractors in the territory of the Republic of Belarus;

the organization and holding actions with participation of the Belarusian and (or) foreign contractors in the territory of one of areas, Minsk;

the organization and holding actions with participation of the Belarusian contractors in the territory of the Republic of Belarus;

the organization and holding performances with participation of the Belarusian and (or) foreign contractors in the territory of the Republic of Belarus.

The type (types) of activities in which the event manager has the right to be engaged is specified in the register and the statement from it.

For the organization and holding actions with participation of the Belarusian and (or) foreign contractors of the organization, except for the event managers included in the register, and the cases specified in Item 3 of this resolution sign the contract with the event manager included in the register.

3. Requirements of paragraph two of part one of Item 2 of this resolution do not extend to event managers with participation of the Belarusian contractors if they are carried out:

according to the decision and (or) with participation of the President of the Republic of Belarus;

according to the decision of Council of Ministers of the Republic of Belarus, republican state bodies, local executive and administrative organs;

state bodies, structural divisions of state bodies;

National state broadcasting company of the Republic of Belarus;

legal entities to which functions of editorial offices of television mass media, the being receivers of subsidies from the republican budget are assigned;

the state organizations * with the assistance of only contractors and (or) other creative specialists performing public performance of results of creative activities, being workers (students) of data of the organizations created by them collectives of art creativity;

by the state organizations when holding actions without implementation of tickets of admission on scenic platforms which are in property, economic maintaining or operational management of data of the organizations, or are transferred to them to free use, or are leased for the term of at least six months, with involvement of contractors and collectives of art creativity under civil agreements;

public associations of disabled people and their organizational structures, the legal entities performing the organization and holding actions with participation only of disabled contractors, included in the list established by the Ministry of Culture in coordination with the Ministry of Labour and Social Protection with the assistance of only disabled contractors who are members and (or) workers of data of public associations and (or) their organizational structures, legal entities and (or) being in structure of the collectives of art creativity created by them;

by the organizations rendering services of public catering, improvement and sanatorium treatment of the population, hotel services with the assistance of only contractors who are workers of data of the organizations (their structural divisions) in rooms which are in property, economic maintaining or operational management of data of the organizations, or are transferred to them to free use, or are leased by them for the term of at least six months.

4. Event managers shall:

have the statements from the register issued in accordance with the established procedure by the Ministry of Culture, except as specified, when inclusion in the register is not required;

receive according to the procedure, established by the legislation, certificates on the right of the organization and holding cultural and spectacular actions in the territory of the Republic of Belarus, except as specified, when receipt of certificates is not required;

provide approval of programs (scenarios) of actions and their realization during these actions;

provide implementation of tickets of admission and the printed materials containing information on actions if their realization (distribution) is provided;

provide presence of the representatives on scenic platforms, in mobile scenic complexes, rooms and (or) on the open areas during actions;

provide holding actions at the high art level taking into account Kodeks Respubl_k_'s requirements Belarus аб cultures;

provide the conclusion of agreements for the organization and holding actions taking into account the features established in Item 5 of this resolution;

not allow cooperation * with persons on whom decisions on prohibition, restriction or suspension of cultural activities according to Article 81 of Kodeks Respubl_k_ Belarus аб cultures were made;

terminate service provision agreements on the organization and holding actions in case of their exception of the register, except as specified, when inclusion in the register is not required;

in case of exception them from the register to hand over statements from the register in the Ministry of Culture no later than three working days after obtaining from the Ministry of Culture of notifications on the made decisions on exception of event managers of the register, except as specified, when inclusion in the register is not required;

perform other requirements established by this resolution.
